Dear Atty.

X,
I write to request your opinion on something that happened to me a few days ago.
I was on vacation in Honolulu, Hawaii for an extended Christmas getaway with my
family. On January 11, 2016, I reported for work bearing gifts from my trip for all
my bosses. This one particular boss of mine came to my cubicle and grabbed my
hand, thanking me for the gift. He then started pulling me towards him to kiss me
on the cheek. Thinking that my boss did not do this with malice and he was just
elated by my thoughtfulness, I let it go and continued with my work.
A week later, however, my boss came to my cubicle, saying he will get some
documents. After he got the documents he was looking for, he took my hand and
greeted me, Good morning! Its so nice to have you here. He then embraced me
and kissed my cheek. At this point, I am already uncomfortable and, although
shaking due to fear and disgust, I slightly pushed him away. This whole incident
was witnessed by my officemates who are occupying the same cubicle as me. Even
if I was already experiencing discomfort in my workplace, I proceeded to do my
job. I made it a point, however, to minimize contact with my boss. During the
times he called me to his office to discuss the project that we have been doing for
some major energy company, I evaded all his attempts to kiss me on the cheek.
A week ago, having successfully won the bidding for a project with a
telecommunications company, our office was in a celebratory mood. We threw a
victory party one night and while all of us were enjoying ourselves, congratulating
one another, my boss came up to me and put his arms around my shoulders and
kissed me on the cheek, to my great disgust and embarrassment. I could not look
my officemates in the eye from then on, paranoid that theyre thinking my boss and
I are in some kind of a relationship. The day after the party, although I wasnt
feeling well, I came to work. My boss was already in his room when I arrived.
When he saw me, he told me to come to his room to discuss the proposals I
submitted for our new project. Afraid that he might do something lewd to me
again, I asked a co-worker to accompany me under the pretence of discussing the
project with my boss. My boss already left for a meeting though when we arrived,
to my great relief.
It was last Monday when I reached my breaking point. I came to work earlier than
usual to get a head start on my deadlines for the week. Apparently, my boss also
came in early. When he saw me, he grabbed me in an embrace, kissed my cheek
again and remarked, Ang gandang makita ka sa umaga. Weak in the knees, I fell
to my seat, trembling. When I felt that I could not hold my tears any longer, I
locked myself up in the comfort room and cried my heart out. It was then that I
realized that I could not take it anymore. I know deep in my heart that I have to
quit my job that I love so much. At the same time, I want my boss to suffer the
consequences of his actions. In addition to an administrative complaint to be filed
with our companys human resource department, I am considering court action
against my boss. I am at a loss, however, on what offense or misconduct he
committed. I did some reading myself and I think my boss committed acts of

lasciviousness and sexual harassment, but I am not quite sure. Please advise me
on this and on the possibility of winning a lawsuit against him. Thank you.
Sincerely,
Y
