Abstract
Downloading is something that 99% of the humans that have access to internet in this present era can boast of attempting. One percent for those toddlers that just go online to play games or for

computer illiterates that have access to the internet and have no idea what exactly is happening on there. The normal saying Music is life most people need music to go through life and so, most people use music to study, to celebrate, to entertain, to illustrate and more. Downloading songs for free online is so easy and fast. This is why indiscriminate downloading is something that is prominent in our society today. This paper talks about the effects illegal download of music has on the music industry, who exactly it affects, and how it affects them.

Introduction

Music is life. This is a saying common in the music industry today. The music industry is one of the fastest growing industries in our society. These days everybody seems to be seeking refuge in the music industry. Drop outs work their way to the top with the help of music, a few go to school to actually study music, some others neither sing nor study music, they produce music, others are promoters of music while the general public merely seeks refuge in music in time of distress. Music is also used to entertain guests, illustrates certain matters, while some students like me for example, and cannot study without music. Since everyone has one thing or the other to do with music, indiscriminate downloading of music is something that is prominent in our society. Everyone wants a short path to get their beloved music. This has its disadvantages and a few advantages.

What is Piracy According to music united for strong internet copyright (MUSIC); piracy is an act of

theft. It is the unauthorized use or copying of intellectual property. MUSIC complains that the meaning of intellectual property is usually misunderstood. Intellectual property is the contents are the songs on the CD not the CD plate itself. The copying and transfer of this intellectual property is what is referred to as piracy. Piracy is when an individual buys a CD its contents on public sites for just anyone to download for free. Piracy is when an individual uses special software to get the sound tracks from YouTube videos or from promotional videos. Piracy is when intellectual properties are

transferred from one digital device to another via Bluetooth. Piracy is the illegal copying and selling of these intellectual properties.

3.0.

The concept of indiscriminate downloading

The issue of piracy did not draw attention until the advent Napster in 1999. This is a site where users can upload songs and as well download any song of their choice as long as another user has uploaded it. Napster gained over 20 million users by the year 2000. The original idea was for users to be able to burn their own CD mixes unknowing it was giving the general populace an unlimited selection of music for free. Anyway, the basic idea of piracy is people getting materials that are supposed to be bought for free or for less than the original price. According to MUSIC, the users of Napster did not view downloading of music as piracy. In fact, a teenage interviewed by Newsweek, stated that People dont think its anything bad...or think about it at all (MUSIC 4-5). The normal question to ask would be Why do people download these songs illegally? Who are the people that pirate these intellectual properties and why do they do it. These questions would be answered in the subsequent paragraphs. 3.1. Why do people download songs illegally

The first reason should be, people most times like one song. A single song has never been put in the store for sale. Rather one will have to pay for the entire album which may be worthless.

The media does not cover this topic enough so most people really do not know that downloading music indiscriminately is a crime. (abeerkadhem 2011)

The internet is a service opened to the public, you can access it from wherever provided you have the required facilities. There is no security guard watching over you while you surf the web with your personal computer. This is one of the reasons why people feel at ease to download as much as possible.

Also, accessibility is another factor to consider. Most people know the sites to download these songs, so why waste money getting these things.

3.2.

Illegal music in Nigeria

In Nigeria, all the above reasons would apply as possible reasons for piracy in Nigeria However, the most important factor as to why Nigerians download music illegally instead of buying or streaming it online, would be because most Nigerians prefer the cheapest way to get things. It is cheaper to download songs than buy them. Buying of songs whether online or in the music store is more expensive than free downloads online. Especially, if you have efficient internet service Another factor to consider is that Nigerians like to find the shortest cut and also the cheapest means and they dont care about the quality of the music. As long as theyve gotten the music and it plays well, that is all. A pirate shop can be located beside a shop that sells original music, and it is guaranteed that in Nigeria, the pirated shop will make more money because they are cheaper and to an average Nigerian man, they produce the same thing and that is all that matters. It could also be because the press and Nigerian artists do not make emphasis on the

consequences of Piracy. If people are told who it affects and how it affects them, I am sure the considerate Nigerians will make an effort to buy the real thing.

4.0.

The consequences of downloading illegally

Other than the fact that the companies that produce these songs lose money, there a few other negative effects of downloading songs indiscriminately. 4.1. Negative Effects

These companies not only lose money from lack of sales, they also lose their cost of production and are not able to gain it back.

Retailers tend to increase to increase the prices of the original CDs so as to make ends meet.

The song writers lose: These are the artists that do not record nor sing the music. Even though the artists gain from the shows, these people gain money from the record companies. When the record companies lose, they lose as well. (Galdson 26-27) [ 4.2. Positive Effects

It helps promote musicians. Illegal downloads are free and songs are downloaded every day for free. Artists can make use of this means to promote their new songs and it could also be used when selling concert tickets. Just put a few songs out there, people will download it rapidly and you would get recognized and people will want to come watch you live.

In the long run, we would discover that indiscriminate downloads has a ripple effect. Eithers ways, everyone is affected be negatively or positively. It does not affect just the artist negatively. It also affects the downloader. Same theory goes for the positive effects. When people download, the artists gain popularity. The public gets their songs for free while the record companies suffer.

5.0.

Suggestions to stop or tolerate illegal downloads


Since the Artists gain more than record companies do, it will be only advisable the record

companies make a deal with the artists. For every show you are invited to, we get twenty percent of the pay. That way, what they lose from CD production would be covered. Local internet providers should offer their users pay for song downloads as they pay for their monthly bills. Users will be more willing to pay for their songs that way. If the fee is almost insignificant, that would be a huge step up for the music industry. (Timmer 2011) The punishment for pirates should be publicized and made stiffer. If someone steals from the bank, everybody knows that the logical reason is to imprison the person. However, nobody really knows what the punishment for an intellectual thief. The government should look for a way to legalize illegal download. One way or another, when something is digitized, it can and will inevitably be freely shared over the internet. (Plotkin 65). Samsung, Nokia, Blackberry and the other phone companies will not stop creating phones with Bluetooth services. When these services are available, they must be used.

Conclusion

No doubt illegal downloads is a treat to the music industry. With the aforementioned suggestions to curb the problems of illegal downloads, I am sure that the whole issue will be reduced to a significant stage.
