I am receiving complaints from prosecutors that judges are interrogating them about the evaluations and the prosecutors
are feeling harassed. I would respectfully request that these inquiries stop immediately. If a judge has a question about
evaluations, they may ask me and I will be happy to meet with that judge. I would hope that you will address this matter.

I have no knowledge of any prosecutors being harassed by any Judges. If you have a specific Judge or Judges about
whom you have received complaints, please let me know and I will address the matter with that Judge or those Judges.
do not feel it appropriate to j ust put out a blanket "stop harassing the prosecutors" to all the Judges, when there is no
reason to do so.
Judges will speak with prosecutors, asthey will with Defense counsel, officers, Defendants, Clerks, and anyone else in
t he Courthouse . That I cannot and will not attempt to prevent. But if there is harassment going on, I need to know
about it - with specific ity.

Judge Lander,
Although we discussed the harassment issue further by phone, I want to address your last point.
The prosecutor's evaluations are indeed valid and worthy of response, but in a different venue. The
prosecutor's evaluations are supported by documentation and provides a clearer picture of what is really
happening in Dallas Municipal Court. The outrage expressed has been the product of politics. rather than
concem for truth and justice. However, the great thing about a courthouse is that the truth is
documented. The prosecutor's points are not invalid, but probably misplaced. Many of the issues raised
by prosecutors may have been issues for the Texas Commission on Judicial Conduct and should not
have been submitted through a judicial evaluation process; a determination to be made by the city
attorney.
You and I have had many conversations (some memorialized through e-mail) concerning ex parte
communications stemming from "open" pleas and the ill-fated off-docket system. The off-clocket process
screams ethical jeopardy by allowing attorneys to forum shop, and justifying/promoting ex parte
communications, etc. Yet after countless e-mail exchanges and group meetings which have included the
City Attorney, First Assistant City Manager and Court and Detention Services Director, Gloria Lopez
Carter, you have not made any remarkable changes. I look forward to working with you to address our
systemic ailments and pave the way for our courthouse to be a hall of justice rather than the joke told
statewide.
