d is located in Subarea 6 of Planned
Development District No. 366. Dallas Development Cod
e §51P-366.105(f)(5) requires that a hotel or
motel use in Subarea 6 of Planned Development District No.
366 have a specific use permit and have
more than 60 guest rooms. The Luxury Inn Motel does not
have a specific use permit to operate and
has fewer than 60 guest rooms. Therefore, the Luxury Inn
Motel was a nonconforming use.
Dallas Development Code §51P-366.1 14(b)(2) provides
that the right to operate a nonconforming
hotel or motel use in Subarea 6 of Planned Development Dist
rict No. 366 automatically terminates on
January 13, 2011.

Dallas Development Code §51P-366.l 14(b)(3) provides


that the owner of a nonconforming hotel or
motel use may request an extension of this complian
ce deadline by filing an application with the
board of adjustment at least 30 days before the deadline.
Failure to timely file a complete application
for extension constitutes a waiver of the right to contest the
reasonableness of the deadline.
You did not apply for an extension of the compliance date
in a timely manner. Therefore, pursuant to
Paragraph 306.12.3, “Void,” of Subsection 306.12, “Voiding
of Certificate of Occupancy,” of Section
306. “Certificate of Occupancy,” of Chapter 52, “Adm
inistrative Procedures for the Construction
Codes,” of the Dallas City Code, Certificate of Occupanc
y No. 0901261034 was void as of midnight
on January 13, 2011. You must cease operating as a hote
l or motel use.
