Notification
Inexerciseofthepowerconferredbytheprovisotoarticle309oftheConstitution,thePresident
herebymakesthefollowingrulesforregulatingtherecruitmentofexServicemeninCentralCivil
ServicesandPosts,namely:

ShorttitleandCommencement.
a. TheserulesmaybecalledtheExServicemen(ReemploymentinCentralCivilService
andPosts)Rules,1979.
b. TheyshallbedeemedtohavecomeintoforceonthefirstdayofJuly,1979.
Definitions.Intheserules,unlessthecontextotherwiserequires:
a. "ArmedForcesoftheUnion"meanstheArmy,NavyandAirforceoftheUnion.
b. "disabledexServicemen"meansanexServicemanwhowhileservingintheArmed
ForcesoftheUnionwasdisabledinoperationsagainsttheenemyorindisturbedareas
c. "exServicemen"meansapersonwhohasservedinanyrank(whetherasacombatant
orasnoncombatant),intheArmedForcesoftheUnion,includingthearmedforcesof
theformerIndianStates,butexcludingtheAssamRifles,DefenceSecurityCorps,
GeneralReserveEngineeringForce,LokSahayakSenaandTerritorialArmy,fora
continuousperiodofnotlessthansixmonthsafterattestation,and
i. hasbeenreleased,otherwisethanathisownrequestorbywayofdismissalor
dischargeonaccountofmisconductorinefficiency,orhasbeentransferredtothe
reservependingsuchrelease,or
ii. hastoservefornotmorethansixmonthsforcompletingtheperiodofservice
requisiteforbecomingentitledtobereleasedortransferredtothereserveas
aforesaidor
d. "Paramilitaryforces"meanstheBorderSecurityForce,CentralReservePoliceForce,
IndoTibetanBorderPolice,CentralIndustrialSecurityForce,SecretariatSecurityForce,
AssamRiflesandRailwaysProtectionForce
e. "reservedvacancies"meansvacanciesreservedunderrule4forbeingfilledbyex
Servicemen.

Application.TheserulesshallapplytoalltheCentralCivilServiceandPosts,Group'C'and
Group'D'andtothepostsofthelevelofAssistantCommandantinallParamilitaryforces.

4.

ReservationofVacancies.

a. TenpercentofthevacanciesinthepostsoftheAssistantCommandantinallPara
militaryforcestenpercentofthevacanciesineachofthecategoriesofGroup'C'posts
andofsuchpostsineachgroup'C'serviceandtwentypercentofthevacanciesineach
ofthecategoriesofGroup'D'postsandofsuchpostsineachGroup'D'service,
includingpermanentvacanciesfilledinitiallyonatemporarybasisandtemporary
vacancieswhicharelikelytobemadepermanentorarelikelytocontinueforthree
monthsandmore,tobefilledbydirectrecruitmentinanyyearshallbereservedfor
beingfilledbyexServicemen:

ProvidedthepercentageofreservationsospecifiedforexServicemenincategoryof
postsshallbeincreasedordecreasedinanyonerecruitmentyeartotheextenttowhich
thetotalnumberofvacanciesreservedforexServicemen,ScheduledCastesand
ScheduledTribes(includingthecarriedforwardreservationsforScheduledCastesand
ScheduledTribes)andforanyothercategoriestakentogetherfallsshortorisinexcess
asthecasemaybe,offiftypercentofthevacanciesinthatcategoryofpostsfilledin
thatyear:
ProvidedfurtherthatincaseofanincreaseinthereservationfortheexServicemen
undertheprecedingproviso,theadditionalvacanciessomadeavailableforthemshall
beutilisedfirstfortheappointmentofdisabledexServicemenandifanysuch
vacanciesstillremainunfilledthereafterthesameshallthenbemadeavailabletoother
exServicemen.

b. OutofthevacanciesreservedforbeingfilledbyexServicemen,vacanciesshallbe
reservedforcandidatesbelongingtotheScheduledCastesandScheduledTribesin
accordancewithsuchordersasareissuedinthisbehalfbytheCentralGovtfromtime
totime:
ProvidedthatifanyexServicemanbelongingtotheScheduledCasteorScheduled
Tribesisselected,hisselectionshallbecountedagainsttheoverallquotaofreservation
thatshallbeprovidedfortheScheduledCastesorScheduledTribesinaccordancewith
theordersissuedbytheCentralGovtformtimetotime.

c. NovacancyreservedforexServicemeninaposttobefilledotherwisethanonthe
resultofanopencompetitiveexamination,shallbefilledbytheappointingauthorityby
anygeneralcandidate,untilandunlessthesaidauthority:
