2012 Sweet & Maxwell Ferguson v Covel Also known as: County Court (Birmingham) 11 November 1996 Case Analysis Where Reported [1997] C.L.Y. 1900; Case Digest Subject: Personal injury Keywords: Measure of damages, Neck, Pain, Personal injury, Whiplash injury Catchphrases: Personal injuries or death, quantum, neck, whiplash type injury Abstract: Female, age 25 at the date of accident and 29 at the date of trial, was involved in a road traffic accident. She developed pain from a whiplash type injury in her neck almost immediately and, within two weeks, pain in her lumbar spine. She wore a soft collar day and night for two weeks, and then for days only for a further week. She was absent from work for five weeks and required at least eleven sessions of physiotherapy. Her neck pain improved, but back pain continued and had reached a plateau when, eight months after the accident, she was involved in a second road accident for which no one was at fault. This caused her to return to physiotherapy for a short period and have one day off work. The symptoms that resulted from this accident completely resolved after two weeks. Her original neck symptoms had completely resolved by trial, but a moderate back injury persisted. Pain was always to some degree present. She took prescribed pain killers as necessary for two and a half years, and then proprietary pain killers occasionally. She modified her lifestyle to avoid carrying heavy objects. She ceased aerobics and golf, and lost enjoyment from gardening. Her injury had affected her domestic life and made her work with computers uncomfortable. The injuries were purely soft tissue and the prognosis was that the continuing pain was unlikely to improve significantly. General Damages: GBP 7,500.
