filing Ethics Complaint with the Jerusalem District, b. Request for clarifications regarding the filing and review
procedures.
1. Letter by the Israel Bar Association, dated July 22, 2012, post-stamed July 23, 2012, re: Attorneys Yoram
HaCohen and Amit Ashkenazi (your number A2-complaints-00937512)
2. Letter by the Israel Bar Association- Jerusalem District Committee, dated July 15, 2012, post-stamped
July 18, 2012 (your number P313/12)
Dear Sir/Madam:
The undersigned thanks the central office of the Israel Bar Association and the Jerusalem District Committee for their
expedient response on his latest communication. The two above referenced letter reached my hands only today, and I am
rushing my response.
The writer is not an attorney and is not represented by counsel in this matter, but believes that the Israel Bar Association
would review the Complaints under due process/fair hearing procedures.
a. Request for extension of the deadline for filing Ethics Complaint with the Jerusalem District
The letter of the Jerusalem District Committee set a deadline for filing the Ethics Complaint of 14 days, and I respond prior
to the end of 14 days from the date of mailing:
i.
A letter of this nature, setting a short deadline, should have been sent by certified mail with certificates of
delivery, similar to service and delivery procedures in fair hearings.
ii.
It is unclear what the start-date of the count is.
iii.
It is unclear what the legal foundation for this deadline is.
iv.
The reason for such expediency is unclear, after the Bar delayed its responses for weeks.
v.
The two letters, referenced above, left material questions regarding the procedures of filing and
review of the Complaints unclear, as detailed below, and therefore, the deadline is not reasonable.

Therefore, I request extension of the deadline for filing the Complaint with the Jerusalem
District Committee, until further responses are received regarding the filing and review
procedures, as detailed below.
b. Request for clarifications regarding the filing and review procedures by the National Office, the Jerusalem
District, and the Tel-Aviv District
The two above referenced letters left material questions, regarding the filing and review procedures unclear:
i.
To the best of my knowledge, the two attorneys are registered in two different Districts, and pursuant to the
instruction, published online under Complaints and Disciplinary Procedures, General Information, February
2012, National Ethics Committee, the two Complaints were filed with the two Districts, respectively.
ii.
The above referenced letter of the National Office was addressed to the Tel-Aviv District and pertained to
receipt of the Complaint in the latter office. However, its subject line pertains to both attorneys.
iii.
No corresponding response has been received to this date from the Tel Aviv District.
iv.
In parallel, a letter was received from the Jerusalem District Committee, also pertaining to both attorneys,
altough to the best of my understanding one of the two is not under the jurisdiction of the Jerusalem District at
all.
v.
The conduct, subject of the Complaint, in part is through cooperation of the two attorneys, for example:
appearance before the Knesset Committee, where one of the two introduces the other as Registrar of
Certifying Authorities, and the other then appears under such introduction, while holding no valid
Appointment Record or lawful authority as Registrar of Certifying Authoritiess.
Therefore, the two Complaints should be filed separately with the two Districts, pertaining to each of
the two attorneys, respectively, under a format that is agreed by the two Districts, and that the review
process be coordinated by the two Districts.
vi.

The instruction in the Jerusalem District Committee, regarding filing the complaint (with no references to
appendices) has no legal foundation, and is not reasonable, since it is common to attach to complaints of legal
nature appendices, providing various writings as evidence.
Therefore, to expedite the process, and realizing the significance of the form for valid and fair
hearings, I propose for your comments as follows: Complaint record up to 5 pages, with clear
references to well-organized appendices, with no reliance on external links.
