The Circuit Attorney of the City of St. Louis, State of Missouri, upon information and belief, charges that Count 3: Murder 2nd Degree (Class A FELONY) RSMo 565.021 PM Place: 3XX North Taylor ON 8/18/2012 Time: 2:20 (SCC 10031)

The defendant, in violation of Section 565.021, RSMo, committed the class A felony of murder in the second degree, punishable upon conviction under Section 558.011, RSMo, in that on or about August 18, 2012 at 2:20 PM, in the City of St. Louis, State of Missouri, Megan Boken, was killed by being shot as a result of the attempted perpetration of the class B felony of robbery in the first degree under Section 569.030, RSMo committed by the defendants, Keith Esters and Johnathan Perkins, on or about August 18, 2012 at 2:20 PM, in the City of St. Louis, State of Missouri.

The defendant, in violation of Section 571.015, RSMo, committed the felony of armed criminal action, punishable upon conviction under Section 571.015.1, RSMo, in that on or about August 18, 2012 at 2:20 PM, in the City of St. Louis, State of Missouri, the defendant, Johnathan Perkins, committed the felony of murder in the second degree charged in Count III, all allegations of which are incorporated herein by reference, and the defendant committed the foregoing felony of murder in the second degree by, with and through, the knowing use, assistance and aid of a deadly weapon.

The defendant, in violation of Section 564.011, RSMo, committed the class B felony of attempted robbery in the first degree punishable upon conviction under Sections 564.011, and 558.011 , RSMo, in that on or about August 18, 2012, in the City of St. Louis, State of Missouri, defendants, Keith Esters and Johnathan Perkins, pointed what appeared to be a firearm at Megan Boken, and such conduct was a substantial step toward the commission of the crime of robbery in the first degree, and was done for the purpose of committing such robbery. The defendant, in violation of Section 571.015, RSMo, committed the felony of armed criminal action, punishable upon conviction under Section 571.015.1, RSMo, in that on or about August 18, 2012 at 2:20 PM, in the City of St. Louis, State of Missouri, the defendants, Keith Esters and Johnathan Perkins, committed the felony of attempted robbery in the first degree charged in Count V, all allegations of which are incorporated herein by reference, and the defendants committed the foregoing felony of attempted robbery in the first degree by, with and through, the knowing use, assistance and aid of a deadly weapon.

PROBABLE CAUSE STATEMENT DATE: August 24, 2012 I, Jerone Jackson, a law enforcement officer for the City of St. Louis, State of Missouri, knowing that false statements on this form are punishable by law, state that the facts contained herein are true. 1. I have probable cause to believe that Johnathan Terrell Perkins, a Black Male DOB: XX/XX/94 Age: 18, committed one or more criminal offense(s). Count 3: Murder 2nd Degree (Class A FELONY) RSMo 565.021 ON 8/18/2012 Time: 2:20 PM Place: 3XX North Taylor (SCC 10031) Count 4: ARMED CRIMINAL ACTION (FELONY) RSMo 571.015 ON 8/18/2012 Time: 2:20 PM Place: 3XX North Taylor Count 5: Attempted Robbery 2nd Degree (Class C FELONY) RSMo 569.030 ON 8/18/2012 Time: 2:20 PM Place: 3XX North Taylor Count 6: ARMED CRIMINAL ACTION (FELONY) RSMo 571.015 ON 8/18/2012 Time: 2:20 PM Place: 3XX North Taylor 2. The facts supporting this belief are as follows: Megan Boken was found dead inside her vehicle. She was shot two times in the chest and neck. Witnesses revealed they heard gun shots and observed an individual running from the scene of the shooting. Investigation into the shooting led to a cell phone that was connected to another robbery that occurred into the area. That investigation led to a witness who stated that her boyfriend, Keith Esters, admitted to her that he was involved in the shooting of Ms. Boken. The witness also stated that her boyfriend and his cousin, Johnathan Perkins, made plans to drive to the Central West End and commit a robbery. Johnathan Perkins was located by the St. Louis Police Department and stated that he agree to drive Keith Esters to the Central West End to commit a robbery. Johnathan Perkins stated that Keith Esters saw the victim in the Central West End speaking on her cell phone and said that she would be the target of the robbery. Johnathan Perkins then stopped the vehicle and let Keith Esters out to commit the robbery. Johnathan Perkins parked his vehicle within sight of the shooting. Johnathan Perkins waited for Keith Esters after he shot the victim and drove him from the scene. Johnathan Perkins stated Keith Esters told him that he shot the victim. Keith Esters stated to the police that he saw Ms. Boken speaking on her cell phone. Keith Esters decided that she would be the target of a robbery. Keith Esters approached Ms. Boken with a handgun and during the course of attempting to take her property, he shot Ms. Boken twice. An eye witness observed Keith Esters running from the scene immediately after Ms. Boken was shot. This witness positively identified Keith Esters as the person running the scene.
