Outof250members238aretherepresentativesofthestatesandUnionTerritories.
These238areelectedindirectlybytheelectedmembers of Legislative Assemblies of
theconcernedstates.
Article80(3)oftheIndianConstitutionpermitsthat12membersarenominatedbythe
President with the special knowledge or practical experience in the fields like Science,
Arts,LiteratureandSocialService.

I.IfholdsanyofficeofprofitundertheUnionorStategovernment.
II.Ifthepersonisofunsoundmindandstandssodeclaredbyacourt.

III.Ifthepersonisanundischargedinsolvent.

IV.IfthepersonisnotacitizenofIndianorhasvoluntarilyacquiredthe
citizenshipofaforeignstate.
V.IfsodisqualifiedunderanylawmadebytheParliament.

NOTE:ThemembersofRajyaSabhaaredisqualifiedbythePresidentafterseekingthe
opinionfromtheElectionCommission.
