JOINT MOTION FOR RELIEF FROM STAY BElWEEN DEBTOR AND TOYOTA MOTOR
CREDIT CORP.
Now come the parties, Delta Produce, LP ("Debtor") and Toyota Motor Credit Corp.
{"Toyota"), by and through counsel and hereby jointly request an order from this Honorable
court, pursuant to 11 U.S.C. 362, granting Toyota relief from the automatic stay to enable it to
recover and liquidate its collateral: two (2) Peterbilt tractors, VIN #'s 1XP7D49X79D786104 and
#1XP7D49X99D786105 (the "Collateral")
The grounds for this joint Motion are as follows:
1. Toyota is the Lessor of the collateral by virtue of a Lease Agreement dated
November 5, 2008, whereby Debtor is the Lessee of the collateral.
2. Debtor filed the within Chapter 11 proceedings on January 3, 2012.
3. Debtor desires to surrender the collateral to Toyota.
WHEREFORE, the parties pray for an Order granting Toyota relieffrom the automatic
stay to enable Toyota to recover and sell its collateral.
