XTOGeronimo Land Use Statement

Dear Sir/Madam, Pursuant to the requirements of the City of Dallas' Specific Use Permit guidelines, the following is the land use statement for the proposed drilling activities at the former Naval Air Station. Description of Proposed Activity The well pad will be used for drilling natural gas exploration and production wells. The following paragraphs provide a description of the well pad construction, drilling, completion, and reclamation process. The first step in the construction process will be clearing and grading. After the area is cleared, it will be sli~htly excavated to account for the 6-inch layer of crushed rock that will be used to stabilize the pad. Once the pad is compacted and the rock has been placed, the pad will be ready for the drilling rig. At this point the drilling rig, temporary mobile offices, and power system will be moved onto the pad and drilling will commence. A 12.25"surface hole will be drilled and 8.625" surface casing will be set and cemented to the depth prescribed by the Texas Commission on Environmental Quality (TCEQ)to protect usable quality ground water. A 7.875" hole will be drilled to the proposed total depth ofthe well and 5.5" production casing will be set and cemented to surface. After the well has been drilled a completion rig will be mobilized to complete the well in the Barnett Shale. The"Barnett Shale will be perforated and fracture stimulated to allow gas to enter the production casing and flow to the surface. After a brief initial production period (typically two to four weeks), a completion rig may again be employed to clean the well bore of frac sand and to run and set production tubing for final production operations. Accessory uses for the proposed gas development include an internal access road, produced water storage tanks, separation facilities, and other uses necessary and customary for gas development. Meters, storage tanks, separation facilities and flow lines are depicted on the operation site plan in the SUP submittal. The well pad will be secured by a 6 feet tall barbed wire fence with a locking device to prevent unauthorized entry. Following drilling of the first well, other wells may be drilled depending on the success of the development and the availability of a local gas market. Wells that are not commercially productive will be plugged at the time of such determination. All producing wells will be plugged at the end of their economic life. All wells will be plugged in accordance with the current applicable Railroad Commission regulations. Vehicular access to the well pad will be off Jefferson Blvd. through a locked gate. The access drive will be constructed with an all weather road material (t.e., Grade 1 flex base) compacted for a smooth driving surface. Fire Access will be provided in accordance with all local, state and federal requirements. Water used for the drilling and completion phase will be stored in frac tanks on the well pad during fraclng operations. Drilling mud utilized during the drilling phase of the well will be stored in steel

Page circulation pits; fresh water will be stored in steel tanks. At the end of the drilling and completion processes the water and drilling mud will be removed by truck and disposed of at an approved facility pursuant to the requirements of the Railroad Commission of Texas.

Produced water from the gas production stream will be stored in a 210 barrel, 8' tall low profile tank on the well pad. The tank will be situated within a secondary lined containment berm capable of holding 150% of the ta nk volume. The tank will also be equipped with a sensing device that will close in the well should the tank become full. The produced water will be removed periodically bv a commercial operator and disposed of in an approved facility in accordance with requirements of the Railroad Commission of Texas. Although the well pad is above the lOO-year floodplain, the tank(s) will be located on the east side of the pad, as far as possible from Mountain Creek and its floodplain and the storage tank(s) will be flood-proofed. Any surface disturbance not necessary for production operations will be reclaimed to original contours and reseeded. At the end of the wells' usable life, the well(s) will be plugged and the site reclaimed in accordance with Texas Railroad Commission regulations.
Protection of the Environment

XTOhas taken precautions to protect the environment during the construction and operation of the proposed Geronimo well pad. During the planning phase, environmental scientists from Peloton land Solutions visited the site. Potential waters ofthe U.S.were delineated and the habitats at the site were evaluated for suitability to threatened or endangered species. No potential water's of the U.S. were identified within the pad limits during a delineation conducted by Jacobs in 2008. The pad was located in such a manner as to avoid wetlands and BMPs will be employed to protect it from sedimentation during construction of the well pad. The habitats available on the site are not suitable for use by endangered or threatened species listed for Dallas County. A storm water pollution prevention plan (SW3P) will be prepared for the project and will be used during construction to reduce the potential for sedimentation Mountain Creek Lake, which is located adjacent to the well pad. The SW3P will employ best management practices (BMPs) to stabilize soils and reduce transport of sediment off-site. BMPs will be installed and constructed in accordance with North Central Texas Council of Governments (NCTCOG)Integrated Storm Water Management (iSWM) manual for construction. Conditions
1. USE:The only use authorized by this specific use permit is gas drilling and production. If a gas well is in the drilling, fracturing, production, or reworking phase, an institutional and community service use, recreation use, or residential use {except trailers or mobile homes placed on the site 2. as temporary residents for workers) is not permitted on the Property. SITE/OPERATIONSPLANS:Use and development ofthe Property must comply with the following attached site and operations plans: a. Site plan showing existing/original conditions; b. c. Site/operation Site/operation plan for the drilling phase; and plan for the production phase

3. TIME LIMIT: a. Except as provided in Section 3(b), this specific use permit expires in 20 years from the date of City Council approval, but it is eligible for automatic renewal for additional 10year periods pursuant to Section SlA-4.219 of the Dallas City Code, as amended. For automatic renewal to occur, the Property owner must file a complete application for' automatic renewal with the Director before the expiration of the current period. Failure to timely file a complete application will render thls speclflc use permit ineligible for automatic renewal. b. The Operator shall notify the building official in writing at least 10 days before permanently stopping gas production (abandoning the well). Once the Operator permanently stops production, this specific use permit expires after the Operator restores the Property in accordance with Article XIIofthe Dallas Development Code, as amended. After the Operator restores the Property, a new specific use permit is required for any other gas drilling and production operation. 4. LANDSCAPE/SCREENING: landscaping is proposed for the site. Although the airfield No (formerly NASDallas) has been decommissioned as a naval aviation facility, aircraft still operate out of the airfield, including military aircraft from the Texas Army National Guard. Given the fact that portions of the facility are still used for aviation, City of Dallas landscaping requirements for the well pad should be waived due to the potential for wildlife strikes associated with tree and shrub plantings. Wildlife poses a serious threat to aircraft and it is our position that nothing should be done on/around the well pad that creates an attractant to birds or other wildlife. The well pad area should be maintained free of vegetation to decrease the potential attraction of wildlife to the airfield. A perimeter 8' chain link fence will be built around 5. 6. 7. the site. HEIGHT:Except temporary structures authorized by the building official, no structure may exceed 24 feet in height. If a residential use is located within 600 feet of the Property, the Operator shall begin drilling all of the gas wells approved by this SUP within one year after receiving a gas well permit for the first gas well. See Sections SlA-12.10S(a)(6)

Except as provided in this subsection, fracturing may only occur during daylight hours, seven days a week, except that flowback operations may occur 24 hours a day, seven days a week. See Section 51A-12.107(m)(1} of the Dallas Development Code, as amended ii. Except as provided in this subsection, reworking may occur 24 hours a day, seven days a week. iii. If a residential use is located within 600 feet of the Property, fracturing and reworking may occur no more than 90 days in any 365 day period.

The Operator must make any repairs or improvements, other than fracturing or reworking, between 6:00 a.m. to 9:00 p.rn., Monday through Saturday, except . that emergency repairs may be made at any time.

PERMITS:The building official may not issue a certificate of occupancy for a gas drilling and production use until the Operator obtains all required permits from the Railroad Commission of Texas, Texas Commission on Environmental Quality, and all other state, federal, or city agencies.

SIGNS:Signs must comply with the provisions for non-business zoning districts in Articles VIIof the Dallas Development code, as amended, and gas drilling and production in Article XIIof the Dallas Development Code, as amended. 10. MAINTENANCE: The Property must be properly maintained in a state of good repair and neat

appearance. 11. GENERAL REQUIREMENTS: se of the Property must comply with all federal and state laws and U regulations, and ordinances, rules, and regulations of the City of Dallas, including the gas drilling and production regulations.

Except as provided in Section 3(b), this specific use permit expires in 20 years from the date of City Council approval, but it is eligible for automatic renewal for additional 10year periods pursuant to Section SlA-4.219 of the Dallas City Code, as amended. For automatic renewal to occur, the Property owner must file a complete application for' automatic renewal with the Director before the expiration ofthe current period. Failure to timely file a complete application will render thls-speciflc use permit ineligible for automatic renewal. b. The Operator shall notify the building official in writing at least 10 days before permanently stopping gas production (abandoning the well). Once the Operator permanently stops production, this specific use permit expires after the Operator restores the Property in accordance with Article XIIof the Dallas Development Code, as amended. required for any other gas drilling and production operation. LANDSCAPE/SCREENING: landscaping is proposed for the site. Although the airfield No (formerly NASDallas) has been decommissioned as a naval aviation facility, aircraft still operate out of the airfield, including military aircraft from the Texas Army National Guard. Given the fact that portions of the facility are still used for aviation} City of Dallas landscaping requirements for the well pad should be waived due to the potential for wildlife strikes associated with tree and shrub plantings. Wildlife poses a serious threat to aircraft and it is our position that nothing should be done on/around the well pad that creates an attractant to birds or other wildlife. Dear Sir/Madam, Pursuant to the requirements ofthe City of Dallas' Specific Use Permit guidelines, the following is the land use statement for the proposed drilling activities at the former Naval Air Station. Description of Proposed Activity The well pad will be used for drilling natural gas exploration and production wells. The following paragraphs provide a description of the well pad construction, drilling, completion, and reclamation process. The first step in the construction process will be clearing and grading. After the area is cleared, it will be slightly excavated to account forthe 6-inch layer of crushed rock that will be used to stabilize the pad. Once the pad is compacted and the rock has been placed, the pad will be ready for the drilling rig. At this point the drilling rig, temporary mobile offices, and power system will be moved onto the pad and drilling will commence. A 12.25"surface hole will be drilled and 8.625" surface casing will be set and cemented to the depth prescribed by the Texas Commission on Environmental Quality (TCEQ)to protect usable quality ground water. A 7.875 hole will be drilled to the proposed total depth of the well and 5.5" production casing will be set and cemented to surface.

After the well has been drilled a completion rig will be mobilized to complete the well in the Barnett Shale. The Barnett Shale will be perforated and fracture stimulated to allow gas to enter the production casing and flow to the surface. After a brief initial production period (typically two to four weeks), a com pletion rig may again be em ployed to clean the well bore of frac sand and to run and set production tubing for final production operations. Accessory uses for the proposed gas development include an internal access road, produced water storage tanks, separation facilities, and other uses necessary and customary for gas development. Meters, storage tanks, separation facilities and flow lines are depicted on the operation site plan in the SUP submittal. The well pad will be secured by a 6 feet tall barbed wire fence with a locking device to prevent unauthorized entry. Following drilling of the first well, other wells may be drilled depending on the success of the development and the availability of a local gas market. Wells that are not commercially productive will be plugged at the time of such determination. All producing wells will be plugged at the end of their economic life. All wells will be plugged in accordance with the current applicable Railroad Commission regulations. Vehicular access to the well pad will be off Jefferson Blvd. through a locked gate. The access drive will be constructed with an aUweather road material (i.e., Grade 1 flex base) compacted for a smooth driving surface. Fire Access will be provided in accordance with all local, state and federal requirements. Water used for the drilling and completion phase will be stored in frac tanks on the well pad during fracing operations. Drillingmud utilized during the drilling phase of the well will be stored in steel

circulation pits; fresh water will be stored in steel tanks. At the end of the drilling and completion processes the water and drilling mud will be removed by truck and disposed of at an approved facility pursuant to the requirements of the Railroad Commission of Texas. Produced water from the gas production stream will be stored in a 210 barrel, 8' tall low profile tank on the well pad. The tank will be situatedwithin a secondary lined containment berm capable of holding 150% of the tank volume. The tank will also be equipped with a sensing device that will close in the well should the tank become full. The produced water will be removed periodically by a commercial operator and disposed of in an approved facility in accordance with requirements ofthe Railroad Commission of Texas. Although the well pad is above the lOO-year floodplain, the tank(s) will be located on the east side of the pad, as far as possible from Mountain Creek and its floodplain and the storage tank{s) will be flood-proofed. Any surface disturbance not necessary for production operations will be reclaimed to original contours and reseeded. Atthe end of the wells' usable life, the well(s) will be plugged and the site reclaimed in" accordance with Texas Railroad Commission regulations. Protection of the Environment XTO has taken precautions to protect the environment during the construction and operation of the proposed Geronimo well pad. During the planning phase, environmental scientists from Peloton Land Solutions visited the site. Potential waters of the U.S. were delineated and the habitats at the site were evaluated for suitability to threatened or endangered species .. No potential waters of the U.S. were identified within the pad limits during a delineation conducted by Jacobs in 2008. The pad was located in such a manner as to avoid wetlands and BMPs will be employed to protect it from sedimentation during construction of the well pad. The habitats available on the site are not suitable for use by endangered or threatened species listed for Dallas County. A storm water pollution prevention plan (SW3P) will be prepared for the project and will be used during construction to reduce the potential for sedimentation Mountain Creek Lake, which is located adjacent to the well pad. The SW3P will employ best management practices (BMPs) to stabilize soils and reduce transport of sediment off-site. BMPs will be installed and constructed in accordance with North Central Texas Council of Governments (NCTCOG)Integrated Storm Water Management (iSWM) manual for construction. XTOGeronimo Land Use Statement

Dear Sir/Madam, Pursuant to the requirements of the City of Dallas' Specific Use Permit guidelines, the following is the land use statement for the proposed drilling activities at the former Naval Air Station. Description of Proposed Activity The well pad will be used for drilling natural gas exploration and productlon wells. The following paragraphs provide a descriptionofthe well pad construction, drilling, completion, and reclamation process. The first step in the construction process will be clearing and grading. After the area is cleared, it will be slightly excavated to account for the 6-inch layer of crushed rock that will be used to stabilize the pad. Once the pad is compacted and the rock has been placed, the pad will be ready for the drilling rig. At this point the drilling rig}temporary mobile offices, and power system will be moved onto the pad and drilling will commence. A 12.25"surface hole will be drilled and 8.625'} surface casing will be set and cemented to the depth prescribed by the Texas Commission on Environmental Quality (TCEQ)to protect usable quality ground water. A 7.875" hole will be drilled to the proposed total depth of the well and 5.5" production casing will be set and cemented to surface. After the well has been drilled a completion rig will be mobilized to complete the well in the Barnett Shale. The Barnett Shale will be perforated and fracture stimulated to allow gas to enter the production casing and flow to the surface. After a brief initial production period (typically two to four weeks), a completion rig may again be employed to clean the well bore offrac sand and to run and set production tubing for final production operations. Accessory uses for the proposed gas development include an internal access road, produced water storage tanks, separation facilities, and other uses necessary and customary for gas development. Meters, storage tanks, separation facilities and flow lines are depicted on the operation site plan in the SUP submittal. The well pad will be secured by a 6 feet tall barbed wire fence with a locking device to prevent unauthorized entry. Following drilling of the first well, other wells may be drilled depending on the success of the development and the availability of a local gas market. Wells that are not commercially productive will be plugged at the time of such determination. All producing wells will be plugged at the end of their economic life. Allwells will be plugged in accordance with the current applicable Railroad Commission regulations. . Vehicular access to the well pad will be off Jefferson Blvd. through a locked gate. The access drive will be constructed with an all weather road material (i.e., Grade 1 flex base) compacted for a smooth driving surface. Fire Access will be provided in accordance with all local, state and federal requirements. Water used for the drilling and completion phase will be stored in frac tanks on the well pad during fracing operations. Drilling mud utilized during the drilling phase of the well will be stored in steel

circulation pits; fresh water will be stored in steel tanks. At the end of the drilling and completion processes the water and drilling mud will be removed by truck and disposed of at an approved facility pursuant to the requirements of the Railroad Commission of Texas. Produced water from the gas production stream will be stored in a 210 barrel, 8' tall low profile tank on the well pad. The tank will be situated within a secondary lined containment berm capable of holding 150% of the tank volume. The tank will also be equipped with a sensing device that will close in the well should the tank become full. The produced water will be removed periodically by a commercial operator and disposed of in an approved facility in accordance with requirements ofthe Railroad Commission of Texas. Although the well pad is above the lOO-year floodplain, the tank(s) will be located on the east side of the pad, as far as possible from Mountain Creek and its floodplain and the storage tank(s) will be flood-proofed. Any surface disturbance not necessary for production operations will be reclaimed to original contours and reseeded. At the end of the wells' usable life, the well(s) will be plugged and the site reclaimed in accordance with Texas Railroad Commission regulations. Protection of the Environment XTO has taken precautions to protect the environment during the construction and operation of the proposed Geronimo well pad. During the planning phase, environmental scientists from Peloton Land Solutions visited the site. Potential waters of the U.S. were delineated and the habitats at the site were evaluated for suitability to threatened or endangered species. No potential waters of the U.S. were identified within the pad limits during a delineation conducted by Jacobs in 2008. The pad was located in such a manner as to avoid wetlands and BMPs will be employed to protect it from sedimentation during construction of the well pad. The habitats available on the site are not suitable for use by endangered or threatened species listed for Dallas County. A storm water pollution prevention plan (SW3P) will be prepared for the project and will be used during construction to reduce the potential for sedimentation Mountain Creek Lake, which is located adjacent to the well pad. The SW3P will employ best management practices (BMPs) to stabilize soils and reduce transport of sediment off-site. BMPs will be installed and constructed in accordance with North Central Texas Council of Governments (NCfCOG) Integrated Storm Water Management (iSWM) manual for construction.
