1. That,PeJ\is a member of the New Haven Depart. nt of olice Service (NHPD) and has been a member 0

said department approximately 11 years prior 0 the date hereof and at all times mentioned herein wa: acting as a member of said department. That the following facts and circumstances are stated from persona knowledge and observations as well as information received from brother and sister officers acting in theii official capacity.

2. On September 19,2010, at 0153 hours, officers of the Uniformed Services Division responded to the area of College Street and Crown Street on a report of a large fight. Upon turning onto College Street from Crown Street, Officers observed a large fight and observed as it quickly escalated into a shooting. Officer C. Cacela saw a black male retrieve a handgun and shoot at another black male within the group. The shooting resulted in the injury of two subjects later identified as Alfred Smith (12/20/87) and Eric Evans (11/9/90). Evans suffered a gunshot wound to his pelvis and Alfred Smith suffered a gunshot wound to his hand.

3. On 9119/10, Officer Cacela met with me at the intersection of Crown Street and College Street for a walkthrough account of the shooting incident. Officer Cacela stated he was working the bar detail and was posted on.foot on Crown Street near the intersection of College Street. Several passersby got his attention and advised him there was a large fight around the comer on College Street. Officer Cacela responded to the area of the alleged fight. As he turned the corner, he looked to his left and saw a group of males in a heated dispute. He then saw a black male within the group who retrieved a handgun from his waistband and fired gunshots at someone within the group. Officer Cacela drew his service weapon and fired at the gunman. The gunman turned his attention toward Officer Cacela and fired gunshots in his direction.

The undersigned, being duly sworn deposes and says;

Officer Cacela exchanged gunshots with the gunman while retreating to find cover and concealment. Th gunman ran southbound on College Street while continuing to fire gunshots in a northern direction, in th direction of Officers. Officer Cacela described the subject as a black male with long dreadlocks to hi shoulders, a striped shirt and a chrome handgun. Officer Cacela last saw the gunman running southboum on College Street.

4. On 9/19/10, Lieutenant Velleca and r went to 177 College Street in New Haven, the Cooperative Arts am Humanities High School, and we viewed video surveillance footage of September 19, 2010. There was ~ camera positioned at the entrance of the school, on the College Street, which recorded the shooting but dir not capture the entire sequence of events with clarity. The footage depicted a group of males huddlec together on the sidewalk portion of College Street, near the entrance of the Co-Op High School. A blad male within the group fired a handgun (in a northerly direction), which caused the group to disperse in al directions. The gunman ran southbound on College Street while continuing to fire gunshots in a northerly direction, The gunman was a black male with long hair down to his shoulders and was depicted wearing :: dark-colored hat.

5. On 9/23/10, Detective M. Wuchek and I interviewed in the Investigatior

Services Division. _was under custodial arrest for Violation of Probation on charges unrelated to this case. He told arresting officers that he had information on the recent shooting that occurred in the downtown area and he wanted to speak with detectives. provided me an audio taped statement, during which he stated the following: On Saturday, September 18, 2010, he went to the Static Lounge, which is located on Crown Street, with his friends, Rameil and a male subjecthe only knows as "J". While inside Static Lounge, he saw subjects he knew from the "Tre" area of the city; said he knew one 01 the subjects to be Marvin Jones (a.k.a "little messy"). While inside, Jones and his friends were staring at

6. At approximately 0150 hours (Sunday, September 19,2010), and his friends exited the lounge as i'

closed for the night. Upon exiting, _and his friends stood outside the Static Lounge establishmen and mingled. While standing in front ofthe Static Lounge, Marvin Jones initiated a verbal dispute with om of friends, "Ricky", A subject standing with Jones, who'" described as a black male witl braids, asked Jones, "What do you want me to do"? 3. would later identify the black male with braids as Eric Evans, via photo array. Ricky would later be identified as Ricky Hargett (DOB 9118/91). Both groups continued to walk westbound on Crown Street toward College Street and turned left onto College Street, southbound.

7. a said there was a confrontation between subjects within the two groups as they turned onto College Street. During the confrontation, Evans reached into his waistband and simulated possession of a handgun. 8. Evans simulated a handgun and gestured at Cadell Harris in a threatening manner, while yelling, "What do you wanna do". An unknown black male standing to the left of Evans held Evans' arm down and

attempted to deescalate the dispute. At that point, Harris pulled out a handgun and shot' at Evans. Tucker

pulled out a handgun and shot at Evans as well. The group dispersed in all directions and __ saw

9 . ._. said Harris and Tucker ran ·~thbound on College Street and went "right into the Hill" neighborhood of New Haven. ""ran into the parking lot, was detained by police and once identified he rwas-released, ~ went to 35 Frank Street (New Haven) immediately after the incident. Rameil, Ricky, Harris and Tucker wert! all together at 35 Frank:fStreet when he arrived. 35 Frank Street is the residence of Ramie1. and Ricky Hargett, twin brothers with a date of birth of 9/1 8/1991. When he arrived at 35 Frank Street, _, saw Harris shaving his long dreadlocks with hair clippers. .... said Harris had long dreadlocks that came down to his shoulders. __ also saw that Harris had a gunshot wound to his leg, which he had wrapped with a shirt.

10. While at 35 Frank Street,_ saw Harris and Tucker still in possession of the handguns they used during the shooting. He described 0110 handgun as a small black .380 caliber and the second handgun as a chrome .38 caliber. '_"said they routinely hid their handguns in the basement of35 Frank Street; however, he did not see where they placed the guns that night. had not seen Tucker or Harris since the shooting. Based on my training and experience, .38 caliber handguns are revolvers and, thus, would not

have resulted in casings left at the scene. .

11. The NHPD's Bureau of Identification Detectives arrived and processed the secured scene. The crime scene consisted of, among other things, .40 Caliber casings and .380 caliber casings. Several buildings on the westbound side of College Street were struck by gunfire and the building on the northeast corner of the College and Crown Street was also struck by gunfire. Officers of the NHPD carry .40 caliber weapons.
