The Factory is represented by Shri R.S. Jha, Additional GM and Shri Rohit Patel, Charge-man. These appeals are being disposed of through the order that follows. 2. The matter, in short, is that the appellant is a Bachelor of Engineering. He is presently working as Charge-man in the Factory. He had applied for grant of NOC so that he could look for a job elsewhere but NOC was not granted to him. It is his contention that NOC was granted to certain other Charge-men viz. Sashant Tikle, Subhang Joshi and Shweta Ambedkar etc. but it was denied to him for no good reasons. 3. On the other hand, Shri Jha submits that the Management has exercised its discretion in the grant of NOC to the above named individuals. As regards the appellant, Shri Jha submits that NOC was denied to him due to shortage of staff in the Factory etc. 4. There is no doubt that the Management has a discretion in the matter but it has to be kept in mind that it is also the duty of the Management to see that its employees realize their full potential by exploring career progression avenues of their liking which is possible only through the grant of NOC. NOC is, thus, a strong weapon in the hands of Management which needs to be wielded objectively and impartially. Hence, I would expect the General Manager to look into the appellants case afresh considering his educational qualifications and the fact that he has already served the Factory for 08 years. 5. As regards the issues raised in the appeals in-question, I am broadly satisfied that the requested information has already been supplied to the appellant. However, as far as File No.CIC/LS/A/2012/1293 is concerned, the CPIO is hereby directed to supply information regarding the duties and responsibilities of Junior Works Manager; AWM/WM/DGM; Joint GM; Additional GM and GM etc. to the appellant, free of cost, in next 03 weeks time.
