THE 2012 REVISED CONSTITUTION OF THE NEGROS OCCIDENTAL CONFEDERATION JUNIOR PHILIPPINE INSTITUTE OF ACCOUNTANTS

PREAMBLE We, the Members of the Negros Occidental Confederation of Junior Philippine Institute of Accountants, in recognizance of our duty to promote unity amidst individuality and the need for a provincial and local organization to serve as a medium of expression of our ideals and aspirations, to promote and protect the welfare and interest of accounting students from each chapter, bind ourselves to assert a dynamic responsible student leadership, to attain a high degree of moral, social and intellectual growth, to engender a community of respect and sympathy, to foster the excellence and zealousness of the nations future accountants, to incite sensitivity for the needs of our industry, and our immediate community, our nation; and secure for ourselves and future members the protection of our rights, privileges, and resources, do ordain and promulgate this constitution and by-laws.

ARTICLE I- NAME, JURISDICTION AND DOMICILE Section 1. The Confederation shall be known as the NEGROS OCCIDENTAL CONFEDERATION OF JUNIOR PHILIPPINE INSTITUTE OF ACCOUNTANTS, herein referred to as NECONFED-JPIA. Section 2. The NECONFED-JPIA comprises all bona fide members of each JPIA chapter of the member schools comprising NECONFED-JPIA namely: Binalbagan Catholic College, Central Philippine Adventist College, Colegio de San Agustin - Bacolod, University of Negros Occidental - Recoletos, University of St. La Salle, West Negros University and Carlos Hilado Memorial State College. Section 3. The governing body of this Organization shall be the NECONFED EXECUTIVE COMMITTEE, hereinafter referred to as NECONFED EXECOM. Section 4. The NECONFED EXECOM shall have jurisdiction over all bona fide members of NECONFED-JPIA. Section 5. The domicile and principal office of this confederation shall be at PICPA House, Negros Occidental Chapter, Singcang, Bacolod City.

ARTICLE II- PURPOSES AND OBJECTIVES Section 1. To adopt such measures as may be necessary to foster educational advancement in the field of accounting. Section 2. To serve as a means of gradually exposing students in each chapter to actual practice in accounting and business life. Section 3. To develop civic consciousness and discipline among chapter members.

Section 4. To acquaint the chapter members with the nature and activities of the Philippine Institute of Certified Public Accountants. Section 5. To promote fellowship and brotherhood among chapter members. Section 6. To upgrade the quality and standard of instruction in each chapter unit.

ARTICLE III - STATEMENT OF PRINCIPLES AND POLICIES Section 1. Membership is sovereign and all authority of NECONFED EXECOM emanates from them. Section 2. The NECONFED EXECOM has the primary duty of serving its constituents and protecting their rights as members of NECONFED-JPIA. Section 3. The NECONFED EXECOM renounces violence in cognizance of its objectives. Likewise, NECONFED EXECOM renounces the development of subdivisions inconsistent with the spirit and zeal through which this Organization is established. Section 4. The NECONFED EXECOM maintains and emphasizes honesty, excellence, and objectivity in the performance of its duties. Section 5. The NECONFED EXECOM recognizes that all members are equal and shall work in cooperation with all members in the development of its policies and activities and the welfare of the members. Section 6. The NECONFED EXECOM duly adheres to the high standards and integrity of the Accounting profession and thus pronounce such in the execution of its duties. Section 7. The NECONFED EXECOM recognizes NECONFED-JPIA as a Filipino institution and shall thereby promote nationalism and Filipino ideals and identity. Section 8. NECONFED-JPIA is a secular organization and shall not compromise and prioritize one belief system over another. Policies Section 9. The NECONFED EXECOM shall guarantee the respect of personality and equality of the members composing NECONFED JPIA. Section 10. The NECONFED EXECOM shall ensure honesty and integrity in the execution of its duties.

Section 11. The NECONFED EXECOM shall take all necessary measures to secure for its members excellence in leadership and management. Section 12. The NECONFED EXECOM shall guarantee equal access to the opportunities and resources offered by NECONFED JPIA. Section 13. The NECONFED EXECOM shall practice independence in its exercise of executive duties, provided, such are not contrary to the fundamental principles over which NECONFED is established.

ARTICLE IV MEMBERSHIP Section 1. The membership of this confederation shall include all recognized bona fide Junior and Senior JPIA members of each chapter under the NECONFED. Section 2. The tenure of membership in this confederation shall be a period of one (1) year renewable every year.

ARTICLE V - RIGHTS AND DURIES OF CHAPTER MEMBERS Section 1. Every member shall enjoy the rights and privileges granted by this Constitution. The chapter members of this confederation shall have the following rights and privileges:
a) The right to exercise free speech, religious belief, political affiliation, and advocacies, provided, such exercise is not contrary to the Confederations policies. b) The right to suffrage. c) The right to be informed of any project or/and activity of the confederation and to participate in such undertaking.

d) The right to representation in policy-making and formulation of activities.


e) The right to vote, to be elected and/or appointed to any official position.

Section 2. The chapter members of the confederation shall have the following duties and obligation:
a) The duty to comply with the provisions of this constitution and other rules that may be promulgated or agreed upon by the confederation. b) The duty to pay the membership fee designated by NECONFED EXECOM for each chapter members. c) The duty to attend assemblies, meetings, and events where ones participation is requested and necessary. d) The duty to cast his vote, provided that such member is qualified, in the particular election being conducted. e) The duty to comply with any other lawful requirements set by the confederation.

ARTICLE VI THE GOVERNMENT BODIES Section 1. The governing bodies of this confederation shall be:
a) The assembly of each chapter unit. b) The Board of Directors

ARTICLE VII THE BOARD OF DIRECTORS Section 1. The subject of this constitution, the confederation shall be managed by the Board of Directors which shall be composed of at least two (2) representatives in each chapter unit, all whom are Board of Directors of such chapter. Section 2. The Board of Directors shall have the power to elect the officers of the confederation: the President, the Vice Presidents, who shall serve as Chairman and Vice Chairman respectively. Section 3. The Board of Directors shall meet within one month, immediately following the annual election, who shall continue to hold meetings regularly, however, special sessions may be called by the President or two-thirds (2/3) of the members of the Board of Directors. Section 4. In case of vacancy due to resignation of any other cause of any of the Board of Directors of such chapter, the Board of Directors is empowered and authorized to designate from among qualified members of the board, until the successor of such has been elected and qualified. Section 5. The general management of the affairs and properties of the federation shall be vested upon on the Board of Directors.

ARTICLE VIII THE EXECUTIVE OFFICERS Section 1. The confederation shall have at least the following officers: a) The President b) Vice President for Academics c) Vice President for Non-Academics d) Vice President for Membership e) Vice President for Finance f) Vice President for Communications g) Vice President for Planning and Logistics h) Auditor i) Secretary General j) Fund Raising Chairperson Section 2. Term of Office of Officers All officers of the association shall hold office for one year and until their successors are duly elected and qualified.

ARTICLE IX QUALIFICATION OF THE EXECUTIVE OFFICERS Section 1. General guidelines are as follows: a.) Must be a bona fide member of NECONFEDJPIA. b.) Participated in at least one (1) activity of NECONFEDJPIA c.) Must not be an officer of the local chapter or any organization holding major position/s inside or outside the school. d.) Must have a General Weighted Average (GWA) of at least 85% in previous semester. e.) Must not have any failing grades in any subject in all semester. f.) The candidate must not be involved in any criminal case brought upon by any competent course of jurisdiction. g.) Must be officially enrolled in any NECONFEDJPIA member school during the current year. Section 2. The President
a) He/She shall be a Senior student of the Board of Directors. b) He/She shall be the Chief Executive of the confederation whose duty to supervise the affairs. c) He/She shall preside over all then meetings of the Board of Directors. d) He/She shall lead the Chapters Board of Directors in carrying the activities to attain the purposes and objectives of the confederation. e) He/She shall perform such other duties and powers inherent to the office of the President.

Section 3. The Vice Presidents


a) He/She shall be a Senior student of the Board of Directors. b) He/She shall be responsible for the promulgation of the constitution and by-laws or to amend ant change within it, provided such amendments shall be ratified first by the president during the meeting of the Board of Directors. c) He/She shall be the coordinator of all activities of the confederation and shall see to it that all activities of the confederation do not conflict with the important of each chapter unit which may be impaired by the success of these functions. d) He/She shall perform such other duties and functions which may be assigned to by the president. e) He/She shall perform such other duties and functions in the absence of the president.

Section 4. The Vice President for Finance


a) He/She shall be a Senior student of the Board of Directors. b) He/She shall be the official custodian of the funds and expenditures of the confederation and be his/her primary duty to keep all funds with the bank chosen by the Board of Directors. c) He/She shall be responsible for a prompt collection of all fees and contributions from each chapter units. d) He/She shall receive and disburse funds for and in behalf of the confederation as authorized by the President; provided, however, that all disbursements shall be supported by the petty cash vouchers or original receipts or other supporting documents which shall be kept as part of these records.

Section 5. Vice President for Communications


a) They shall be responsible for the press releases, disseminations, invitations, posters and other reading matters of information pertinent to the confederation to all chapter members and other persons important in carrying the functions of the confederation. b) They shall act as liaison officers of the confederation. c) They shall be responsible for the proper acknowledgement of letters of appreciation and other matters of communication which are outside the duties of other officers, provided, the above mentioned information and communication shall first be noted by the President.

Section 6. Vice President for Planning and Logistics


a) He/She shall be a Senior student of the Board of Directors. b) He/She shall assist the President or other executive officers in the transaction of the confederation. c) He/ She shall perform such other duties and functions which may be assigned by the President of the Board of Directors.

Section 7. The Auditor


a) He/She shall be a Senior student of the Board of Directors. b) He/She shall audit the financial reports and other financial documents of the Treasurer promptly to insure effective administration of the assets and resources. c) He/ She shall examine and verify the Treasurers reports and shall certify it correctness before submission to the Board of Directors.

Section 8. The Secretary General


a) He/She shall be a Senior student of the Board of Directors. b) He/She shall keep the records of the confederation intact. c) He/She shall keep the record of the minutes of the meeting of the confederation. d) He/She shall maintain and update roster of membership of each chapter and shall submit this ti the National Federation of Junior Philippine Institute of Accountants thru PICPA Chairman on Committee on Education and Students Participation, Negros Occidental Chapter.

ARTICLE X ELECTION Section 1. The election of the Executive Officers of the Board of Directors of the confederation on a date, time, manner, and place as specified by the Committee on Election, one week after the election of the Bacolod Federation (BACFED). Section 2.
a) The Committee on Election shall be composed of TWO (2) Faculty Advisers, one from the north and one from the south, assigned by the chairman of the PICPA Students Participation Committee. b) The Chairman of the PICPA Students Participation Committee shall take charge of the preparation for the election of the members of the confederation.

Section 3. The manner of election shall be in Secret Balloting.

Section 4. The Committee on Election shall count the votes cast and proclaim the duty elected members of the board. Section 5. The decision of the Committee on Election shall be final, executory and binding upon all.

ARTICLE XI CONFEDERATIONS FUND AND EXPENDITURES Section 1. All collections shall be deposited at the Philippine National Bank, 10th Street Lacson, Bacolod City, by the confederation Treasurer as chosen by the Board of Directors. Section 2. Withdrawals from the bank shall be under signatories of the confederation President and the Vice President for Finance. The account name of the Passbook shall be referred to as NECONFED. Section 3. The Bankbook shall be in custody of the confederation Vice President for Finance. However, before the end of the Second Semester, the confederation VP Finance may turn over the bankbook to the PICPA Students Participation Chairman.

ARTICLE XII QUORUM Section 1. Fifty percent (50%) of the Board of Directors or at least two-thirds (2/3) of the Chapter represented or all the chapter being represented whom are Board of Directors of such chapter.

ARTICLE XIII EXPULSION OF BOARD OF DIRECTORS Section 1. Any officer of this confederation shall be removed from the office by impeachment for any gross violation of this constitution and by-laws, internal rules of this confederation as well as the rules and regulations promulgated by the Board of Directors. Section 2. The Board of Directors sitting en bane, by three-fourths votes, excluding the officer in question shall have the sole power of impeachment.

ARTICLE XIV AMENDMENTS Section 1. The Board of Directors sitting en banc, by majority votes may propose any amendments to or revision of this constitution. Section 2. Any amendment to or revision of this constitution shall be valid when ratified by a majority of the Board of Directors in a special meeting called for; the purpose the time, date, the place, and the manner of which shall be fixed by the Board of Directors.

This revised NECONFED Constitution shall be deemed final on 12 midnight of December 31, 2012 after publication of this draft online and after due consideration of the concerns of any member of NECONFED EXECOM, NECONFED CONCOM, or any of the bone fide members of the Confederation. The Constitution shall take effect upon January 5, 2013. The Constitutional Commission
