CONTRACT

AND

EMPANELMENT

OF

1. SUBMISSION OF OFFERS
The Consultant can submit their expression of interest for any one of categories of
the consultancy service, subject to fulfilment of prequalification and eligibility criteria
for the category. The offers shall be submitted in separate sealed envelopes clearly
super scribing the category / categories of consultancy services on the envelope.
Offers with requisite documents should be sent to the office of Chief Architect
Planner, Uttar Pradesh Avas Evam Vikas Parishad,104,Mahatma Gandhi
Marg Lucknow-226016. latest by 10-02-2014 before 3.00 pm.
1.1 Part-I : Technical Offer for Prequalification and eligibility criteria:The Consultant is required to submit required documents in support of their
fulfilment of Prequalification and eligibility criteria on prescribed format for any one
category as stated belowCategory

Eligibility criteria
1. Individual Architect /Planner/ Firm should have minimum 05 years experience.
2. Architect / Firm should possess adequate qualified man power. A detailed
profile of the firm with name & experience of Principal Architect / Architects
to be mentioned along with staff strength.
3. In case of firm, it should be headed by the Architect/Planner as the case may
be.The ability and competence of the applicant to render required services
within the specified time frame will be a major factor while deciding the
empanelment of Architect / Consultant.
4. The architect/firm empanelled with development authority/ corporation/
building department of states would be preferred.
5. The Architect should be a registered member of the Council of Architect),if so,
please mention the number/ attach certificate.
6. The Planner should be registered with Institute of town planners, India
(ITPI),if so, please mention the number/attach certificate.
7. Architect/Planner / Firm should be registered for Tax with IT Department and
for Service tax with excise department.
8. The Architect/Planner/ Firm should have relevant work experience. A
narrative list of works along with layout and activities undertaken during last
3 financial years along with the value should be submitted. It should also
describe the nature of assignment. All offers and supporting documents shall
be submitted in English or Hindi.

1.2 Part-II Financial Offer for professional fee on rate contract basis :
The Consultant is required to submit consent for professional fee on rate contract
basis (wherever feasible) by signing on TOR as stated in annexure-A1 in a separate
sealed envelope marked as B1.
All the sealed envelopes (Part-I- Technical-offer, Part-II-Financial offer) shall be
covered in a large single envelope which shall also be sealed and duly super scribed
& must be addressed to the Chief Town Planner, of Chief Architect Planner,
Architecture and planning section, UPAVP(Uttar Pradesh Avas Evam vikas
Parishad),Lucknow.
The Financial offer of those who qualify Technical qualifications (those who fulfills
pre-qualification and eligibility criteria) shall be opened as per scheduled in office of
the Chief Architect Planner, Architecture and planning section,Second floor,
Neelgiri Complex,Indira Nagar,Lucknow-226016.in the presence of the
consultants or their representatives, who wish to be present on the day
1.3 Envelope of Technical offer should also contains
A1) Demand Draft of Scheduled bank of Rs. 5,000/-(Rupees Five thousand only) in
favour of UPAVP, payable at lucknow as processing fee (Non refundable and in
separate envelope).
A2) Other documents/papers in support of Pre-Qualification Requirement and
eligibility Criteria (PQR) are to be enclosed with endorsement on each page.
Note : Application form for empanelment shall be submitted in sealed envelope
super scribing " Empanelment of individual/ architectural & planning
consultancy firms for category-(A/B/C) " having envelope -A1,A2, and B1,B2
along with supported document.
1.4 Envelope-B of Offer should contain the following:
B1)This envelope should contain willingness to work on Rate contract for various
services as prevailing in UPAVP as per annexure-A1.
B2) Demand Draft of Scheduled bank for registration money as prescribed for
respective category as per clause-1.1. in favour of UPAVP, payable at lucknow in
separate envelope.(Refundable if ,applicant is not found eligible for empanelment).
Note :
The broad scope work has been given in this document. The actual project specific
Scope of work & Payment schedule may be modified and decided on mutually
agreed terms between consultant and UPAVP. The rate contract fees to be paid as
decided through this offer ,as rationalized by UPAVP shall not be changed.
1.5 Submission of offers
Sealed Offers in accordance with the TOR duly signed must be submitted in the
office of Chief Architect Planner, UPAVP, Lucknow by 10-02-2014 at 3:00 pm which
is to be received at the following address.

1.6 OTHER TERMS & CONDITIONS FOR THE CONSULTANTS :1. The application shall be submitted strictly in the format as mentioned along
with the supporting documents.
2. The application shall be signed by the person/s on behalf of the organization
having necessary authority/power of attorney to do so. Each page of the
application shall be signed and copy of power of attorney/memorandum of
Association wherever applicable shall be furnished along with application.
3. If the space in proforma is insufficient for furnishing full details, such
information may be supplemented on separate sheet stating therein the part
of Proforma and serial number. Separate sheet may be used for each part of
application. while filling up the application with regard to list of important
project completed or on hand the application shall only include major works
handled by firm.
4. The applicant should ensure that the application is delivered at the given
address within prescribed date and time as mentioned in the advertisement.
5. The cost and submission of the offer is entirely the responsibility of the
consultants, regardless of the conduct or outcome of the tendering process.
6. Validity of empanelment by UPAVP must be for Minimum of 2 years. The
rates rationalised by the competent authority are listed as the eligible rates
for carrying out the respective consultancy work. More than one consultant
can be assigned the job at the same rate. The UPAVP shall be free to assign
any consultancy service to the consultants on the rates approved by UPAVP
without inviting any Financial offer or Tender etc.
7. Housing commissioner, UPAVP, Lucknow reserves the right to reject all or any
of the offers without assigning any reason thereof.
8. UPAVP shall be free to award the work on approved rates to any of the
consultant, which it considers suitable.

Scope of work 2.1 & 2.2 :
1. Intellectual property right of work carried out for UPAVP shall lie with
UPAVP.The consulting firm shall submit all data, documents, design(Hard
copy and soft copy in original format of generation) to UPAVP. The firm shall
not be allowed to use these for any other purpose without permission of the
board.
2. Building plan Architectural drawing i.e. Elevation, Architectural sections etc
need based iso-metric/perspective views and block pattern in case of 3/4
storied. If required scale models on payment basis.
3. Services layout/design i.e. electrical ,water supply, sewerage, plumbing,
fire fighting, rain water harvesting etc.
4. Planning of the building should be based on requirement and liking of
customers on the basis of study/survey.
2.3 Flats more than four storied
A- Scope of work:
1. Layout plan of area.
2. Building plan & Elevation with block pattern.
3. Structural design along with detailed structural drawing, Bar bending
schedules, material schedules, finishing schedules etc structure design to be
vetted by Academician professor of IIT/ reputed govt engineering college and
the cost of vetting will paid by the UPAVP

for above work payment will be made @1% of Total projects cost the project
if actually executed as mentioned below:

Planning and design of Housing Scheme.


Scope of work:
A- Zonal Plan: it includes T.L.P. with land use and its density allocations, other
Details, etc as scheme DPR, road sections details, , landscape plan, Rain
water harvesting, Conceptual services and networks plan in respect of master
plan of the city.
B- Sectorial Layout Plan: It includes details layout plan of the area as per by
laws of U.P. Govt./ UPAVP i.e. showing of setbacks, FAR, densities, height of
the building, , road sections details, , landscape plan, Rain water harvesting,
Conceptual services and networks plan Naming ,Numbering and other
construction parameters.
C- Revisions: where ever required (upto three times) will be made by the firm
within above rates. Revision shall mean change in LOP after approval of
competent Authority.

3.0 PROCESSING OF BIDS

The Bids scrutiny Committee shall scrutinize the bids proposals, and list of the
technically qualified consultant shall be displayed on the notice board of office
of Chief Architect Planner, Uttar Pradesh Avas Evam Vikas Parishad,
104 Mahatma Gandhi marg,Lucknow-226016.
Note:- The Housing commissioner shall have the discretion to co-opt more
members, to change the composition of the Committee, to review any
decision taken related to empanelment of consultant, to empanel any fresh
consultant at any time depending upon his technical expertise and also to
terminate the empanelment of Any consultant.

4.0

However, if additional copies are required, actual cost of printing of payment
shall be made.

All the Drawings, Reports, Estimate, documents and any other media (in original
format-in which they are generated) will be submitted to concerned appropriate
authority i.e Chief Architect Planner.

4.1

FACTORS EFFECTING PAYMENT TO THE CONSULTANTS

1.

The payment made to the Consultants during various stages would be on


account payment and will get adjusted in the final payment.
Progressive payment at all stages of mode of payments may be made to the
consultants in any of the above stages based on the quantum of work done
in the stage as may be mutually agreed to by the parties.
The UPAVP reserves the right to make deduction from the professional fee of
the consultants on account of penalty.
In case only part of the Scheme is continued (before actual commencement
of work at site) then the consultancy fee would be paid up to the stage for
which drawings have been received and approved by the Competent
Authority and if the scheme is discontinued after the commencement of work
at site then the consultancy fee would be paid upto 50% of the total fee
payable as at this stage as all the preliminary drawings, working drawings,
structural and services drawings, estimates and tender documents etc. have
been prepared and received by the UPAVP. Further payment shall be released
to the consultant in consistent to the value of work done at site
During execution of work the Consultant or his associate may be required to
make at least one or two site visits in a month for which actual TA/DA
equivalent to IInd AC fares will be paid separately to him. The frequency of
such visits, depending on the site requirement, may vary from project to
project.
The Consultant shall be obliged to notify any discrepancy noticed by it or any
modification if it finds appropriate to improve the functionality of the building
/ scheme in written to appropriate level. The Consultant is also required to
issue such improvement / modification free of cost.

The Consultant may be required to make minor changes or revisions in the


plan, and other details, if needed during the execution of the works without
any additional fee upto three revisions. If any additional work is required
during the validity of contract, the consultant shall have to provide drawings
for such work on mutually agreed rates.
Soil Investigation and third party checking/vetting of the design and
considerations shall be carried out by the consultants at their own expenses.
Parameters required for structural design of the building shall be as per the
prevailing norms or the rules as may be prescribed by UPAVP.

4.2

EXECUTION OF THE ASSIGNMENT

1.

All the stages of work shall be completed by the Consultants and the
necessary approval given by the UPAVP according to the time schedule
mutually agreed upon. The work throughout the stipulated period of contract
will be carried out with diligence, time being essence of the contract.
In the event of consultants firm closing its business the upavp shall have the
power to employ any other agency to complete the work after payment has
been made to the consultant upto the stage of service completed.
UPAVP shall have the right and authority to terminate the agreement on
giving seven days notice, in the event of the failure on the part of consultants
to complete their work or the consultants committing a breach of any one or
more of the terms and conditions of the agreement to the satisfaction of the
UPAVP.
The consultants shall prepare drawings, designs, outline specifications and
estimates of costs on cubic measurements or on areas basis on schedule of
rates of the executing agency plus tender percentage and/or ISI
specifications as per requirements. In the absence of rate in the aforesaid
schedule rates, the same shall be arrived at by actual market analysis.
The consultants shall advice on the time and progress chart prepared by the
contractors and/or construction Management Consultants for the completion
of the work, if required.
The consultants shall assume full responsibility for the design and
specifications for terms described in the scope of work, UPAVP will have full
access to the details of the calculations and the structural designs for the
purpose of scrutiny. The structural engineers of the consultants will render all
possible help for the above scrutiny.
On completion of the work, the consultants will prepare and submit "As Built
drawings" of the project indicating all the minor adjustments done on site,
and submit to the UPAVP with two sets of hard and soft copy. These are legal
documents and hence the consultants shall be held responsible for any
discrepancy in these drawings from site conditions.
The consultants shall advice UPAVP regarding the work under execution
during their visits to the site and submit reports on their observations in
writing. The UPAVP shall consider the necessity of such additional work/extra
items with reference to the drawings and specifications and additional cost
involved. The responsibility for implementation of this advice shall be of
UPAVP.

Any deviation from the approved drawing or specification that may be


observed by the Consultant shall be given in writing by them to the UPAVP
who shall issue necessary instructions to concerned executive engineer.
The Consultants shall make necessary revisions as may be required by the
UPAVP in the drawings and other documents submitted by them.
No change shall be made in the approved drawings and specification at site
without the consent of the UPAVP.
The drawings, specifications, reports, documents and other instruments of
service are the property of the UPAVP whether the scheme for which they are
made is to be executed or not. They are not to be used for any other purpose
except with the written consent of the UPAVP.
UPAVP shall have the liberty to postpone or not to execute the work and the
consultants shall not be entitled to any compensation or damage for such
postponement or non execution of the work except the fees which are
payable to the consultants up to the stage of services then completed.
The consultant will not proceed with the work stipulated in any stage without
the written consent of the UPAVP.
The consultants shall ensure that the executing agency is furnished with
drawing or drawings and plan or plans at the time or times appointed and
specified in the contract to be made between UPAVP and the contractor. If
the consultants fail to furnish drawings or plans to UPAVP accordingly the
consultants shall pay to UPAVP compensation for any loss or damage arising
from such neglect, failure or omission, particularly to meet with the claim or
demand if any, presented by the contractor against UPAVP for loss or
damage suffered in consequence of the delayed supply of drawings to the
contractor.
The Consultants shall guarantee their designs, specifications, and other
related technical information and these should be complete, accurate,
adequate and workable. The burden of proof that the designs, specifications
and other related technical information are complete, accurate, adequate and
workable shall rest with the consultants.

AGREEMENT WITH THE CONSULTANT


At the time of issuance of the work order UPAVP shall execute an agreement
with the consultant on Non judicial stamp paper of Rs 100/-, the terms and
condition shall be as mentioned in this bid document and any other specific
condition can also be laid down by UPAVP as per there need and project
specific requirements. A Model Agreement shall be provided by the UPAVP.

4.4

SETTLEMENTS OF DISPUTE
All difference and disputes arising out of the agreement between UPAVP and
the Consultants regarding the execution, payment, interpretation or any such
connected and related matter to the execution of the Scheme shall be settled
by the Principal Secretary to the Government, Housing and urban planning
section whose decision shall be final and abided by both the parties.

JURISDICTION
All the disputes arising with regard to the agreement between UPAVP and the
Consultants will be deemed to have arisen at Lucknow and will be subject to
the jurisdiction of the courts situated at Lucknow only for which both the
parties agree specifically, well knowingly and consciously.

4.6

DENYING FURTHER ASSIGNMENT TO THE CONSULTANTS


If a Consultant who has been assigned work by UPAVP does not act in
conformity with the practices and ethics of the profession, he may not be
assigned any further work by the UPAVP thereafter.

Planning and design of Housing Scheme.


Scope of work:
D- Zonal Plan: it includes T.L.P. with land use and its density allocations, other
Details, etc as scheme DPR, road sections details, , landscape plan, Rain
water harvesting, Conceptual services and networks plan in respect of master
plan of the city.
E- Sectorial Layout Plan: It includes details layout plan of the area as per by
laws of U.P. Govt./ UPAVP i.e. showing of setbacks, FAR, densities, height of
the building, , road sections details, , landscape plan, Rain water harvesting,
Conceptual services and networks plan Naming ,Numbering and other
construction parameters.
F- Revisions: where ever required (upto three times) will be made by the firm
within above rates. Revision shall mean change in LOP after approval of
competent Authority.

Note: The rate quoted above does not guarantee any work order, and the rates
quoted above could be rationalized by the competent authority which will be
acceptable to me/us. It is further accepted that UPAVP would be free to issue work
order to any firm empanelled with UPAVP.
I/We shall have no objection to the decision and selection of any empanelled
consultant for work order as finalized by the UPAVP.
