2010, the city government of Baybay, represented by Mayor Cari, purchased office supplies, drugs and medicines amounting to P7,391,009.31 without the requisite public bidding as required by the Government Procurement Reform Act or R.A. 9184. Instead, according to the three complainants, the alternative method of shopping was resorted to even though the exacting requirements therefore were not met. Attached in support of their complaint is the 2010 Annual Audit report of COA regional office 8 stating that; 2. Non Conduct of public bidding for

The Social Security System (SSS) has disbursed a total of P9.88 billion for December and 13th month pensions for about 1.6 million SSS pensioners, who were granted double the amount of their regular pensions this month to make their yearend holiday celebrations more meaningful. This was disclosed by SSS President and Chief Executive Officer Emilio de Quiros, Jr., who said a total of P9.81 billion were credited to the savings accounts of 1.63 million pensioners, while P63.60 million more in pension checks were sent to 12,062 pensioners through mail. We d i s b u r s e d a n additional P210.84 million to 54,782 pensioners who benefited from our Special Pension Run on November 20, so that they too can receive their December and 13th month pensions in time for the Christmas season, he said. sign the commitment form that the department will require will not be awarded contracts. Such move is a clear indication that only future projects are being targeted for anti-corruption eorts. The commitment is expected to ensure that private contractors will become partners with government in the campaign against graft and corruption. People who are the end-users of government projects are the victims of government infrastructures that are substandard. There are a lot of government projects that are defective and the private contractors of those projects must be held answerable. Yet, the focus of the campaign is only for future projects. And all that is required is for the private contractor to sign the commitment, never mind if the contractor had been involved in anomalous and defective projects that have visible and huge cracks..
ommitting to rid government projects from graft and corruption is a step in the right direction. The plan of the public works and highways department to draw commitments from major stakeholders of government projects is laudable. It is a move that is long overdue but had only been given impetus under the present administration in line with the Daang Matuwid advocacy of President Noynoy Aquino. The plan reportedly aims to change public perception of an agency that is vulnerable to fraud. Private contractors will be made to sign an integrity pledge. Those who will not sign the commitment will not be awarded contracts according to the news report that landed as banner story in yesterdays issue of this paper. That would oblige contractors to be mindful of their responsibility to the people whose taxes are used to defray government projects. But the anti-corruption campaign being planned seems to target future projects. The statement that private contractors who will not

Conceptions misconceptions
Last series gitimate option. Aside from artificial contraceptives that had been found to be abortive, the floodgate had been opened to abortion if the couple finds the number, spacing and timing of a child to be wrong at a time when that child had already been conceived. While the aim of the legislation is for couples to regulate the number, spacing and timing of children by means that prevent conception, the danger is when conception had already taken place when the couple realizes that it is a wrong number, spacing or timing for that child to be born. The couple can opt to abort the conception and government is very much willing to support the couple by providing post-abortion procedures. The recognition by the legislative measure that abortion is a criminal offense is a futile provision for it is tough to nab an induced and intentional abortion, it being a felony that can be committed in the secret confines of the couple who decided to resort to such act just to exercise that right of deciding the number, spacing and timing of children. Such conception that conception can be rightfully intervened by the couple with the support of government is a fatal misconception. Comments to alellema@ yahoo.com
The proposed legislation that is House Bill 4244 prescribes a way for parents to adequately respond to the needs and aspirations of the family and children and that is by responsibly and freely exercising their reproductive health rights. This prescription is offtangent to what is being required of parents in the very context of responsible parenthood. The basic requirement for responsible parenthood as defined by the same legislative measure is the will, ability and commitment of parents to adequately respond to the needs of the family and children. Verily, parents have that innate trait of having the will, ability and commitment to respond to the needs of the family and the children. If such needs are not met, it surely is due to other factors, chief of them the social inequities that deprive parents from earning just income to support the family. With the prescribed solution of responsibly and freely exercising their reproductive health rights, the legislation intends to sustain the unjust and inequitable social order by leaving parents under prevailing conditions where they fail to meet the needs of the family and children. Instead of government aiming to raise the earning capacity of parents and increase economic opportunities, it sets its focus on reducing the number of children on the assumption that conception is an added burden to parents and to society. Rather than provide access to gainful employment so that parents can respond to the needs of the family, the legislation aims to destroy the natural order where couples are capacitated to procreate and support their offspring given adequate opportunities to
harness their ability to earn a living for their family and children. The same legislative proposal defined Reproductive Health Rights as the rights of couples, individuals and women to decide freely and responsibly whether or not to have children; to determine the number, spacing and timing of their children; to make decisions concerning reproduction free of discrimination, coercion and violence; to have relevant information; and to attain the highest condition of sexual and reproductive health. This defines the ultimate goal of the legislative measure, which is primarily the curbing of population by way of contraception, granting couples the right to determine the number, spacing and timing of their children. It is this grant of freedom and authority to couples to determine the number, spacing and timing of their children that paves the way to abortion as a le-
busy in their political career that they neglect to consider in their program the natures rehabilitation. Instead, they focus their need to increase taxes for infrastructure projects keeping their attention away from the urgent need of countering natures destruction brought by unscrupulous businesspersons. If our leaders cannot perform the mandate of the people to protect nature we concerned citizens should be the ones to act. We have the right and authority to do it for the sake of the unborn babies. The Rules of Procedure for Environmental Cases promulgated by the Supreme Court on April 13, 2010, provides: Section 5. Citizen suit. Any Filipino citizen in representation of others, including minors or generations yet unborn, may file an action to enforce rights or obligations under environmental laws. ... Citizen suits filed under R.A. No. 8749 and R.A. No. 9003 shall be governed by their respective provisions. Is it only for violation of the forestry and mining laws? No. It also included other violations of environmental laws. To name a few, they are: Sanitation Code; Marine Pollution Decree; Water Code; Plant Quarantine Law; Prohibition Against the Cutting, Destroying or Injuring of Planted or Growing Trees, Flowering Plants and Shrubs or Plants of Scenic Value along Public Roads, in Plazas, Parks, School Premises or in any Other Public Ground; Toxic Substances and Hazardous Waste Act; Peoples Small-Scale Mining Act; Philippine Mining Act; Indigenous Peoples Rights Act; Philippine Fisheries Code; Clean Air Act; Ecological Solid Waste Management Act; National Caves and Cave Resource Management Act; Wildlife Conservation and Protection Act; Chainsaw Act; Clean Water Act; Oil Spill Compensation Act of 2007; and other existing laws that relate to the conservation, development, preservation, protection and utilization of the environment and natural resources. Those are some of the laws to protect nature; which any citizen can file a case against violators. A citizen should not worry regarding payment of filing and legal fees because Section 12 thereof provide, that: For a citizen suit, the court shall defer the payment of filing and other legal fees that
on how to prepare a complaint. The complainant will need a conscientious member of the Public Attorneys Office or member of the free counsel group. At this point a citizen may encounter difficulty because some members of the Public Attorneys Office denies to subscribe affidavits prepared by other person. I have already encountered such incident. I prepared the counter-affidavit of an accused who could not afford to pay a lawyer. However, when it was brought to the Public Attorneys Office here in Ormoc City, it was refused to be subscribed. It is good Atty. Demosthenes Fiel Tugonon, a city councilor, who has a notarial commission did the notarization of the affidavit for free. I hope there will be more lawyers like Tugonon who has a heart of a true lawyer. Likewise, I hope there will be more citizens who will be vigilant to file cases against the unscrupulous businesspersons who want to rape mother earth. (Feedback welcome, g_ duna@yahoo.com)

Friday of the 2nd Week of Advent Is 48:17-19, Ps 1, Mt. 11:16-19
JESUS LAMENTS
Jesus said to the crowds, To what shall I compare this generation? It is like children who sit in marketplaces and call to one another, We played the flute for you, but you did not dance, we sang a dirge but you did not mourn. For John came neither eating nor drinking, and they said, He is possessed by a demon. The Son of Man came eating and drinking and they said, Look, he is a glutton and a drunkard, a friend of tax collectors and sinners. But wisdom is vindicated by her works.
COOPERATION
Jesus came as our Redeemer to do a great service for us, something that we could not do for ourselves. He offered us a gift that we could never hope to acquire otherwise. Yet the people complained about the gift and complained about Jesus, the Giver. Jesus did not force his gift on us. He instead expected our cooperation, but we continued to be more interested in ourselves. God still sends graces not only directly through the sacraments and by the inspiration of the Holy Spirit, but also through other people. They are the agents of Gods Will for us. Like Jesus, they expect our cooperation because they are going to do something good for us. Do I accept these generous people and the good that they do for me by Gods grace? Do I tend to be critical of the way that they act instead of appreciating the good that they intend to do? Am I patient with others who are critical of the good that I try to do for them? God, our Father, you guide everything in wisdom and love. Accept the prayers we offer for our nation; by the wisdom of our leaders and integrity of our citizens, may harmony and justice be secured and may there be lasting prosperity and peace. Almighty and eternal God, You know the longings of our hearts and You protect our rights. In your goodness, watch over those in authority, so that people everywhere may enjoy freedom, security and peace. We ask this through our Lord Jesus Christ, your Son, who lives and reigns with you and the Holy Spirit, one God, forever and ever. Amen. (Courtesy of Daughters of St. Paul)

Upgrading road project in Samar, E. Samar will cut 7,739 trees DENR reports
TACLOBAN CITY The $214.44 million United States-funded road upgrading project in Samar and Eastern Samar will cut 7,739 trees planted along roadsides, the Department of Environment and Natural Resources (DENR) reported. DENR Regional Executive Director Manolito Ragub said that for two contract packages (CP) alone, they need P6.15 million as replacement cost that will be affected by the 222-kilometer road rehabilitation project. We will enforce the rule that in every tree cut, it should be replaced with 100 seedlings, which will be planted in different parts of Samar Island, Ragub said. With the 7,739 trees that will be cut, the DENR requires a 773,900 replacement. The department will still determine the cost required in two other CPs that are still under bidding process. The P6.15 million from the Department of Public Works and Highways (DPWH) fund for road right of way, will cover compensations for CP1 with 236 affected trees and a funding requirement of P641,481 and 2,029 trees for CP3 with replacement cost of P5.51 million. Signing of memorandum of agreement is tentatively scheduled next week between DENR, Millennium Challenge AccountPhilippines (MCA-P), and (DPWH). The road project covers 15 towns in Samar and Eastern Samar traversing 134 villages with 23 kilometers crossing the Samar Island Natural Park (SINP), a 458,700 hectares area, which hosts a total of 974 species of plant diversity. Only few of trees along roadsides are naturally grown. Most of the trees were grown through tree planting activities. The natural forest cover will still be intact, Ragub said. Other than trees, the MCA-P disclosed that a total of 9,169 structures will be removed by the entire project. The most common obstructions are fences, houses, stores, public waiting sheds, water faucets, ramps, benches, garages, balconies, doors, driveways and pathways. The project will keep the road right-of-way at not less than 20 meters as specified by Executive Order No. 621. The upgraded road will have a road shoulder of 1.5 meters on both sides. (SARWELL Q.

NEWS Pro-RH lawmakers win in nominal VM Cari... procurement of vote; House passes RH bill and materials.
Im not against life. Im against ignorance, Diwa party-list Representative Emmeline Aglipay, for her part, said. House Deputy Speaker Pablo Garcia, a staunch critic of the bill, said the RH bill seeks to prevent and frustrate the Lord from giving life through the use of contraceptives to be provided under the proposed law. Garcias son, Cebu Representative Pablo John, and other lawmakers from Cebu also voted to junk the RH bill. In voting NO, I run the risk of being called anti-women by those who are quick to do so. I would rather take that risk than to use the name of women to push an agenda that is, for all we know, so foreign to and far removed from the real interests of women, the young Garcia said. Sarangani Representative Manny Pacquiao also voted against the RH bill. What happened in Vegas strengthened my already firm belief of the sanctity of life, Pacquiao said referring to his knockout loss against Mexican boxer Juan Manuel Marquez over the weekend. Before the vote, the chamber breezed through the proposed amendments compared to last week wherein only the first four pages of the substitute bill were tackled. Lagman rejected the proposed amendment of Cagayan de Oro Representative Rufus Rodriguez deleting an entire section on mandatory sex education. Rodriguez then proposed that sex education be taught to senior high school students aged 16 to 17 years old instead of Grade 6 pupils. Lagman rejected the same. The period of amendthe suspect who is currently detained at the Villaba PNP lock-up cell. While the illegal drugs situation in the region is not alarming, it needs close monitoring due to geographical and economic factors, the regional director averred. He explained that geographically, Eastern Visayas has wide coastal areas with several ports and terminals that could serve as the entrance and exit points of illegal drugs. On the otherhand, EVs reputation as one of the fastest growing regions attracts both legitimate and illegitimate businesses. ments was terminated at 7:43 p.m., almost three hours after discussion on the RH bill resumed. The roll of members was called thereafter. Out of the 287 lawmakers, 217 members responded to the call and quorum was declared. Rodriguez earlier claimed that at least 140 lawmakers will vote against the RH bill and only 90 of their colleagues will vote in favor of it. The House leadership said by Monday next week the RH bill will be put to a vote on third and final reading, which is a significant step for a measure that has been in Congress for 13 years. Congress has only three session days before it goes on a Christmas break. Earlier, Antipolo Bishop Gabriel Reyes, chairman of the Catholic Bishops Conference of the Philippines-Episcopal Commission on Family and Life (CBCP-ECFL), presided over a mass at the St. Peters Chapel, which was just five minutes away from the Batasan Complex. Also present are Bishops Teodoro Bacani, Broderick Pabillo, Jesse Mercado, and Romulo dela Cruz. Plenary debates on the RH bill started March of last year but it was only on last week that individual amendments to the measure were discussed, after President Benigno Aquino III appealed to members of the House of Representatives to put the RH bill to a vote. During the lunch meeting, Aquino made it clear that he is in favor of the proposed RH law. The RH bill was also included in the priority measures of the LegislativeExecutive Development Advisory Council. (SUNNEX)

MANILA - The House of Representatives approved on Thursday the Reproductive Health (RH) measure or House Bill 4244 on second reading with a vote of 113-104-3 -a first since the controversial measure was filed more than a decade ago. With 113 votes on affirmative, 104 negative and three abstention, RH bill now moves to third and final reading next week. Presiding speaker Lorenzo Taada III earlier ruled that the ayes (yes votes) have it over the nays (no votes) by viva voce or voice votes but to confirm the votes, lawmakers had to vote through nominal voting or one by one upon the motion of Navotas Representative Tobias Tiangco. The nominal voting, wherein each lawmaker would explain his or her vote, started at exactly 8:15 p.m. After more than five hours, the pro-RH side won by a very slim margin. Albay Representative Edcel Lagman, the main proponent of the RH bill, defended the measure, saying it can provide sustainable human development. The linkage between human development and population is too close and related to be ignored. Although this is not a population control measure, it pursues a sound population policy that addresses the population issue because sustainable human development can never be achieved without solving the population problem, Lagman said. Iloilo Representative Janette Garin, a co-author of the measure, said the RH bill is not about religion neither it is about population control. This is pure and simple responsible legislation, she said.
Procurement of office supplies, drugs and medicines amounting to P7,391.009.31 in calendar year 2010 were not done thru public bidding instead shopping was resorted to even if the conditions were not met, contrary to Sections 10 and 52 of RA 9184, thus, there was no assurance that the lowest costs/volume discounts were not obtained that would have redound to the benefit of the Municipality. The COA Audit report further states that; Procurement of supply, materials and property of LGU Baybay was not made in accordance with the Annual Procurement Program for the Calendar Year 2010 but rather acquisition of such were undertaken on a case to case basis emanating from the fourteen (14) offices of the LGU. Scrutiny of the accounting records revealed that a total of P7,391, 009.31 were procured through shopping as the mode of procurement. These supplies and materials were office supplies, drugs and medicines and not one of
of office supplies, dugs and medicines amounting to P7,391,009.31 were made by both Mayor Carmen Cari and Vice Mayor Michael Cari in calendar year 2010, on separate dates and occasions, falling under their corresponding terms. In previous interview with Mayor Carmen Cari, she said that any government unit can not buy that big amount of supplies and medicines without a bidding because this is government, saying further that they have all the documents that will disprove the three complainants allegation- and she is ready to face them at the Ombudsman. To get vice mayor Caris side of the story, at 11:35 a.m, (December 10) this writer called up the vice mayors office but his staff informed that the vice mayor is still at his residence. This writer then called up his residence at 11:38 a.m. but was informed by a lady that I had to call back after 15 minutes, as the vice mayor was still in the shower roomand instructed to call back again after 10 minutes. are in close coordination with the Department of the Interior and Local Government (DILG) how these hindrances could be addressed. Their office does not provide any financial assistance to LGUs except giving in technical assistance like design of the landfill. Aguinaldo said that she is happy that the city of Ormoc has now an existing and operational sanitary landfill where its daily wastes could now be disposed properly. She said that open dump sites are now discouraged considering that wastes are not disposed properly and could clutter in the streets. Open dumps are very unsanitary; it has no linings that would make leachates sip into our aquifer. Also, it contributes to global warming because of the methane generated by the wastes, Aguinaldo said. Meantime, Mayor Codilla said that he is happy that after so many years, Ormoc has now its own sanitary landfill. The 1.8 has. sanitary landfill was constructed back in January,2010 and was finished just last month. He also said that he is open to the idea to allow nearby towns to dump their wastes at their sanitary landfill. Yes, we could perhaps for a fee, Codilla said, adding clustering of areas that will use a sanitary landfill is also being encouraged due to its prohibitive amount in constructing it. (JOEY A.

environmental protection, Emelita Aguinaldo, secretariat executive of the NSWMC, said on Wednesday. Based on their records, out of the 1,719 local government units in the country(comprising of provinces, cities and municipalities) only 45 of them have existing sanitary landfills. In Eastern Visayas, only two have their own landfills, namely, Calbayog City which opened last July of this year with an area of 4.9 hectares at a cost of around P80 million and Ormoc City which opened on Wednesday and graced by Aguinaldo, among other visitors. Eastern Visayas regional center, Tacloban, has yet to come up with its own sanitary landfill though it has already prepared the necessary documents like program of work and applied for an environmental clearance certificate(ECC). It has identified Barangay Santo Nino, more than 13 kms away from the center, and is projected to cost around P75 million with an area of 1.5 has. PRO8 arrests 169 drug offenders, seized 21M worth of illegal drugs
C A M P R U P E RT O KANGLEON, Palo, Leyte The intensified crackdown by the Philippine National Police against the proliferation of illegal drugs in Eastern Visayas has netted a good number of drug suspects and a seizure of a significant amount of illegal drugs as the Police Regional Office 8 (PRO8) vowed to make the area free from the drug menace. The campaign against illegal drugs remains to be one of our top priority as we want to make Eastern Visayas illegal drugs-free, Police Chief Superintendent Elmer Soria, Eastern Visayas regional director said. Soria informed that from January 1 to November 30 this year, intensified antiillegal drugs operations conducted by the AntiIllegal Drugs Special Operations Task Group (AIDSOTG) of PRO8 resulted in the confiscation of P21,024,242.90 worth of illegal drugs in 152 antidrug operations across the region. The confiscated illegal drugs includes 4 bricks of cocaine; 74.646 grams of methamphetamine hydrochloride or shabu; 286 uprooted marijuana plants, 13 marijuana sticks, 1,599.638 grams of dried marijuana leaves, 10 marijuana teabags and 1.13 grams marijuana seeds, the police official disclosed. Soria added that a total of 169 violators of RA 9165 or the Comprehensive Dangerous Drugs Act of 2002 were rounded-up by the police in drug buybust operations, raids and searches, and marijuana eradication operations, resulting in the filing of 150 drug charges in different courts regionwide. This developed as AIDSOTG operatives arrested another suspected drug pusher Monday morning in a buy-bust operation in Villaba town in Leyte. Soria identified the
