1. The Federal Republic of Germany has decided to impose a public-service obligation, with effect from 1
July 2000, in respect of the scheduled air services between Erfurt and Berlin/Tempelhof, Erfurt and
Hamburg, and Erfurt and Cologne/Bonn in pursuance of Article 4(1)(a) of Council Regulation (EEC) No
2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes.

2. The public service obligation is as follows:

2.1 Minimum frequencies

A regular air service – in the form of a service at each end of the day — must be maintained. At
each end of the day means that there will be a morning return flight between 6 and 10 a.m. and an
evening flight between 3 and 10 p.m. between the point of origin and the given destination, and
back again. The evening flight on a Friday can take place from 1 p.m. onwards. That requirement
shall apply throughout the year. A limited air service is possible between Christmas and the New

2.2 Capacity

Aircraft having at least 18 passenger seats must be used for the flights involved.

2.3 Aircraft types

The flights from/to Erfurt airport must be carried out in accordance with the instrument flight
rules (IFR).

The cabin of the aircraft type used should have adequate headroom.

2.4 Fares

The maximum basic fare for a single flight on the individual routes may not exceed DEM 170
(EUR 86,92) plus DEM 0,50 (EUR 0,26) per kilometre of linear distance between the airport
reference points concerned.

2.5 Continuity of air services

The number of flights cancelled for reasons that can be directly attributed to the air carrier may not
exceed 2 % of the estimated annual number of flights.

3. The air carriers will be informed that provision of the air transport services will be put out to tender
and that contracts are to be awarded with effect from 1 July 2000. An appropriate invitation to tender
in pursuance of Article 4(1)(d) of Regulation (EEC) No 2408/92 will shortly be published in the Official
Journal of the European Communities.
