Purpose: To require a report on air surveillance conflicts
at Virginia Beach, Virginia.

To authorize appropriations for fiscal year 2011 for military


activities of the Department of Defense, for military
construction, and for defense activities of the Depart-
ment of Energy, to prescribe military personnel
strengths for such fiscal year, and for other purposes.

Viz:
1 At the end of subtitle E of title III, add the following:
2 SEC. 349. REPORT ON AIR SURVEILLANCE CONFLICTS AT

3 VIRGINIA BEACH, VIRGINIA.

4 (a) REPORT REQUIRED.—Not later than 180 days


5 after the date of the enactment of this Act, the Secretary
6 of Defense shall submit to the congressional defense com-
7 mittees a report on potential air surveillance conflicts at
8 Virginia Beach, Virginia.
9 (b) ELEMENTS.—The report required under sub-
10 section (a) shall include the following:

1 (1) An assessment of the impact on the per-
2 formance of the Oceana Air Surveillance Radar
3 (ARSR) of proposed construction of buildings in the
4 Virginia Beach, Virginia, oceanfront area that are
5 less than 200 feet high.
6 (2) An evaluation of the cost and impact on air
7 surveillance operations of various options for reduc-
8 ing or eliminating potential air surveillance conflicts
9 in the area, including—
10 (A) relocating the Oceana ARSR;
11 (B) upgrading the signal processing or
12 power management capabilities of the Oceana
13 ARSR;
14 (C) providing supplementary, ‘‘gap filler’’
15 radar through sources other than Oceana
16 ARSR, including a cost estimate for the pro-
17 curement and installation of such radar; and
18 (D) any other alternative options that
19 would mitigate potential air surveillance con-
20 flicts.
21 (c) CONSULTATION.—In preparing the report re-
22 quired under subsection (a), the Secretary of Defense shall
23 consult with the Secretary of the Navy, the Secretary of
24 the Air Force, the Administrator of the Federal Aviation
25 Administration, the Commander of the North American

1 Aerospace Defense Command, and the Secretary of Home-
2 land Security.
