In Scathing Attack On CapitalSources Business Model, The University Of Dayton Law Review Denounced Tax Certificate Foreclosures. In an examination of the very business model employed by CapitalSource, the editor-in-chief of the University of Dayton Law Review wrote, To make matters worse, the twelve largest counties in Ohio are putting tax liens into the hands of aggressive, private investors that seek only to turn a profit from the

Effective in 1998, the tax certificate statutes allow counties to sell tax certificates to private investors, who then have tax liens with the first priority of property tax liens. These private investors are exacerbating the foreclosure crisis by aggressively foreclosing on these tax liens. A review of records available through the Cuyahoga County Court of Common Pleas and the Cuyahoga County Office of the Auditor revealed that on February 15, 2012, CapitalSource owned 167 properties in the county, most of which were residential properties. Records show CapitalSource took the properties after foreclosing on the previous owners. Appendix: Sample Of The Ohio Properties Taken By CapitalSource Through Foreclosure


A review of civil court records in Ohios Cuyahoga County has revealed that John Delaneys CapitalSource has been active in the Cleveland area, purchasing tax liens tied to local properties from the government and subsequently foreclosing on the properties. In total, CapitalSource (in some cases listed as two words Capital Source), has been the plaintiff in 1,670 cases in Cuyahoga County Court of Common Pleas. A review of the cases reveals that the vast majority of these cases are Tax Certificate Foreclosure cases or Foreclosure Marsh. of Lien cases. A comparison of foreclosure court records and Cuyahoga county property records revealed that in virtually all cases CapitalSource is acquiring the foreclosed properties following conclusion of the foreclosure cases. On February 15, 2012, a search of the Cuyahoga County Office of the Auditors database revealed that CapitalSource (sometimes listed as two words Capital Source) was the owner of 167 properties in the county, with the majority being residential properties. Over the two days following our initial search, CapitalSource sold off two of the properties, reducing the number of properties they own as of February 22, 2012, to 165. Further analysis revealed that the properties owned by CapitalSource were acquired directly from the defendants they brought foreclosure cases against. In every case, the parcel numbers listed in court documents matched up with the parcels transferred from the foreclosure defendant to CapitalSource. The chart below examines a sample of the properties owned by CapitalSource on February 15, 2012. In almost every single instance, records show the defendant in CapitalSources foreclosure case is the immediate past owner. Of the 83 properties examined below, 74 of them were residential properties; six were residential vacant land; one was classified as Other Commercial Structures; one was classified as Other Residential Structures; and one was classified as Manufacturing and Assembly Light. A review of the other properties reveals a similar trend is at work. The property and foreclosure case records prove beyond a doubt that Delaneys CapitalSource has been profiting by foreclosing on families and taking their homes.
