Will the negligence of using milk substitute to feed an infant resulting to injuries be

tantamount to a violation of the RPC and/or the Child and Youth Welfare Code?

Introduction:

Best nourishment for an infant is mother’s milk. There is nothing greater than
a mother to nurture her beloved child straight from her bosom. The ideal is for each
Filipino child to enjoy the equaled benefits of breast milk. (Pharmaceutical and
Health Care Association of the Philippines v Duque III, 535 SCRA 283) In this point of
view, the Philippines as well as the other countries developed laws enforcing the
use and protection of breast milk in their respective countries. One example is the
enforcement of the Milk Code during the Corazon Aquino’s Administration. The
United Nations promulgated the International Code of Marketing Breast milk
Substitutes (ICMBS) and the Global Strategy for Infant and Young Child Nutrition
(Global Strategy).

In the Philippines, several breast milk substitutes are available. After the
enactment of the Global Strategy, Milk Code was promulgated. The objective of the
milk code is to promote a safe and adequate nutrition for infants by promoting
breastfeeding and ensuring the proper use of breast milk substitutes and
supplements when necessary (milk code). In recent news reports today, several
