AGREEMENT OF LASER DAZZLER SAFETY PRINCIPLES


WITH WORLDWIDE DISTRIBUTORS AND DEALERS

THIS AGREEMENT OF LASER DAZZLER SAFETY STATEMENT ARE takes effect from the
1st day of March, 2010 by and between Jet Lasers Photonics Devices Co.,Ltd(hereinafter
abbreviated as Jetlasers), its sister companies, Shaanxi Scitower Photoelectricity Equipment Co.,
Limited and Far East Photonics International Group Limited and their worldwise distributors,
resellers, dealers and customers.

BACKGROUND

A. Jetlasers manufactures and provides a variety of portable laser dazzlers and laser dazzler
systems for military and law enforcement use only.

B. Jetlasers appeals to all its worldwise distributors, resellers, dealers and customers to follow
and spread the agreed guidelines concerning the laser dazzler safety.

THEREFORE, in consideration of the foregoing Background (which is incorporated


NOW, THEREFORE
in to this Agreement) and the mutual promises set forth in this Agreement, the sufficiency of
which is hereby acknowledged, and subject to the following terms and conditions, the parties,
intending to be legally bound, agree as follows:

SAFETY STATEMENT CONCERNING THE JETLASERS

NON-LETHAL LASER DAZZLERS

The laser dazzlers have been become a better option than other nonlethal weapons
used for personal protection or crowd control by law enforcement. The laser dazzler
weapon systems manufactured and provided by Jetlasers can be used as an alternative
to lethal force to temporarily incapacitate, confuse, delay, or restrain an adversary in a
variety of situations. They can also be used as a discretionary or disorienting device
on operational roadblocks and checkpoints and by mounted or dismounted patrols.
Such laser dazzlers can also be used for stopping vehicles.

The need for these non-lethal laser dazzlers in the military is expanding, particularly
on peacekeeping missions, the application of deadly physical force is strictly
controlled, and area commanders have a real need for force they can use without
creating an international incident.

The Jetlasers Laser Dazzler would cause temporary blindness, disorientation and
nausea when used as a non-lethal laser weapon but it runs the risk of eye damage if
used improperly, while the severity of eye damage, and its subsequent impact on the

vision of the injured party may range from quite significant to virtually undetectable,
but this is dependent on many factors and is best addressed by a medical
specialist.That’s why a training program of laser dazzler weapons become necessary
and urgent.

Various regulations require a review of the legality of all non-lethal laser dazzler
weapons that will be procured to meet a military requirement of the U.S. armed
forces.

THE LEGITIMACY of JETLASERS LASER DAZZLERS

The purpose of this legal review is to ensure that the intended use of the non-lethal
laser dazzlers is consistent with customary international law and the international law
obligations of the United States, including law of war treaties and arms
control agreements to which the United States is a party.

Non-lethal weapons are "explicitly designed and primarily employed so as


to incapacitate personnel or materiel, while minimizing fatalities, permanent injury to
personnel, and undesired damage to property and the environment." Unlike
conventional weapons, non-lethal weapons "employ means other than gross physical
destruction to prevent the target from functioning." In accordance with DOD
directives and Army regulations, the laser devices and weapons systems recently
reviewed for employment in theater were reviewed under the criteria of Article 36.

Non-lethal weapons should also be reviewed to "ensure consistency with the


obligations assumed by the U.S. government under all applicable treaties, with
customary international law, and, in particular, the laws of war.

FAQ-1: When Should Jetlasers Non-lethal Laser Dazzler weapons

Be Used?

The Jetlasers laser dazzlers can be used as an alternative to lethal force to temporarily incapacitate,
confuse, delay, or restrain an adversary in a variety of situations. They can be used as a
discretionary or disorienting device on operational roadblocks and checkpoints and by mounted or
dismounted patrols. Such lasers can also be used for stopping vehicles. Techniques, tactics, and
procedures (T-FP's) developed for the weapon systems suggest their use when:

* Lethal force is not appropriate;


* Lethal force is justified and available for back-up but lesser force may subdue the aggressor;

* Lethal force is justified but could cause collateral effects such as injury to bystanders or damage
to property and the environment; or,
* Otherwise justified by unit SOP and/or Rules of Engagement.

These weapon systems are intended to augment, but not replace, lethal weapons within the use of
force continuum and are designed to deter and dissuade civilian vehicles from encroaching on a
specified area or security zone established during convoy and vehicle checkpoint operations. The
asymmetric threat facing deployed Soldiers, including vehicle-borne improvised explosive devices
(VBIED's), requires a non-standard, aggressive means of mitigating the threat while deterring
innocent vehicle drivers and determining driver's intent at a safe distance. These laser dazzlers will
help prevent the death of innocent civilians while providing Soldiers extended range and reaction
time to destroy threat vehicles.

FAQ-2: What makes Jetlasers laser dazzlers Different from the laser

target designators? What makes Jetlasers laser dazzlers top priority

non-lethal laser weapons?

1st, "Dazzling" effects refer to temporary incapacitation of individuals by flash


blindness and glare. "Dazzler" lasers manufactured by Jetlasers are designed for this
purpose; in contrast, laser target designators can only produce such effects through
significantly prolonged exposure, which contradicts laser target designators' standard
conditions of use.

2nd, This intended use is reflective in the "dazzler" laser's Class 3b label, compared to
the Class 3a label for laser target designators. The dazzler lasers are defined as
weapons " which have an intended effect of injuring, destroying, or disabling enemy
personnel, materiel, or property." Likewise, the non-lethal weapons directive defines
nonlethal weapons as being "explicitly designed and primarily employed so as to
incapacitate personnel or materiel."

3th, The intended use of ordinary Class iiia laser pointers and portables, even
considering potential collateral effects or unintended consequences, does not meet
these definitions of a weapon.

4th, Jetlasers laser dazzlers are non-lethal weapons rather than lethal weapons, but they
are not prohibited by the Blinding Laser Protocol, Protocol IV to the 1980 Convention
on Conventional Weapons (CCW), which prohibits laser weapons that are
"specifically designed, as their sole combat function or as one of their combat
functions, to cause permanent blindness to unenhanced vision." Although the United
States is a party to the CCW, it is not a party to Protocol IV. The U.S. government has,
nonetheless, implemented its own proscription on use or transfer of laser weapons
"specifically designed to cause permanent blindness." Neither Jetlasers laser dazzlers

nor ordinary portable laser pointers are designed to cause permanent blindness nor
will they inflict such an injury during normally usage.

5th. Just like every laser dazzlers made for law enforcerst and the military, the jetlasers
laser dazzlers are used to cause temporary visual disorientation or flash-blindness at
longer ranges or advise approaching vehicles or individuals that they are being
targeted. The power density is equal with a Class 3a laser, with a power of up to 5
milliwatts (mW), which has a one-mile night time range and is visible in broad
daylight within 1000 yards.

6th, Jetlasers laser dazzler systems are all equipped with a high-end laser range finder
which not only allows the user to adjust the power level accordingly so that the
maximum safe energy is put on target, but also help sort out innocent civilians from
people who represent a threat. Simply put, These laser dazzlers will help prevent the
death of innocent civilians while providing Soldiers extended range and reaction time
to destroy threat vehicles. A fundamental principle of the law of armed conflict is that
combatants must be distinguished from noncombatants. Only combatants and military
objectives can be legitimately targeted. Civilians are protected from indiscriminate
attacks. If a weapon cannot be controlled in such a manner that it is capable of being
directed against a lawful target, then it fails the discriminate effects test.

What Makes Jetlasers laser dazzlers Eye-safe Laser Weapons


FAQ-3:What Weapons??

1. Some of Jetlasers laser dazzlers, mainly the PL-C Laser Dazzlers and PL-G Laser Dazzlers,
are Class 3b lasers with sufficient power (200, 300, 400, 500 mW, respectively) to cause ocular
injury at short ranges (20, 30, 50, and 80 meters, respectively, based on a 0.25-second unaided
exposure) and temporary visual disorientation or flash-blindness at longer ranges. The hazard
classification for a laser is based on the most restrictive Maximum Permissible Exposure (MPE)
calculated. The MPE for a 0.25-second unintentional exposure to a 532 nm continuous wave laser
is 2.6m W/cm2. To classify a laser, an accessible emission limit (AEL) is calculated by
multiplying the MPE by the area of the limiting aperture, based on the laser wavelength and
0.25-second exposure duration.

2. The Class 3b laser upper limit is 500 mW. The output of the jetlasers portable laser dazzlers,
FDA certified version, 150-500mw dazzler lasers are all under that limit respectively. All five
weapons have a disorienting or flash-blinding effect on targeted personnel up to 200 meters in
daylight and 400 meters at night. These effects are temporary and have more impact in low-light
conditions since the effect is exacerbated by the greater difference between the laser light and
ambient light.

These lasers, under standard conditions of use, would not cause eye injury. A momentary direct
exposure of the eye, even momentary exposure through the ocular pupil, to a Class 3b continuous
wave laser would appear very bright under low luminance conditions (e.g., dawn, dusk, or night).

3. Exposure incidents of this nature are similar to laser target designators and usually result in
rubbing of the eyes and concern about whether injury occurred because the laser appeared so
bright. The aversion response, which includes head and eye movements, pupil constriction, and a
blink and squint response, would limit the exposure of any one area of the retina and prevent eye
injury.

4. NOHD Clearly Defined by Jetlasers: Prolonged and deliberate staring into a Class 3b laser
could result in retinal injury or maculopathy, but the danger of immediate or permanent injury is
minimal outside the nominal ocular hazard distance (NOHD). The NOHD for enhanced vision
(i.e., glasses, binoculars, and night vision devices) is 20/30/50/80/100/200/500/1000 meters for the
portable laser dazzlers and laser dazzler systems manufactured by Jetlasers. These limitations are
largely based on safety standards established by the American National Standards Institute,
American National Standard for Safe Use of Lasers.

5. The most likely type of injury caused by this wavelength of laser is photochemical damage,
causing cumulative retinal damage. The available research, however, indicates that initial eye
damage lessens over time during healing. Based on the scientific data accumulated during tests of
these and related systems in 2005, the standard conditions of use for these lasers will not cause
permanent blindness to enhanced or un-enhanced vision.

6. The case is also true for the 700Mw/1000mw/1500mw/2000mw laser dazzlers manufactured by
the Jetlasers though they’re obviously the Class IV lasers (c.w. >500mW or pulsed >10J/cm²)
laser devices. Although the direct beam and diffuse reflections from Class IV lasers are hazardous
to the eyes and skin, they’re required not only to ensure the safe operation but also control the
power density to 0.6-2.6mw/cm2 outside the range of their respective listed NOHD.

SAFETY GUIDELINES FOR JETLASERS LASER


DAZZLERS

1. Fully aware of the NOHD and take the range of the laser systems into consideration

Polices and Soldiers should be trained to shine a green laser dazzler before they use it
as tactical non-lethal weapons. They should be fully aware of the Nominal Occular
Hazard Distance — making sure there is no risk of eye damage when they point the
dazzler lasers upon any human being. It holds the potential to do permanent damage to
people, anyway.

2. Learn all the safety features of Jetlasers laser dazzlers, such as the key switches,
remote connector keys, the aperture stop, etc. Try to avoid the possibility of an
accidental activation of the device, potentially exposing soldiers within the NOHD
[Nominal Ocular Hazard Distance] to a hazardous level of radiation.

3. On the battlefield, a soldier handling the Jetlasers laser dazzler should pay attention
not to be injured or thrown the wrong way by the laser dazzlers and accidentally aim
the device at a comrade.

In most cases, only a few hours of training are required for new operators to be
qualified to use the Jetlasers laser dazzler weapons.In this way, with all the fudge
factors, the redundancy, the safety and the training that the soldiers are going to get,
the risk is negligible if not minimal.

4. The Jetlasers manufacturer or the military should equip its soldiers with laser
goggles or protective eyewears for guaranteed laser safety, esp. what they would use
is the Class IV lasers (c.w. >500mW or pulsed >10J/cm²), portable laser dazzler or
laser dazzler systems, although they don’t have to wear the safety goggles all the time.

5. The Polices and Soldiers should also be trained to transform the non-lethal laser
dazzlers into lethal weapons in emergency, in case lethal force might have to be used
if nonlethal options fail. This might be a lifesaver both for the threat and the enforcer.
There is no legal requirement to use non-lethal weapons where deadly force is
warranted by the circumstances.
