This letter is submitted jointly by the Manufacturers in response to the Court’s Request
For Proposed Agendas, dated of November 26, 2008.

The following matters are the Manufacturers’ priorities for the hearing set for
December 10, 2008:

1. Manufacturers’ Motion For Summary Judgment For Summary Judgment of

Invalidity Under 35 U.S.C. § 102 of Claim 16 of U.S. Patent No. 6,266,285;
Claims 27 and 43 of U.S. Patent No. 6,314,051; Claim 28 of U.S. Patent No.
6,426,916; and Claim 16 of U.S. Patent No. 6,452,863 (MSJ No. 1);

2. Joint motion of Hynix, Micron, and Samsung for Summary Judgment of

Invalidity Under 35 U.S.C. § 102 of Claim 14 of the ‘184 Patent, Claim 33 of the
‘120 Patent, Claim 16 of the ‘863 Patent, Claim 3 of the ‘446 Patent, claim 43 of
the ‘051 Patent, and Claim 34 of the ‘037 Patent (MSJ No. 2); and

3. Manufacturers’ Daubert Motion to Preclude Testimony of Robert Murphy on

Secondary Considerations of Nonobviousness (Daubert No. 1).

These motions, if granted, will substantially reduce the burden on the Court and the
parties in trying liability in this litigation; even if not granted, decisions on these motions will
provide significant guidance to the parties as to the issues that remain in the case and how
