IT IS HEREBY STIPULATED AND AGREED, by and through respective counsel, that Plaintiff’s
claims shall be dismissed without prejudice, to allow Plaintiff to continue with an administrative
review, under the following terms and conditions :

1 . The parties agree to dismiss Plaintiff’s claims pursuant to Fed .R .Civ.P . 41(a)(1) ;

2 . Each party shall bear its own fees, costs and expenses, and no party shall seek
reimbursement of any fees, costs or expenses as sanctions or otherwise in connection with the
filing, prosecution, defense or dismissal of this action.
