enhancement of military cooperation within the EU and NATO. This applies in particular to military

As per state secretary decision dated 21 October 2013 (FMoD Org - Ref. 10 01 00)3, the
GMAA is directly subordinate to the FMoD. Administrative control over the GMAA is exercised by the
Chief of Defense, whereas functional control of the GMAA will be provided by the competent
organizational elements of the FMoD irrespective of the administrative chain of command.4

In addition to Par. 201 above, the management on MoD level and functional supervision of
the GMAA will occur under the coordinating guidance of the Directorate-General for Forces Policy
(FSK) of the FMoD5 when tasks and responsibilities of a national military aviation authority are
concerned. As indicated in the letter by FMoD Organization, which was approved by the State
Secretary on 28 March 20146, this task of coordinating guidance has been assigned to the FSK I 5
branch.

30, Par. 1 of the German Civil Aviation Act provides the possibility to deviate from the
regulations set in this act and the related implementing orders when required to fulfill special tasks of
the Bundeswehr considering public safety and order. Deviations from the directives/regulations for
operating in the airspace are permitted only as far as they are absolutely necessary for performing
sovereign tasks.

EU regulations on civil aviation are not applicable for military air traffic (cf. Art. 1, Par. 2 of
Regulation (EC) No. 216/2008). Nevertheless, the EU member states are obliged to observe the
objectives of Regulation (EC) No. 216/2008 during military flight operations as far as practicable.7
304.
As far as this General Publication delegates the responsibility for directives/regulations based
on 30 of the German Civil Aviation Act to the GMAA, the provisions of the German Civil Aviation Act
have to be observed.
In the course of the amendment of the German Civil Aviation Act, the wording of 30 will be modified to reflect
this legal situation.

5.1
General

The core mission of the GMAA is derived from the overriding objectives pursued by the

The GMAA is responsible for auditing, approving or recognizing organizations and companies
and for licensing personnel whose primary tasks are the conduction of aviation tasks and duties or the
provision of aviation services which may only be performed by licensed personnel.

The airworthiness verification and certification rules/regulations contain requirements for the
approval/recognition of companies/organizations and for the licensing of personnel. Section 5.2 shall
therefore be observed.

In the course of the tasked conversion of EMAR standards into DEMAR, the basic principle of
approval/recognition and licensing shall be adopted and further developed step by step in order to
ensure safe performance of military flight operations. The regulations/standards required for this
purpose (e.g. DEMAR and subordinate documents) shall be issued by the GMAA and reviewed within
the scope of a continuous monitoring and approval program. In this context, it is of special importance
that the DEMAR are updated on a regular basis in order to guarantee that the DEMAR standards are
continuously kept up to date with the basic EMAR and related EASA regulations.

function of the issuing authority for regulations concerning approval/recognition and licensing matters
(in whole or partially) which used to be issued by the FMoD.

Steps for each recognition process shall be developed individually for the respective subject
matter in accordance with EMAD-R and if applicable with other aviation policy documents (e.g. EU
regulations).

Following the successful completion of the recognition process, the GMAA is in charge to
recognize the foreign aviation authority with regard to the subject matter concerned.
5.5

The GMAA is responsible for the basic regulation and standardization of the aviation control
services and the aeronautical information service within the scope of Bundeswehr flight operations.
532.
The GMAA is responsible for providing central safety supervision over military aviation control
services on the basis of established quality and safety management systems derived from the relevant
EU regulations. In this context, it will issue directives/regulations with normative character, will review
and approve documents prepared by the major organizational elements/military major organizational

Modifications to systems, procedures or operations of the aviation control services are subject

systems used. These guidelines shall be based on international, in particular European standards. An
appropriate degree of interoperability with civilian systems is desirable, provided this does not conflict

In order to provide a professional overview for developments at the European level, the
GMAA runs an Air Traffic Management Liaison Office in Brussels. The Brussels liaison office is the
local German interface for all relevant questions related to the Single European Sky/Single European
Sky Air Traffic Management Research Programme (SES/SESAR). Thus, the GMAA assumes a central
role in the SES/SESAR project work.

In addition, the GMAA will ensure the safeguarding of all related interests in bodies of NATO

The GMAA exercises the functions of the former Military Aviation Authority of the Federal

In matters concerning the planning and permission of buildings, the Federal Office of
Bundeswehr Infrastructure, Environmental Protection and Services19, in its role as an agency with
responsibilities for matters of public concern, will represent the interests of the Bundeswehr towards
the permitting authorities of the Federal States. The GMAA will support the Federal Office of
Bundeswehr Infrastructure, Environmental Protection and Services in all matters concerning air traffic
control and flight operations and provide an expert opinion.
5.7
Protective Tasks

5.8
Aviation Security
546.
Regulation (EC) No. 300/200823 and the German Aviation Security Act24 are the basic
documents for ensuring air traffic security. The term "airspace security" within the field of aviation
security covers all tasks provided by the Bundeswehr in order to ensure those measures that may be
required in accordance with Article 14 of the German Aviation Security Act25. The topic airspace
security and the related directives/regulations are not subject of this General Publication and will be
addressed in separate regulations.
547.
The GMAA is responsible for the general regulation of aviation security in the area of military
flight operations as well as for the compliance with provisions on civil aviation security in accordance
with the provisions of the German Aviation Security Act and Regulation (EC) No. 300/2008 on
common rules in the field of civil aviation security in conjunction with Regulation (EC) No. 185/201026
laying down detailed measures for the implementation of the common basic standards on aviation
security.
For this purpose, the GMAA shall implement the provisions of the German Aviation Security Act and
the relevant EC Regulations in the Bundeswehr in close coordination with the FMoD and establish an
agreed scope of standards for the Bundeswehr.
548.
The Bundeswehr Logistics Command with its air transport security branch (and the function of
the Bundeswehr Chief Air Transport Security Officer) is responsible for ensuring the secure transport
and supply chain within the Bundeswehr logistics system and in the run up to an air transport
operation.

The Bundeswehr Logistics Command issues regulations on air transport security within the
Bundeswehr logistics system and coordinates them with the GMAA before they are implemented. The
GMAA in the context of its task to ensure the safety of military flight operations and to implement the
provisions on civil aviation security issues regulations for establishing/maintaining/ensuring aviation
security and coordinates these regulations with the Bundeswehr Logistics Command if logistic matters
are concerned.

Authorizations, approvals and licenses in accordance with Regulation (EC) No. 300/2008 and
the German Aviation Security Act will be provided either directly by the GMAA or, as far as air
transport security within the Bundeswehr logistics system is concerned, by the Bundeswehr Logistics
Command in cooperation and coordination with the GMAA.
5.9
Aviation Safety
551.
The FMoD delegates the overall task [in terms of oversight] of aviation safety in the
Bundeswehr to the GMAA. The FMoD delegates the overall responsibility for aviation safety in the
Bundeswehr, which up to now has been assumed by the Chief of the Air Force, to the in-service
managers (Chiefs of the Services, Director of the Federal Office of Bundeswehr Equipment,
Information Technology and In-Service Support) for their respective areas of responsibility (aviation
safety in the Air Force, Navy, Army, Federal Office of Bundeswehr Equipment, Information Technology
and In-Service Support).
552.
The FMoD delegates the responsibility for the investigation of accidents and incidents over
and on German territory including territorial waters or on German vessels to the Directorate of
Aviation Safety Bundeswehr for any accidents/incidents where only military aircraft are involved.
553.
The responsibility for the specialized investigation of accidents and incidents associated with
the operation of civil aircraft in which military aircraft are involved, is specified in an interministerial
agreement27 based on the Air Accident Investigation Act28.
554.
Investigations of air accidents/serious incidents with aircraft of the Bundeswehr outside the
territory of the Federal Republic of Germany shall be conducted by the Directorate of Aviation Safety
Bundeswehr on the basis of agreements between nations/military authorities/agencies or as directed
by FMoD Directorate-General for Forces Policy. As far as the investigation of accidents/incidents (Cat
B) of military aircraft over international waters is concerned, these directions are considered to have
been given.

The FMoD authorizes the GMAA to release information from the investigation records to
individuals concerned or to their legal advisors, provided this information is needed in order to
determine, enforce or defend legal claims or for coping with bereavement.
5.10
Aviation Medicine
557.
Aeromedical regulations Category A and B will be prepared by the GMAA and issued by the
Medical regulations that may affect licensing, authorization or training of personnel working in
the aviation sector are issued by mutual agreement between the issuing agency and the GMAA.

The GMAA is authorized to represent the FMoD externally in matters concerning aviation
medicine.29
5.11
Legal Issues
560.
The FMoD transfers the responsibility for the evaluation, assessment and decision of legal
issues that may arise in connection with the aforementioned tasks to the GMAA. In case of questions
regarding the basic application and interpretation of the law, the FMoD must be involved.

The responsibility for participation in legislative procedures of the Federal Government or the
European Union and the right to issue statutory orders remains with the FMoD.

The regulations required for the safe performance of military flight operations are issued at
FMoD and GMAA level. The issuing authority is specified under Nos. 3 and 4. Any changes to Nos. 3
and 4 shall be coordinated with FMoD FSK I 5.
2.
In principle, the responsibilities and competences will be handed over to the GMAA on
1 January 2015. Interim arrangements shall be established as required if the regulations do not reflect
the new competences/responsibilities by that date.

Within the scope of the special task area of diplomatic flight clearance, the GMAA is the
superior authority of the Diplomatic Clearance Cell, which is under the administrative control of the
Commander, Special Air Mission Wing FMoD. Details shall be specified in the organization directives
of the affected agencies.

Monitoring and Information Center which may be effective as good publicity have to be reported to
FMoD FSK I 5.
7.
The GMAA and the Director of the Bundeswehr Geoinformation Service shall establish a
written agreement on the work relations in the functional area of the Bundeswehr Geoinformation
Service which also identifies the associated competences. The responsibility for functional matters of
the Bundeswehr Geoinformation Service rests with FMoD SE I 2 or with the Director of the
Bundeswehr Geoinformation Service.

The government quality assurance offices for military aeronautical equipment and military
aircraft of the Federal Office of Bundeswehr Equipment, Information Technology and In-Service
Support which are collocated with industrial companies in Germany shall cooperate with the GMAA on
a permanent basis. This is due to the responsibility of the government quality assurance offices for
product conformity and airworthiness reverification inspections specified in General Publications A1525/1 and A-1525/2. Apart from their tasks in the field of airworthiness verification and certification,
the responsibilities of the government quality assurance offices concerning the evaluation of supplier
suitability and qualification/QA capabilities of aerospace companies will also be an important element
in the fulfillment of sovereign tasks by the GMAA. Contributions provided by the government quality
assurance offices in this area thus form a part of the internal reporting procedures of the GMAA.

Support supports the GMAA with the technical expertise of its technical centers and research
institutes. The provision of support will primarily be required for the assessment of the compliance
demonstration and the preparation of supporting documents within the scope of type inspections. This
applies in particular to the execution and assessment of flight tests, the assessment of flight
performance/flight characteristics or other assessments of flight-relevant aspects, which are carried
out by test pilots and flight test engineers only available in the Equipment, Information Technology and
In-Service Support organizational area. Tasking of the agencies of the Federal Office of Bundeswehr
Equipment, Information Technology and In-Service Support is effected by means of defense technical
tasks; details are specified in a documented procedure of the Federal Office of Bundeswehr
Equipment, Information Technology and In-Service Support. The GMAA acts as the requesting party

concerning the defense technical task and the Federal Office of Bundeswehr Equipment, Information
Technology and In-Service Support as the ordering party.
10.
Support supports the GMAA through its government quality assurance offices by monitoring and
evaluating the inspections to be performed by the contractor within the scope of type inspections. To
obtain support, the GMAA shall notify the Federal Office of Bundeswehr Equipment, Information
Technology and In-Service Support about its support requirements.

The cooperation between the GMAA and the Federal Office of Bundeswehr Equipment,
Information Technology and In-Service Support with respect to the handling of planning and approval
procedures that are of legal relevance in terms of aviation law is laid down in Special Publication
D 1800 (see Annex 7.3, Reference No. 11).
12.
All branches of the Bundeswehr [that perform duties or handle equipment as described in
this publication] will support the audits to be conducted by the GMAA by providing trained auditors.
Details will be specified by the GMAA in a documented procedure [to be issued]. Para 508 shall be
observed.
13.
For certain tasks, the GMAA may require the support of external companies. The GMAA will
identify the requirement and have the service provided within the scope of the authorized budget. With
respect to the administrative procedures, the GMAA will be supported by the local Bundeswehr
Service Center.
The Federal Office of Bundeswehr Equipment, Information Technology and In-Service Support shall
allow for project-related support services to be provided to the GMAA in the respective contracts.
14.
The GMAA will prepare an annual report and submit it to the Chief of Defense, thus providing
The ministerial functional supervision over relevant parts of the "Traffic and Transportation"
business process and the "Provision of Logistic Services" service process remains with FSK III 4
within the scope of its tasks as the responsible business/service process authority. Accordingly, FSK
III 4 is responsible for the integration/tasking of the business process manager at the Bundeswehr
Logistics Command (including the air transport security branch).
16.
The responsibilities for infrastructural issues are handed over from the Military Aviation
Authority inside the Federal Office of Bundeswehr Infrastructure, Environmental Protection and
Services to the GMAA33. This includes the following tasks:

The GMAA shall issue the disbursement order and conduct SAP booking and account allocation. Planning,
requisition and distribution of budgetary funds shall be effected by the Infrastructure, Environmental Protection and
Services organizational area (Federal Office of Bundeswehr Infrastructure, Environmental Protection and Services,
