Defendant MOTION TO VACATE SEALING ORDER PURSUANT TO FLORIDA SUPREME COURT RULING SC06-2136 AND THE FLORIDA RULES OF JUDICIAL ADMINISTRATION 2.420(5) Please Take Notice, that on this 06th Day of February, 2012, pursuant to Florida Supreme Court Ruling SC06-2136 and the Florida Rules of Judicial Administration 2.420(5) which states A nonparty may file a motion to vacate a sealing order I respectfully demand compliance with Florida Supreme Court ruling SC06-2136 and Florida Rules of Judicial Administration 2.420(3) which states A sealing order issued by a court must state with specificity the grounds for sealing and the findings of the court that justify sealing. After reviewing the court records, this was not addressed in the Court Order of December 06, 2011 by Judge Richards. Further, the Florida Supreme Court Ruling SC06-2136 and the Florida Rules of Judicial Administration 2.420(2) states A public hearing must be held on any contested sealing motion and may be held on certain uncontested sealing motions was also never adhered to by Judge Richards. Additionally, based upon Judge Richards involvement with the order to expunge records involving him, as well as his bias and prejudice against Ronald Gillis, a unbiased and impartial judge should hear this motion.
