How do we know when copyright applies to using materials in education?


A great deal of information is protected by copyright laws. Educators are under the misapprehension that they are exempt from copyright laws because of the fair use policy. However, contrary to popular belief, there is no blanket exception under copyright law for education uses of that information. Fair use qualifies under copyright law based on 4 factors:

How the work is being used Nonprofit, teaching, and research uses generally are allowed, whereas commercial uses are NOT. The nature of the work . The use of published or nonfiction work is favored over the use of unpublished or fictional work, because the author in the latter case did not agree to share the work publicly. The amount and substance of the work used.So using large portions of a work or a key point of a work is not permitted. The effect of the use of the work. So, if the use of the work reflects negatively on that work, it is not allowed.
