Objectives

101.

"Uniform certification and approval standards for military equipment are a prerequisite for the

enhancement of military cooperation within the EU and NATO. This applies in particular to military
aviation."1
102.

The establishment of the Luftfahrtamt der Bundeswehr2 (German Military Aviation

Authority/GMAA) has provided a comprehensive single authority that is responsible for the
airworthiness of aircraft and aeronautical equipment and for any regulatory aspects in connection with
military flight operations.
103.

The intention of the Executive Group of the Federal Ministry of Defense (FMoD) was to

concentrate functional and organizational competences in one authority, to establish clear


responsibilities and decision-making powers and to reduce the number of interfaces.

As per state secretary decision dated 21 October 2013 (FMoD Org - Ref. 10 01 00)3, the

GMAA is directly subordinate to the FMoD. Administrative control over the GMAA is exercised by the
Chief of Defense, whereas functional control of the GMAA will be provided by the competent
organizational elements of the FMoD irrespective of the administrative chain of command.4
202.

In addition to Par. 201 above, the management on MoD level and functional supervision of

the GMAA will occur under the coordinating guidance of the Directorate-General for Forces Policy
(FSK) of the FMoD5 when tasks and responsibilities of a national military aviation authority are
concerned. As indicated in the letter by FMoD Organization, which was approved by the State
Secretary on 28 March 20146, this task of coordinating guidance has been assigned to the FSK I 5
branch.
203.

This General Publication A-270/3 shall be considered as a supplement to General Publication

A-500/1 further specifying responsibilities with regard to functional cooperation. Basic requirements set
in General Publication A-500/1 remain unaffected and will be amended by this General Publication
only when necessary.
204.

According to the Dresdener Erlass [military-political guidance document], the FMoD is to

concentrate on its ministerial core tasks. As the GMAA will be handed over tasks that up to now have
been performed by the FMoD, the respective responsibilities and competences must be defined.

As a matter of principle, all Bundeswehr flight operations must be performed in accordance

with the German Civil Aviation Act.


302.

30, Par. 1 of the German Civil Aviation Act provides the possibility to deviate from the

regulations set in this act and the related implementing orders when required to fulfill special tasks of
the Bundeswehr considering public safety and order. Deviations from the directives/regulations for
operating in the airspace are permitted only as far as they are absolutely necessary for performing
sovereign tasks.
303.

EU regulations on civil aviation are not applicable for military air traffic (cf. Art. 1, Par. 2 of

Regulation (EC) No. 216/2008). Nevertheless, the EU member states are obliged to observe the
objectives of Regulation (EC) No. 216/2008 during military flight operations as far as practicable.7
304.

As far as this General Publication delegates the responsibility for directives/regulations based

on 30 of the German Civil Aviation Act to the GMAA, the provisions of the German Civil Aviation Act
have to be observed.

In the course of the amendment of the German Civil Aviation Act, the wording of 30 will be modified to reflect
this legal situation.

Purpose and Scope of Application

401.

This General Publication specifies the interrelationships between the FMOD, the GMAA and

all other entities involved in the performance of military flight operations.


402.

It is the basic document for ensuring safe military flight operations and use of military airspace

in Germany. In this context, ensuring military flight operations implies the establishment and the
support of airworthiness of aircraft as well as building and supporting the framework conditions and the
supporting environment required for the performance of safe flight operations.
403.

With the establishment of the GMAA, the responsibility for a number of joint regulations,

which

Responsibilities and Competences

5.1

General

501.

The core mission of the GMAA is derived from the overriding objectives pursued by the

FMoD's Executive Group with the establishment of the GMAA:


concentrate the functional responsibility for all matters concerning the safety of military flight
operations in one single authority;
establish clear decision-making processes, competences and responsibilities;
establish the framework conditions required for a stringent implementation of the European Military
Airworthiness Requirements (EMAR);
ensure appropriate representation at all levels in national and international panels.
502.

The mission of the GMAA is to execute the functional supervision required for the realization

of safe flight operations of the Bundeswehr. Within the scope of this task spectrum, which has been
handed over from the FMoD to the GMAA, it will also exercise the legal supervision in all areas related
to Bundeswehr flight operations. In this context, the GMAA is authorized to issue directives and
conduct monitoring activities.
503.

Within the scope of its mission, the GMAA will act as the primary functional authority and is

generally to issue all relevant mission-related directives of the first level subordinated to the FMoD
(IAW General Publication A-550/1, Annex 7.1.). It coordinates all activities related to the
implementation of EMAR regulations at national level. Within the scope of its mission, the GMAA is to
represent the FMoD and the Bundeswehr in mission related national and international panels.
504.

The mission and tasks of the GMAA are specified in Annex 2 of the Organization Directive8.

The responsibilities and competences in the respective subject areas are summarized in this chapter.
505.

Responsibilities for common tasks result from the administrative subordination of the GMAA

to the Chief of Defense. Deviations shall be laid down in specific service agreements.
506.

The FMoD may assign additional tasks in the field of military aviation to the GMAA.

Fragmentary instructions issued by the FMoD which concern basically new subject areas and
responsibilities as well as

related new or modified interrelationships will normally require an

amendment of this capstone document and could be accompanied by organizational measures when
necessary.

507.

Inquiries from the political-parliamentary sector which concern the tasks of the GMAA will be

answered under coordinating guidance by FMoD FSK I 5.


508.

The GMAA may delegate specific tasks or sub-tasks to other agencies, if agreed on by these

agencies, in order to ensure execution of these tasks at the appropriate levels. Any delegation of tasks
shall be documented. The overall responsibility will remain with the GMAA.
509.

The GMAA is to establish and maintain an internal quality management system in accordance

with applicable QMS standards (e.g. DIN EN ISO 9001, DIN EN 9100) and aeronautical standards.
This system will serve, in particular, as the basis for the mutual recognition processes between
aviation authorities.

5.2

Airworthiness Verification and Certification Policy Matters for

Aircraft and Aeronautical Equipment


5.2.1

Fundamental Provisions

510.

At present, airworthiness verification and certification matters are covered by two

independently and basic types of regulations, on the one hand the General Publication A-1525/1,
"Das Prf- und Zulassungswesen fr Luftfahrzeuge und Luftfahrtgert, Teil 1" (Airworthiness
Verification and Certification Regulations for Aircraft and Aeronautical Equipment, Part 1), in
conjunction with General Publication A-1525/2, "Das Prf- und Zulassungswesen fr Luftfahrzeuge
und Luftfahrtgert, Teil 2" (Airworthiness Verification and Certification Regulations for Aircraft and
Aeronautical Equipment, Part 2), and on the other hand the type DEMAR9 regulations, which still need
to be developed. The respective responsibilities and competences within these types of regulations
will be specified in the following paragraphs.
511.

Generally, the provisions of General Publications A-1525/1 and A-1525/2 shall apply. The

applicability of other regulations, e.g. DEMAR, will be directed by the FMoD on a case-by-case basis.
512.

The GMAA is to support procurement and utilization procedures in accordance with General

Publication A-1500/3, "Customer Product Management" (amended), and is to support integrated


project teams (IPT) with subject matter expertise as required.

5.2.2

Stipulation of Tasks and Responsibilities

513.

With regard to airworthiness verification and certification matters of aircraft and aeronautical

equipment, the GMAA is responsible for the following tasks:


a) Conduct of type inspections and granting of type certificates for Bundeswehr aircraft, aeronautical
equipment and ground-based air traffic control installations,
b) Issuance of certificates of airworthiness for Bundeswehr aircraft,
c) Registration of Bundeswehr aircraft in the aircraft register,
d) Exercising of NMAA10 tasks in accordance with DEMAR,
e) Issuance of airworthiness certificates and military airworthiness review certificates for Bundeswehr
aircraft to which DEMAR standards are applied,
f) Licensing of inspection personnel and authorized personnel for release to service in accordance
with General Publications A-1525/1 and A-1525/2,
g) Licensing of aircraft engineering personnel in accordance with DEMAR,
h) Issuance of authorizations for military flight operations and individual aircraft restricted
airworthiness certificates,
i) Approval of maintenance, repair and special repair procedures,
j) Performance of the duties of the responsible Bundeswehr level 3 testing authority for nondestructive material testing and approval of inspection instructions for non-destructive material
testing,
k) Issuance of airworthiness directives,
l) Approval of relevant type-related technical modifications of defense materiel,
m) Issuance of instructions for product-related airworthiness standards by issuing related provisions at
the first level subordinate to the FMoD in accordance with General Publication A-550/1, special
directives, DEMAR,
n) Issuance of instructions for standardization requirements for technical operating procedures
concerning airworthiness of aircraft and aeronautical equipment (cf. FMoD FSK III 1, "Aufgaben
des LufABw" (Tasks to be performed by the GMAA), dated 14 April 2014),
o) Auditing, authorizing or recognition and monitoring of organizations, enterprises and training
facilities,
p) Recognition of military aviation authorities of other nations,
q) Issuing instructions for auditor training standards including central course planning, qualification of
auditors and maintenance of related records,
r) Issuing instructions for aircraft engineering training standards and requirements for training
contents and training procedures,

s) Provision of advisory support to the Federal Office of Bundeswehr Equipment, Information


Technology and In-Service Support on airworthiness and certification matters in draft contracts for
the development/procurement/maintenance of aircraft or aeronautical equipment,
t) Provision of advisory support to the in-service and supply managers,
u) Provision of advisory support to the materiel manager for operational viability and the holder of the
military type certificate,
v) Analysis of discrepancy reports and evaluation whether the discrepancies affect the
type/airworthiness certificate or flight safety and thus require an intervention of the supervising
authority, e.g. by issuing an airworthiness directive or convening a meeting of the flight safety
committee,
w) Analysis of international directives, agreements, laws and regulations and evaluation of their
relevance for airworthiness verification and certification of aircraft and aeronautical equipment,
x) Presentation of related topics at international and national level.
514.

With regard to airworthiness verification and certification of aircraft and aeronautical

equipment, the FMoD is responsible for the following tasks:


a) Issuance of directives/regulations on the implementation of all applicable fields of airworthiness
regulations (currently, procedures in accordance with General Publication A-1525/1 and DEMAR)
which also define responsibilities and competences,
b) Provision of interministerial coordination,
c) Determination of the field of airworthiness regulation to be applied for specific weapon systems,
d) Decision on deviations from basic principles of airworthiness verification and certification derived
from the EU Basic Regulation and the German Civil Aviation Act. These principles comprise the
following provisions:
Aircraft must be type-approved and have a type certificate and an airworthiness certificate.
Aircraft must be registered in the Bundeswehr Aircraft Registry.
Airworthiness papers must exist for aeronautical equipment and flight safety-critical assemblies.
Commercial enterprises or organizations that develop manufacture or maintain aircraft or
aeronautical equipment must be approved and certified by the responsible supervising authority.
Aircraft engineering personnel and inspection personnel must be authorized to perform their
tasks on the basis of their qualification and experience.
The tasks of and the relations between the design company, the airworthiness authority, the
holder of the military type certificate and the operator must be clearly defined and separated
from each other.

The Director of the Federal Office of Bundeswehr Equipment, Information Technology and In-

Service Support is responsible for the following tasks:


a) Implementation of the provisions of this document and the provisions of General Publication A1525/1, General Publication A-1525/2 and DEMAR within the area of responsibility of the Federal
Office of Bundeswehr Equipment, Information Technology and In-Service Support and in contracts
with the industry. The implementation may entail deviations/exemptions from the airworthiness
verification and certification rules for aircraft and aeronautical equipment if such exemptions have
been authorized by the FMoD, e.g. on the basis of a MoU11 or FMS12 case.
b) Performance of technical aeronautical inspections (prototype, preproduction, product conformity
and airworthiness reverification inspections) in accordance with General Publications A-1525/1 and
A-1525/2 at industrial contractors,
c) Determination of aircraft type-related tasks to be performed by the holder of the military type
certificate:
Submission of requests for a comprehensive, supplementary or simplified type inspection to the
GMAA,
Presentation of type design documentation and compliance documents by the tasked
type/system supporting company to the GMAA,
Maintenance of type design documentation (generally done within the scope of technical-logistic
support by the type/system supporting company),
Compilation and updating of the documentation (generally within the scope of technical-logistic
support) in cooperation with the GMAA,
Conducting product monitoring tasks, which includes processing of discrepancy reports
submitted by non-Bundeswehr agencies and submission of incoming discrepancy reports to the
GMAA as well as to the in-service and supply managers. He or she may propose to the GMAA
the convening of a meeting of the flight safety committee. Details shall be specified in a
procedural arrangement to be made out between the in-service and supply managers and the
materiel manager for operational viability.
Establishment of maintenance and repair procedures in cooperation with the GMAA,
Preparation of technical modifications of defense materiel and submission of the modifications to
the GMAA for supplementary type inspection (type-relevant service bulletins of a design
company shall be processed in the same way since they would not become valid within the
closed military regulatory area without a supplementary type inspection performed e.g. by the
GMAA); obtaining of program manager's contributions to technical modifications of defense
materiel (logistic provisions, technical provisions for the implementation on aircraft, compliance

demonstration, use of tools, selection of contractors for the performance of the modification,
amendment of the documentation as required); putting into effect of the completed technical
modification of defense materiel and submission of the technical modification to the in-service
manager for implementation,
Performance of the functions of the holder of the military type certificate in accordance with
DEMAR.
516.

The in-service and supply manager is responsible for the following tasks:

a) Implementation of the provisions of this capstone document, of General Publication A-1525/1,


General Publication A-1525/2 and DEMAR and of operating procedures concerning airworthiness
of aircraft and aeronautical equipment specified by the GMAA within the own organizational area,
b) Initial processing of discrepancy reports. If the responsibilities of the holder of the military type
certificate are involved, the in-service and supply manager will delegate the performance of this
task to the holder of the military type certificate. Otherwise, the in-service and supply manager is
responsible for the completion of the process. He or she may propose to the GMAA the convening
of a meeting of the flight safety committee. Details shall be specified in a procedural arrangement to
be made out between the in-service and supply manager and the materiel manager for operational
viability.
c) Issuance of technical operating instructions in order to implement technical modifications of
defense materiel on individual aircraft. Technical operating instructions for instruction of
personnel/performance of inspections may be issued by the in-service manager on his/her own
responsibility.
d) Application of Par. 316 of General Publication A-1525/1 in accordance with the provisions of this
document also to aircraft of his/her organizational area, which are detached to the Bundeswehr
Joint Forces Operations Command. For this purpose, advice must be generally obtained from the
GMAA (Par. 513).
e) Performance of assigned tasks for all aircraft of holders within his/her organizational area. This is of
particular importance for the participation in flight safety committees convened under the direction
of the GMAA and for the implementation of the related conclusions.

5.3

Flight Service/Flight Operations

517.

The GMAA is tasked with the basic regulation and standardization of Bundeswehr flight

operations13 as well as military flight operations in Germany, which also includes the services that
support flight operations. For this purpose, the GMAA acts as the issuing authority of relevant flight
operations procedures/regulations (see Annex 7.1, Par. 3 ff.).

This task includes the following responsibilities:

Preparation of required changes or updates to flight operations regulations and publication of these
changes and updates in the Military Aeronautical Information Publication Germany (MilAIP) for all
organizational areas and for the allied forces in Germany,
Acting as the coordinating agency for modifications to the airspace structure/airspace control in
accordance with user requirements of the Bundeswehr and the allied air forces,
Public relations work for military flight operations.

5.4

Recognition and Licensing

519.

The GMAA is responsible for auditing, approving or recognizing organizations and companies

and for licensing personnel whose primary tasks are the conduction of aviation tasks and duties or the
provision of aviation services which may only be performed by licensed personnel.
520.

The airworthiness verification and certification rules/regulations contain requirements for the

approval/recognition of companies/organizations and for the licensing of personnel. Section 5.2 shall
therefore be observed.
521.

The DEMAR stipulate that Continuing Airworthiness Management Organizations (CAMO),

design, production and maintenance companies and training facilities of the Bundeswehr and of
commercial partners are subject to approval and regular auditing. The DEMAR also stipulate that the
qualification and reliability of personnel employed in these organizations, companies and facilities has
to be proved.
522.

In the course of the tasked conversion of EMAR standards into DEMAR, the basic principle of

approval/recognition and licensing shall be adopted and further developed step by step in order to
ensure safe performance of military flight operations. The regulations/standards required for this
purpose (e.g. DEMAR and subordinate documents) shall be issued by the GMAA and reviewed within
the scope of a continuous monitoring and approval program. In this context, it is of special importance
that the DEMAR are updated on a regular basis in order to guarantee that the DEMAR standards are
continuously kept up to date with the basic EMAR and related EASA regulations.
523.

The approval/recognition and licensing task also includes the approval of technical aviation

companies of commercial partners as well as licensing of inspection personnel/authorized personnel


for release to service for Bundeswehr aircraft and aeronautical equipment in accordance with General
Publications A-1525/1, and A-1525/2 and other regulations IAW Annex 7.1.
524.

Generally, licensing of personnel serving in the flying service, aviation control services,

aeronautical information service, aerospace medicine service and parachute jumping service of the
Bundeswehr, of crews and operators of remotely piloted aircraft systems (RPAS) and of inspection
personnel/authorized personnel for release to service will be held, regulated and performed by the

GMAA. The procedural provisions concerning the issuance/prolongation/extension/withdrawal/renewal


of licenses and permits as well as the licensing regulations shall be prepared, issued and updated by
the GMAA.
525.

In accordance with the Org Directive14, the GMAA will act as the central management agency

for approval/recognition and licensing tasks. For this purpose, the FMoD entrusts the GMAA with the
function of the issuing authority for regulations concerning approval/recognition and licensing matters
(in whole or partially) which used to be issued by the FMoD.
526.

Provisions concerning the approval/recognition procedures for organizations/companies/

facilities or licensing of personnel shall be determined and directed by the GMAA.


527.

In order to execute and decide on approval/recognition, licensing and withdrawal procedures

on behalf of the GMAA and to handle appeals and complaints filed by individuals concerned, the
Director General of the GMAA will nominate the responsible officials and authorities within the GMAA
and delegate the required level of decision-making powers to them.
528.

If required, the GMAA will conduct the recognition process for (military) aviation authorities of

other nations. For this purpose, the European Military Airworthiness Document - Recognition (EMADR) should be used as a guideline.
529.

Steps for each recognition process shall be developed individually for the respective subject

matter in accordance with EMAD-R and if applicable with other aviation policy documents (e.g. EU
regulations).
530.

Following the successful completion of the recognition process, the GMAA is in charge to

recognize the foreign aviation authority with regard to the subject matter concerned.

5.5

Flight Control Services15 and Aeronautical Information Service

531.

The GMAA is responsible for the basic regulation and standardization of the aviation control

services and the aeronautical information service within the scope of Bundeswehr flight operations.
532.

The GMAA is responsible for providing central safety supervision over military aviation control

services on the basis of established quality and safety management systems derived from the relevant
EU regulations. In this context, it will issue directives/regulations with normative character, will review
and approve documents prepared by the major organizational elements/military major organizational

elements and certify/audit the agencies of the military aviation control services. This includes
monitoring of the required measures.
533.

Modifications to systems, procedures or operations of the aviation control services are subject

to legal, technical and/or operational evaluation and certification by the GMAA.


534.

The GMAA is tasked with the issuance of basic technical guidelines for the military air traffic

control service, the tactical control service, the aeronautical information service and the technical
systems used. These guidelines shall be based on international, in particular European standards. An
appropriate degree of interoperability with civilian systems is desirable, provided this does not conflict
with military requirements.
535.

The GMAA specifies the basic, advanced and follow-on training policy and develops technical

guidelines for the licensing of appointed personnel.


536.

Within the scope of its responsibilities, the GMAA closely cooperates with the Federal

Supervisory Authority for Air Navigation Services16 and maintains a liaison office at the headquarters
of this agency. An agreement was signed by both agencies17 describing the areas of responsibility
concerning supervision and certification of civil and military air traffic management services
respectively. It also regulates the status of the mentioned liaison office.
537.

In order to provide a professional overview for developments at the European level, the

GMAA runs an Air Traffic Management Liaison Office in Brussels. The Brussels liaison office is the
local German interface for all relevant questions related to the Single European Sky/Single European
Sky Air Traffic Management Research Programme (SES/SESAR). Thus, the GMAA assumes a central
role in the SES/SESAR project work.
538.

In addition, the GMAA will ensure the safeguarding of all related interests in bodies of NATO

and other organizations at the level below the FMoD.


539.

The responsibility for the definition of the overall strategic-political objectives and for the

issuance of related directives rests with the respective functional branch of the FMoD. This requires
regular coordination between the GMAA and the functional branches of the FMoD. Any tasks/missions
exceeding the competences of the GMAA as well as the required directive- and reporting system will
be dealt with according to the ministerial guidance of AIN II 2 and FSK I 5 on a case by case basis.

Infrastructure

The GMAA exercises the functions of the former Military Aviation Authority of the Federal

Office of Bundeswehr Infrastructure, Environmental Protection and Services18. The GMAA is


responsible for the implementation and approval of inspection procedures for military airfields
stipulated by aviation law and for the identification, modification or cancellation of construction
restriction zones. Where military flight operations are permanently discontinued on a military airfield,
the GMAA will terminate military ownership of this site and withdraw the declaration for the use of this
site as an airfield if there is no civilian follow-on user.
541.

The GMAA may permit air traffic obstacles and issue sufferance notes on its own

responsibility unless other state authorities are responsible for these issues. In addition, it is
responsible for processing claims for compensation in accordance with the Civil Aviation Act and
claims for reimbursement of expenses in accordance with the Aircraft Noise Act.
542.

A detailed description of the tasks [related to infrastructural matters] is provided in Annex 7.2,

"Individual Arrangements".
543.

In matters concerning the planning and permission of buildings, the Federal Office of

Bundeswehr Infrastructure, Environmental Protection and Services19, in its role as an agency with
responsibilities for matters of public concern, will represent the interests of the Bundeswehr towards
the permitting authorities of the Federal States. The GMAA will support the Federal Office of
Bundeswehr Infrastructure, Environmental Protection and Services in all matters concerning air traffic
control and flight operations and provide an expert opinion.

5.7

Protective Tasks

544.

The statutory protective tasks comprise the implementation of statutory requirements

concerning occupational 20 and environmental protection21 and hazard prevention22 to be applied in the
Bundeswehr.
545.

The regulations on statutory protective tasks issued in the FMoD's area of responsibility shall

be complied with in all activities of the GMAA. In addition to the implementation of statutory protective
tasks, the GMAA will support the Federal Office of Bundeswehr Infrastructure, Environmental

Aviation Security

546.

Regulation (EC) No. 300/200823 and the German Aviation Security Act24 are the basic

documents for ensuring air traffic security. The term "airspace security" within the field of aviation
security covers all tasks provided by the Bundeswehr in order to ensure those measures that may be
required in accordance with Article 14 of the German Aviation Security Act25. The topic airspace
security and the related directives/regulations are not subject of this General Publication and will be
addressed in separate regulations.
547.

The GMAA is responsible for the general regulation of aviation security in the area of military

flight operations as well as for the compliance with provisions on civil aviation security in accordance
with the provisions of the German Aviation Security Act and Regulation (EC) No. 300/2008 on
common rules in the field of civil aviation security in conjunction with Regulation (EC) No. 185/201026
laying down detailed measures for the implementation of the common basic standards on aviation
security.
For this purpose, the GMAA shall implement the provisions of the German Aviation Security Act and
the relevant EC Regulations in the Bundeswehr in close coordination with the FMoD and establish an
agreed scope of standards for the Bundeswehr.
548.

The Bundeswehr Logistics Command with its air transport security branch (and the function of

the Bundeswehr Chief Air Transport Security Officer) is responsible for ensuring the secure transport
and supply chain within the Bundeswehr logistics system and in the run up to an air transport
operation.
549.

The Bundeswehr Logistics Command issues regulations on air transport security within the

Bundeswehr logistics system and coordinates them with the GMAA before they are implemented. The
GMAA in the context of its task to ensure the safety of military flight operations and to implement the
provisions on civil aviation security issues regulations for establishing/maintaining/ensuring aviation
security and coordinates these regulations with the Bundeswehr Logistics Command if logistic matters
are concerned.

Authorizations, approvals and licenses in accordance with Regulation (EC) No. 300/2008 and

the German Aviation Security Act will be provided either directly by the GMAA or, as far as air
transport security within the Bundeswehr logistics system is concerned, by the Bundeswehr Logistics
Command in cooperation and coordination with the GMAA.

5.9

Aviation Safety

551.

The FMoD delegates the overall task [in terms of oversight] of aviation safety in the

Bundeswehr to the GMAA. The FMoD delegates the overall responsibility for aviation safety in the
Bundeswehr, which up to now has been assumed by the Chief of the Air Force, to the in-service
managers (Chiefs of the Services, Director of the Federal Office of Bundeswehr Equipment,
Information Technology and In-Service Support) for their respective areas of responsibility (aviation
safety in the Air Force, Navy, Army, Federal Office of Bundeswehr Equipment, Information Technology
and In-Service Support).
552.

The FMoD delegates the responsibility for the investigation of accidents and incidents over

and on German territory including territorial waters or on German vessels to the Directorate of
Aviation Safety Bundeswehr for any accidents/incidents where only military aircraft are involved.
553.

The responsibility for the specialized investigation of accidents and incidents associated with

the operation of civil aircraft in which military aircraft are involved, is specified in an interministerial
agreement27 based on the Air Accident Investigation Act28.
554.

Investigations of air accidents/serious incidents with aircraft of the Bundeswehr outside the

territory of the Federal Republic of Germany shall be conducted by the Directorate of Aviation Safety
Bundeswehr on the basis of agreements between nations/military authorities/agencies or as directed
by FMoD Directorate-General for Forces Policy. As far as the investigation of accidents/incidents (Cat
B) of military aircraft over international waters is concerned, these directions are considered to have
been given.
555.

In the execution of its tasks related to the investigation of accidents/incidents of military

aircraft, the Directorate of Aviation Safety Bundeswehr acts independently and is not bound by
instructions.

The FMoD authorizes the GMAA to release information from the investigation records to

individuals concerned or to their legal advisors, provided this information is needed in order to
determine, enforce or defend legal claims or for coping with bereavement.

5.10

Aviation Medicine

557.

Aeromedical regulations Category A and B will be prepared by the GMAA and issued by the

Surgeon General, Bundeswehr.


558.

Medical regulations that may affect licensing, authorization or training of personnel working in

the aviation sector are issued by mutual agreement between the issuing agency and the GMAA.

The GMAA is authorized to represent the FMoD externally in matters concerning aviation

medicine.29

5.11

Legal Issues

560.

The FMoD transfers the responsibility for the evaluation, assessment and decision of legal

issues that may arise in connection with the aforementioned tasks to the GMAA. In case of questions
regarding the basic application and interpretation of the law, the FMoD must be involved.
561.

The responsibility for participation in legislative procedures of the Federal Government or the

European Union and the right to issue statutory orders remains with the FMoD.

requires full understanding of the work relations between the FMoD and the GMAA, and in specific
cases the coordination of tasking, supporting and reporting functions.

In addition to the provisions of General Publication A-500/1 No. 306, FMoD FSK I 5 has to

be informed for informational purpose on all proceedings with the GMAA by the lead/functional branch
of the FMoD.
605.

In addition to the provisions of General Publication A-500/1 No. 306 ff., FMoD FSK I 5 has to

be informed for informational purpose by GMAA when providing reports to the FMoD and when
completing tasks assigned by the FMoD in accordance with the provisions of No. 507.

Further individual arrangements are listed in Annex 7.2 or shall be documented in functional

directives/regulations and submitted to the Ministry's authorized agency within the scope of the
updating service.

6.3

Coordinating Guidance by FMoD FSK I 5

FSK I 5 is the FMoD's branch tasked with coordinating guidance of the GMAA30 and

representing the interests of the GMAA within the FMoD.

The functional responsibility of the appropriate lead branches of the FMoD will not be affected

in any way by this coordinating guidance.


609.

In its function as the ministerial coordinator, FMoD FSK I 5 shall be informed for

informational purpose on:


tasks assigned to the GMAA by the FMoD if these tasks are assigned for the first time or if the task
assigned is a new task, and
any reports or inquiries submitted to the Federal Ministry of Defense by the GMAA.

Any questions referred to the GMAA by the media, public or political sector have to be

coordinated with FSK I 5.

Within the scope of the special task area of diplomatic flight clearance, the GMAA is the

superior authority of the Diplomatic Clearance Cell, which is under the administrative control of the
Commander, Special Air Mission Wing FMoD. Details shall be specified in the organization directives
of the affected agencies.
6.

Any violations of regulations on flight operations identified by the GMAA/Flight Operations

Monitoring and Information Center which may be effective as good publicity have to be reported to
FMoD FSK I 5.
7.

The GMAA and the Director of the Bundeswehr Geoinformation Service shall establish a

written agreement on the work relations in the functional area of the Bundeswehr Geoinformation
Service which also identifies the associated competences. The responsibility for functional matters of
the Bundeswehr Geoinformation Service rests with FMoD SE I 2 or with the Director of the
Bundeswehr Geoinformation Service.

The government quality assurance offices for military aeronautical equipment and military

aircraft of the Federal Office of Bundeswehr Equipment, Information Technology and In-Service
Support which are collocated with industrial companies in Germany shall cooperate with the GMAA on
a permanent basis. This is due to the responsibility of the government quality assurance offices for
product conformity and airworthiness reverification inspections specified in General Publications A1525/1 and A-1525/2. Apart from their tasks in the field of airworthiness verification and certification,
the responsibilities of the government quality assurance offices concerning the evaluation of supplier
suitability and qualification/QA capabilities of aerospace companies will also be an important element
in the fulfillment of sovereign tasks by the GMAA. Contributions provided by the government quality
assurance offices in this area thus form a part of the internal reporting procedures of the GMAA.

The Federal Office of Bundeswehr Equipment, Information Technology and In-Service

Support supports the GMAA with the technical expertise of its technical centers and research
institutes. The provision of support will primarily be required for the assessment of the compliance
demonstration and the preparation of supporting documents within the scope of type inspections. This
applies in particular to the execution and assessment of flight tests, the assessment of flight
performance/flight characteristics or other assessments of flight-relevant aspects, which are carried
out by test pilots and flight test engineers only available in the Equipment, Information Technology and
In-Service Support organizational area. Tasking of the agencies of the Federal Office of Bundeswehr
Equipment, Information Technology and In-Service Support is effected by means of defense technical
tasks; details are specified in a documented procedure of the Federal Office of Bundeswehr
Equipment, Information Technology and In-Service Support. The GMAA acts as the requesting party

concerning the defense technical task and the Federal Office of Bundeswehr Equipment, Information
Technology and In-Service Support as the ordering party.
10.

The Federal Office of Bundeswehr Equipment, Information Technology and In-Service

Support supports the GMAA through its government quality assurance offices by monitoring and
evaluating the inspections to be performed by the contractor within the scope of type inspections. To
obtain support, the GMAA shall notify the Federal Office of Bundeswehr Equipment, Information
Technology and In-Service Support about its support requirements.
11.

The cooperation between the GMAA and the Federal Office of Bundeswehr Equipment,

Information Technology and In-Service Support with respect to the handling of planning and approval
procedures that are of legal relevance in terms of aviation law is laid down in Special Publication
D 1800 (see Annex 7.3, Reference No. 11).
12.

All branches of the Bundeswehr [that perform duties or handle equipment as described in

this publication] will support the audits to be conducted by the GMAA by providing trained auditors.
Details will be specified by the GMAA in a documented procedure [to be issued]. Para 508 shall be
observed.
13.

For certain tasks, the GMAA may require the support of external companies. The GMAA will

identify the requirement and have the service provided within the scope of the authorized budget. With
respect to the administrative procedures, the GMAA will be supported by the local Bundeswehr
Service Center.
The Federal Office of Bundeswehr Equipment, Information Technology and In-Service Support shall
allow for project-related support services to be provided to the GMAA in the respective contracts.
14.

The GMAA will prepare an annual report and submit it to the Chief of Defense, thus providing

a contribution to the preparation of political-strategic guidelines, guidelines for further development


and the allocation of resources to the GMAA.
15.

The ministerial functional supervision over relevant parts of the "Traffic and Transportation"

business process and the "Provision of Logistic Services" service process remains with FSK III 4
within the scope of its tasks as the responsible business/service process authority. Accordingly, FSK
III 4 is responsible for the integration/tasking of the business process manager at the Bundeswehr
Logistics Command (including the air transport security branch).
16.

The responsibilities for infrastructural issues are handed over from the Military Aviation

Authority inside the Federal Office of Bundeswehr Infrastructure, Environmental Protection and
Services to the GMAA33. This includes the following tasks:
a) handling of lawsuits and opposition proceedings,

b) preparatory work in policy matters in support of the FMoD,


c) implementation of air law investigation procedures in accordance with 6, 8, 30 of the German
Civil Aviation Act and 41 of the Regulations on Certification and Licensing in Aviation,
d) rendering of decisions related to air law (e.g. negative certificate or approval/modification approval
for military airfields of the Bundeswehr and the armed forces of the sending states IAW 6 of the
German Civil Aviation Act). Exception: The responsibility for establishing an agreement with the
Federal Ministry of Transport and Digital Infrastructure before an approval is granted IAW 30 of
the German Civil Aviation Act remains with the FMoD.
e) execution of aviation supervision on Bundeswehr airfields in accordance with 47 of the
Regulations on Certification and Licensing in Aviation,
f) identification/declaration, modification and cancellation of construction restriction zones for military
airfields,
g) release of the armed forces from their responsibility for military airfields IAW 8 Par. 5 of the
German Civil Aviation Act,
h) withdrawing of the dedication as military airfields if military flight operations have been permanently
discontinued on the airfield without a civilian follow-on user taking over,
i) authorization of flight operations on Bundeswehr airfields IAW 44 of the Regulations on
Certification and Licensing in Aviation or in specific cases IAW 25 of the German Civil Aviation
Act,
j) evaluation and approval of off-field takeoffs and landings by Bundeswehr aircraft IAW 25 of the
German Civil Aviation Act,
k) finalization of requests for compensation IAW 19 of the German Civil Aviation Act,
l) approval of buildings inside construction restriction zones of military airfields IAW 12, Par. 2,
Sentence 2 of the German Civil Aviation Act,
m) approval for the erection of other air traffic obstacles IAW 15, Par. 2 of the German Civil Aviation
Act,
n) assurance of the absence of air traffic obstacles in the construction restriction zones of military
airfields IAW 16, 16 a of the German Civil Aviation Act,
o) issuance of sufferance notes concerning the marking of buildings and objects IAW 16 a of the
German Civil Aviation Act,
p) cooperation with the Federal States within the scope of the responsibilities of the GMAA,
q) processing of claims for compensation IAW 19 of the German Civil Aviation Act and claims for
reimbursement of expenses IAW 9 of the Aircraft Noise Act34,
