IamtakingtheefforttoexposeanissuewithCommissionmemberstakinggiftsbecauseIsincerely
believethishascompromisedwiththecommissionitselfandhowitservesthecitizen.Ithasalsohas
compromisedwiththeservicesthatthecitizenscouldhavereceived.Taxpayersarebeingcheatedout
oftheirtaxdollars.Ihopecitizenscangetsomebasicservices,likecellphonereception,andthose
shouldnotbecompromised.Takinggifthasbecomesopervasivewedonotquestionthemanymore.
I,PinakiGhosh,wasassignedastheCommissionerforCommunityTechnologyandTelecommunication
CommissionfromDistrict1.Icomewith20yearsofexperienceintechnologyworldandIwantedto
servemycitytothebestinterestofthecitizens.Thecommissionisrunbycityordnance#20111208

TheCTTC(forCommunityTechnologyandTelecommunicationCommission)isunderTARA
(TelecommunicationandRegulatoryAffairs)whichhasdeeprelationshipswithcablecompaniesbecause
theyprovidemorethan30milliondollarstocitiesgeneralfundsforRightofWayandFranchisefees.
AfterservingfewmonthsIcametorealizethatthiscommissiondoesnotproduceanyresultandwe
commissionerswerejusttheretosignofftoagrantcalledGTOPS(Exhibit2).(Therewasalsoadhoc
fundingtheyweresigningoffto(Exhibit3).Mostofthesefundsweregoingtoshamcomputerlabs
examplethelibrariesalreadyprovideinternetaccesssocreatingcomputerlabintodaysworldisquite
useless.(Thesurprisingfactisthatthisistakenoutofourbylawsbydesigneventhoughitwasinour
ordnance)whichIprotested.AtthesametimewewerebeingforcedtoworkonitandMrs.Hawkins
wassuggestingthatweadvisethecouncilmemberstoincreasethebudgetofthegrantfrom200Kto
500K.
WewereneverallowedtoanythingseriousintheaboveordnanceeventhoughIshoutedtirelesslyto
workontopicswhichmatterto100%ofthecitizens(insteadof1%whoaredestituteanddoesnothave
accesstoanything).Mymantraisthateverybodyhasacomputerintheirhandanditstheircellphone.
Soifwecanprovidecityservicesthroughcellphonethencitizensareserved.(exampleyoushouldbe
abletotalktoacityplannerandhaveameetingusingacellphone).Sincecellsphonesalsohave
internetconnectionsoagoodcellularconnectionmakescableinternetredundant.
IalsofoundthatMr.LemuelWilliamswhoisthechairmanoftheCTTCisinthatplacefor8andhasdeep
friendshipwithcityemployeesespeciallysomebodycalledRondellaHawkins.

2. UseandDestructionofelectricutilitypolesbycablecompanies
KeepingcablecompanieshappyisoneofthejobsofTARAbecausetheyprovidealotofrevenue.The
otherfactisthatcablecompaniesgeneratealotofrevenuefromcableinternetbecausealotofpeople
aditchingcableTVandgettingeverythingoverinternet.Soifcellphonedownloadspeedsbecomevery
fastthencablecompaniesloosebusiness.Myprimaryworkinthecommissionwastoincreasethe
wirelessspeedfortheentirecity.Ineastsidethewirelesssystemisunbelievablybadworsethanmany
thirdworldcountries.Thisisindirectconflictwiththecablecompanies.
Weformedawirelessworkgroup,throughcityprocess,insidethecommission(Exhibit4).Iwasworking
hardtogetdataandsetupmeetingswiththewirelesscompanies.Mymeetingsweregettingcancelled

WhenIaskedquestionsaboutaccidentscausedbygooglefiberwork(therewasstatesmanreportand
thatishowthecommissiongottoknowaboutit)itwasbecomingdeeplyunpopular.Onlycoupleof
commissioners(allmale)wouldsupportme.(Exhibit6)
Ialsofoundthatcitywasdevelopingacomprehensivetelecomplanandwewereneverevenallowedto
seeiteventhoughwewerethetelecomcommission.(Eventhoughthisismandatedintheordnance
Exhibit1SectionG).ThefundamentalideaisthatifcellphoneconnectioningreaterAustinremainsto
belessthanparthencablecompanieshavegoodcableinternetbusinessandthisiswhatcitylikes.Even
thoughcitizensnowhavetopayfor2internetaccess.
InFebruaryMr.WilliamsandMrs.Hawkinssuddenlygotsomebody(HughForrest)fromSXSWwithout
anypreviousdiscussionhewasaskedtospeakinthecommissionfor30minuteswhichwerarely
allow.Weactuallyquestionthisalotbecauseitwasapurewasteofourtimethepersonwho
questioneditmostwasCommissionerNarissaJohnson.GoingthroughMr.Williams'semail,thatIgot
throughPIR,IfoundthatMr.WilliamswasgettingfreepassestoSXSW.Thesearecompleteinteractive
passes.Eachisvaluedatabout$1200ormore.Henevermentionedthisatourcommissionmeetingin
facthewasdistributingthesebehindourbacktogaininfluence.(Exhibit7,8,9)

Gettingagiftofabout$5000asagovernmentofficeriscompletelyillegalandagainstallcityandstate
laws.Nowcityemployeesareworkinghardtocoverupthecase.Myethicscomplainedwasstone
walledfor20daysbyReyArrellanoandothercityemployeesformorethan20daysuntilIdirectly
reachedouttocitylawdepartmentthroughapublicemail.(Exhibit10)

Thisemailforbadgerequestisbeyondbizarreheensuresthatnobodyelseiscopiedinthisemail.He
talksaboutthewomeninthecommission.ThethreewomencommissionersareNarissaJohnson
(representingDeliaGarza),AngelaNewell(representingKathyTovo),VirgiliaSingh(representingSteve
Adler).Allfourhaveacceptedtheticketsandusedthem.(Exhibit11)

Thesewereneverreportedtothecommissionortothecityclerksofficeeventhough$4800worthof
itemswereexchanged(SXSWisanindependentbodywhichdoesbusinesswithcity).

IbelieveMr.Zimmerman,whomMr.Williamsrepresents,wasalsonotawareofthis(Exhibit12).Iam
memberofvariousbodiesandIamprohibitedtoevengetacoffeefromthevendors.Infederal
governmentpeoplehavetogothrough3stagesofsignaturetogotoanyconferencewhichisnotfree.I
couldnotaffordtogotoSXSWsoItookmydaughtertoallthefreethingsbecauseIbelievewegetting
giftasacommissionerisagreatoffence.Lemuelhasnotonlycompromisedhisownpositionbutalso
compromisedthepositionof3othercommissioners(whoprobablythoughtitwasniceperkforbeing
commissioner)

IalsofoundthatMrs.RondellaHawkinsandhersmallteamdid9conferencetripsin2015(notincluding
thetripsinAustin).Manyoftheseconferencesweremadefreeasgifts.Wedonotdoanytelecom

CTTC(CommunityTechnologyandTelecomCommission)isunderTARA(Telecomand
RegulatoryAffairs)
o TARAmakesabout35milliondollarseveryyearforthecityfromROW(rightofWay)
andFrancizelicensetaxes.
TARAalongwiththecommissionalsomanagesagrantcalledGTOPSanddistributesabout
$200Ktoorganizations.
o CTTCisforcedtoworkonthisGrantwithsupportfromthechairmaneventhoughitis
notinthecommissionsbylaws.Itwasremovedfromthebylawstogoaroundthelaw.
o ThecommissionisbeingadvicedbyTARAmembersto
SXSWuseRightofWayandFranchiselicensesinthecitywhichiscontrolledbyTARA.
TARAcontrolallthetelecomnetworkofthecityand
CityhasaverylargebusinessrelationshipwithSXSWandcollectsfeesfromSXSWformultiple
reasons.
o SomecityofficialsgetfreetickettoSXSWthroughParksFoundationbutthatiswell
regulated.Itisnotbehindthescene
SXSWsellsbadges(alongwithotherthings)anditstheircommoditysomethingtheyselllike
builderssellapartment.Thisishowtheymakemoneysowhentheygiveawaybatchestheyare
essentiallygivingawaymoney.
ThecityordinancesrequirethatCityCommissioners(whoarealsoofficersofthecity)donot
receiveanygiftswithoutthepermissionofthecityclerksoffice.Commissionersarerequiredto
gothroughanethicstrainingandanoathceremonytocomplytoethics.
Theserequestsforbadgesover$5KwasnotmentionedintheFebruaryorMarchcommission
meetingseitherbyMr.Williamsorbytheother3members
Mr.Williamsdoesnotmakecopytoanybodywhenhesendstherequestforthesebadgesto
SXSWfromhisgovernmentprovidedemail.
o HehastousethegovernmentemailbecauseSXSWwouldnothavegivenhimthe
ticketstohisprivateemail.Theywanttokeepevidenceofthefactthattheyare
providinggiftsofmaterialandmonetaryvaluetocityofficialsfortheirinternalaudit
elsetheywouldbeintrouble.
