The FTC cant say when it will complete its behavioral targeting principles, Parnes told DeMint, saying she
doubts theyll still be in draft in a year. She said the FTC probably has authority to regulate targeting under section
5 of the FTC Act. But DeMint, a former advertising executive, urged the FTC to focus first on actual harms. The
targeting hubbub seems to be a solution in search of a problem as the industry tries to cut these problems off
before they occur, he said. Business should reveal what it collects so that the consumers become the regulators
of the Internet, DeMint said. Parnes agreed that self-regulation at this point is more appropriate.
The hearing's timing was uncanny, given the presence on the Senate floor of the Foreign Intelligence Surveillance Act compromise bill (WID July 9 p1), said Sen. Bill Nelson, D-Fla., also an Intelligence Committee
member. The bill later passed the Senate. (See related report in this issue.) I want to question the underlying basis of targeting, he said, comparing the practice to government snooping on individual library use. The question
is how do we rein this in before the Internet becomes totally ubiquitous, Nelson said. How do we support our
Constitution and protect our civil rights?
Dorgan hasnt "the foggiest idea whos tracking his Web surfing, or if any company that is has enough
scruples to resist selling his data to just anyone, he said. One of the most important elements coming from this

Internet service providers, from behavioral targeting to net neutrality and network management.

"Why shouldn't Congress be able to do the same?" he asked.
Culberson backed away from his initial anger over the issue, during an interview Wednesday. He said what
troubled him was that the proposed rule would "for the first time, regulate the Internet and the ability of members of
Congress to utilize the Internet."
Culberson acknowledged the validity of some restrictions on congressional Web use, such as those separating official business from campaigns, and said he had made inquiries about how to follow the rules while using cutting edge technologies. He said the Administration Committee told him that "no one had ever asked before" and
until recently no one had objected.
Though Culberson declined to call the Capuano proposal an attempt at censorship, he bristled at the
idea that he would have to receive approval to communicate as he wanted. The Administration Committee's
efforts, he said, were akin to "King Canute trying to stop the tide" and said that he would approach Capuano
"in a nonpartisan, friendly way" Thursday to resolve the dispute. Culberson said he plans to continue his Web
video postings regardless of any rule changes. This technology is allowing us to really shine sunlight into the
federal government... For me, its tremendously exciting.
Capuano may not be ready for compromise. I guess they don't care if constituents clicking on their
videos will be treated to commercials for anything you can imagine, from the latest Hollywood blockbuster to
Viagra, Capuano said in a written statement. He acknowledged that ads are easily identifiable and said avoiding the perception of impropriety was the goal of his proposal. Members of Congress who use taxpayer
money to communicate with constituents should be held to the highest possible standard of independence -and the appearance of independence.
Culberson said that instead of regulations, the committee should trust members judgment.

The House Judiciary Antitrust Task Force appears ready to tackle the Google-Yahoo search deal, again.
Wednesday it announced a July 15 hearing on Internet competition, the same heading as its cancelled June 27
hearing on the deal (WID June 23 p6). We couldnt immediately reach the committee to confirm the subject. July
15 is also when the Senate Judiciary Antitrust Subcommittee explores the deal. Senate Judiciary goes first at 10:30
a.m., with House Judiciary following at 1:30 p.m.

Comcast said it will work with Vonage on network management practices that will allow Comcast to
avoid congestion while assuring that VoIP services aren't hurt. The deal shows that the cable operator is committed to providing network management solutions that help customers and competition, Comcast Chief Technology Officer Tony Werner said. "This announcement calls into question the company's honesty about its
treatment of competing services," Free Press General Counsel Marvin Ammori said. "Was Comcast degrading
Vonage's VoIP service before this announcement? And are they continuing to degrade other services that
compete with their products?... This collaboration should do nothing to deter the FCC from investigating and
stopping Comcast's blocking of other Internet services."
