 1 STIPULATION AND ORDER
2 WHEREAS, the 05-06 Patent Trial is scheduled to begin on February 17, 2009
3 (hereinafter the "Patent Trial");
4 WHEREAS, the scheduling order dated July 16, 2008 ("Patent Trial Scheduling
5 Order"), and the Court's Standing Order Re: Pretrial Preparation, set certain pretrial deadlines for
6 the Patent Trial;
7 WHEREAS, the Court, via the Court's Order Memorializing Wilfulness
8 Procedures dated December 4, 2008, set forth a schedule for pretrial submissions with respect to
9 wilfulness;

10 WHEREAS, in response to the Court's Request For Proposed Agendas dated

11 December 12, 2008, extending the deadline for fiing the joint pretrial conference statement to

12 January 5, 2009, the paries agreed, via a joint stipulation and proposed order filed on December

13 22, 2008 and signed by the Court on December 24, 2008, to a schedule for pretrial submissions,

14 including a date for filing proposed findings of fact and conClusions of law for non-jury issues
15 pursuant to Standing Order Paragraph B(7);

16 WHEREAS the paries have further agreed to amend the schedule for fiing
17 proposed findings of fact and conclusions of law regarding inequitable conduct;

18 WHREAS Micron Technology, Inc. and Micron Semiconductor Products, Inc.

19 ("Micron") and Rambus Inc. ("Rambus") have further agreed to amend the schedule for filing any
20 proposed findings of fact and conclusions of law regarding Micron's license and standing
21 defenses;
22 NOW therefore, it is hereby AGREED and STIPULATED, by and among the
23 paries hereto through their undersigned counsel, that:
24 1. Proposed findings of fact and conclusions of law regarding inequitable
conduct shall be fied concurrently with findings of fact and conclusions of
25 law regarding wilfulness; and

 1 2. If the case against Micron is not dismissed or stayed and trial against
Micron is set to proceed commencing February 17, 2009, proposed
2 findings of fact and conclusions of law regarding Micron's license and
standing defenses shall be filed by February 13,2009.
