Guest Agreement
This agreement is between you, a Licensee of the rental property, hereafter referred to as Guest(s), and Cortes Island Vacation Rentals, hereafter referred to as CIVR, an agent authorized by the owner of the rental property, hereafter referred to as Owner. THIS AGREEMENT WITNESSES that, in consideration of the premises and the covenants contained herein, the parties do hereby agree as follows: TERMS AND CONDITIONS OF GUEST AGREEMENT 1. CORTES ISLAND VACATION RENTALS AS AGENT Cortes Island Vacation Rentals has arranged this use of the Property solely as agent for the owner of the Property ("Owner"). The Guest agrees that the Guest is paying the Owner for the use of the property, not Cortes Island Vacation Rentals, and that Cortes Island Vacation Rentals incurs no liability whatsoever; whether negligent or not, nor as a result of alleged misrepresentations relating to the Property, except for its express obligations set forth in the Guest Agreement. All information regarding the Property has been provided to Cortes Island Vacation Rentals by the Owner, and Cortes Island Vacation Rentals is not responsible for any misleading description of the Property which is provided by Cortes Island Vacation Rentals. 2. BINDING AGREEMENT These terms are conrmed and a binding agreement will be constituted between the Guest, the Owner and Cortes Island Vacation Rentals on the terms and conditions set forth in the Guest Agreement (the "Guest Agreement"). The Guest Agreement is binding upon and is for the benet of the Guest, the Owner through its agent, and where applicable, Cortes Island Vacation Rentals.

3. RESERVATIONS For the reservation to be conrmed, Guest must agree to the Terms and Conditions of The Guest Agreement online, or CIVR must receive this signed agreement, along with the Reservation Deposit of one half (50%) the total reservation amount due within ve (5) days of the date this agreement is entered into. Balance Duepayments will be automatically billed to Guest 60 days prior to check-in, or on initial reservation date if reservation is made within 60 days of arrival.If Guest would like to use a different method of payment for the Balance Due, Guest must notify CIVR prior to Balance Due Date. All reservations must be paid in full prior to disbursement of check-in information. Any reservation that is not conrmed as described above will be automatically cancelled. 4. CANCELLATION (a) By Guest Conrmed reservations are non-refundable. However, in the event of a cancellation, Cortes Island Vacation Rentals will attempt to re-rent the property, and if successful,Cortes Island Vacation Rentals will refund the Guest money in full, less a 10% cancellation fee.A proportionate refund will apply if the property is re-booked for only a part of the Guests reserved time. If the property is not re-rented, CIVR will retain all payments. No refunds will be made for unused days or early departures. (b) By Owner If, for any reason, the Owner cancels a conrmed reservation of the Property or the Property is rendered uninhabitable, other than as a result of a default by the Guest or an invitee of the Guest, the Owner will refund to the Guest the reservation payment and Cortes Island Vacation Rentals will release to the Guest the Damage Deposit paid by the Guest. Cortes Island Vacation Rentals will make reasonable efforts to nd another property represented by Cortes Island Vacation Rentals for use by the Guest. Neither the Owner or Cortes Island Vacation Rentals will be liable in any way to the Guest in the event of a cancellation of a conrmed booking, other than as expressly set forth in this paragraph, and the Guests damages or claims shall be limited to the return of funds paid. 5. CONDITION OF PROPERTY The Guest understands that they are staying in the Owner's home and that while every effort is made to make the home comfortable and clean, the home may be more "lived in" than a hotel room. Also, the Owner may leave belongings in the home during the Guest's stay.

CIVR cannot be held responsible for typographical errors, omissions, environmental factors, price changes and changes made by Owner in furnishings, equipment, bed arrangements, etc. 6. GUEST CONDUCT AND RESTRICTIONS (a) The Guest will act in a proper and reasonable manner while staying at the Property, and will ensure the Property and all contents of Owners personal property used by the Guest are used in a manner to avoid any damage, reasonable wear and tear permitted. The Guest will make all reasonable efforts to preserve and protect the Property and all contents of the Owners personal property. (b) The Guest will not create a nuisance to occupants of any neighboring property. Parties and large gatherings are prohibited unless prior arrangements have been made with the Owner and Cortes Island Vacation Rentals. (c) The Guest will ensure that members of the Guest's party and the Guest's invitees act in accordance with terms of this Guest agreement and otherwise comply with the obligations of the Guest hereunder (except as to the payment of fees hereunder) as if such persons were named as the Guest. The guest is responsible for the acts of members of the Guest's party and invitees. (d) The Guest will check in no earlier than 4:00 p.m., and vacate the Property no later than the checkout time of 10:00 a.m. Failure to vacate the property at the check-out time of 10:00 a.m. will result in an extra daily rate being charged against your damage deposit - No exceptions, unless previously agreed with Cortes Island Vacation Rentals. (e) The Guests will leave the Property in the same clean, tidy and orderly condition in which they found it upon arrival. (f) Furniture will be in the same location as at the commencement of the stay, and no personal belongings, furniture, or other items belonging to the Owner may be removed or misplaced by the Guest. (g) Only those adults who have signed this Guest Agreement and the minor children named in the Guest Agreement may stay overnight at the Property. If an additional person stays overnight at the Property, the Owner may, in addition to its other remedies, levy an additional charge of $25.00 each person per night unless otherwise stated in the rate sheet. The Guest may not sublet all or a portion of the Property nor assign this Guest Agreement. The Guest may not camp, tent or place other auxiliary accommodation facilities on the Property without prior written authorization from Cortes Island Vacation Rentals.

The Owner, or Cortes Island Vacation Rentals, may evict a Guest, and a Guest Party, without prior notice, if, in the Owner's or CIVRs reasonable opinion, the behavior of the Guest or any member of the Guest Party is unreasonable, or if the Guest breaches this Guest Agreement, whereupon the use will terminate and the Guest will not be entitled to any refund.

7. DAMAGE DEPOSIT All reservations are subject to a minimum of $500.00 Damage Deposit regardless of the length of stay. This fee can be higher on certain properties or for large groups. The Damage Deposit is pre-authorized for a minimum of $500.00 by the Guests credit card, and may be retained by the Owner and applied against any and all damage and loss to the Property caused by the Guest, (other than normal wear and tear), excessive cleaning costs, and any other amount owing by the Guest to the Owner under this Guest Agreement. The retention of the Damage Deposit herein is without prejudice to the Owners right to claim from the Guest any amount in excess of the deposit. Cortes Island Vacation Rentals will act in accordance with the Owner's instructions regarding deductions from the damage deposit and will have no responsibility or liability to the Guest in so acting. Cortes Island Vacation Rentals will release the Damage Deposit, minus any deductions required by the Owner to the Guest within 30 days. 8. CLEANING All properties are cleaned before and after the Guests stay. Cleaning can be arranged any time during the Guests stay for an additional charge of $25 per hour. Guests are responsible for leaving the accommodation tidy and with furniture left in the same position as it was when the Guests arrived. Guest shall keep and maintain the premises in a clean and sanitary condition at all times. If Guest uses the barbecue/grill, Guest is required to clean grill with supplied wire brush when nished cooking each meal. Upon termination of the agreement, Guest shall surrender the premises to Owner in the same condition as when received, excepting normal, light cleaning and laundry. Cleaning Fees are built into the weekly rental rate. Additional cleaning fees will apply to stays longer than 1 week. Our cleaning fees cover normal cleaning of the home and property. Excessive mess left by the Guest, resulting in extra cleaning hours, will be deducted from the Guests Damage Deposit, where necessary. Please refer to the following Cleaning Check List. Failure to comply with these simple departure cleaning activities will result in extra cleaning fees being charged to your credit card.

9. DEPARTURE CLEANING CHECK LIST Upon departure, Guest(s) must complete the following simple cleaning duties: - Remove and/or discard all personal food and beverages from the fridge and cupboards. Please take home any remaining food or beverages that you brought with you. - Gather all used towels and place in laundry area. - Strip beds of all bedding, and leave on top of beds. - Ensure that your garbage and recycling is clean, sorted, bagged, and put in proper recycling/garbage bins. - Please clean up after your children and/or pets. This includes cleaning up after spills/messes, and any excessive mess caused by pet (see Pet Policy). - Wash all dishes that you used, and either put away in proper cupboards, or leave in the drying rack. - Ensure that all furniture, books, games/puzzles, and other items belonging to the property owner are put back in their respective places. - Ensure that the BBQ is scrubbed and cleaned, ready for the next guests use. 10. MAINTENANCE Every effort is made to have the home clean and all equipment in good working order. Even the newest or best-maintained equipment occasionally malfunctions.Refunds will not be issued due to a malfunction in equipment. Any problems should be reported immediately to our ofce at (250) 935-0102 so we can make arrangements to resolve them. Repairs are corrected in as timely a manner as possible.CIVR reserves the right, if necessary, for maintenance staff to enter the premises during business hours for repair, care, or management of the property; CIVR will make every effort not to disrupt your vacation. 11. PET POLICY For properties that allow pets, Guest must adhere to the following pet policy rules: There is a non-refundable pet fee of $75.00/week, or $15.00/day for shorter stays. Pets are not to be left unattended in the home, due to potential noise, damage, or accidents. Pets must be housebroken. Pet owner must bring their own pet bedding. Pets are not allowed on any beds or furniture in vacation home. Guestsagree that the pet will not get on the furniture or bedding. Guests will be responsible for any pet damages and/or additional cleaning caused by the pet. This may include but is not limited to: excessive hair/fur on the furniture and carpets, paw prints, dirt tracked in and not cleaned up after, scratches or evidence of

chewing on walls, oor, or furniture, ea/tick infestation, and/or pet accidents in the home. Guests agree to promptly report any damage caused by pet(s), and any related charges will be deducted from the Damage Deposit. If damages are not reported but are found by owners/agent, they will be documented and necessary replacement or repair costs will be deducted from the Damage Deposit. Domestic pets only (dogs, cats, etc.) Birds and hamsters must be caged at all times. No exotic pets allowed. Owner is responsible for cleaning up after their pet in all outdoor areas. Guestsagree that dog(s) will not be washed in the bathtubs or showers inside the home. All excess dog hair will be swept, vacuumed or otherwise picked up and removed from the inside of the home prior to departure.Failure to clean up properly after your pet upon departure will result in extra cleaning costs deducted from your Damage Deposit. 12. PROPERTY USED AT GUESTS RISK The Property is used entirely at the risk of the Guest and members of the Guest's party. The Guest is responsible for any damage, loss or injury caused to the Property or to any other property or person by the guest or members of the Guest's party, or the Guest's invitee. Neither Cortes Island Vacation Rentals nor the Owner is responsible for any injury, accident, death, property loss or damage, loss of physical or mental enjoyment, expense, costs or inconvenience directly or indirectly caused to the Guest or any member of the Guest's party, by or arising out of the use or occupation, or the condition of the Property or its approaches, whether arising from breach of contract, negligence, misrepresentations or otherwise. Guest agrees to be familiar with appliances located on the premises, and to use all furnishings in a safe and reasonable manner. The fact that children may be permitted at the Property does not imply that the Property is without risk to children. Parents and adult guests are responsible for the actions and security of all children while on the Property. 13. INDEMNITY The Guest will indemnify and save harmless the Owner, the Owner's agents and Cortes Island Vacation Rentals from any and all damage, loss, expense, claim, action or liability of any kind whatsoever, or howsoever caused and whether negligent or not, including, without limitation, a claim of any kind by any member of the Guest's party (including those of minor children), which arises from or relates in any way to the use

or occupation of the Property by the Guest, members of the Guest's party or by invitees of the Guest. The Guest is responsible for and will indemnify the Owner for any damage of any kind to the Property caused or contributed to by the Guest, members of the Guest's party or by invitees of the guest. 14. LIMITATION OF LIABILITY Cortes Island Vacation Rentals does not own the Property and acts only as agent for the Owner. Cortes Island Vacation Rentals has no control over and is not responsible for or with respect to the Property; the Owner or the Owner's agents will incur no liability whatsoever whether negligent or not resulting from the state or condition of the Property or any act or omission, including, without limitation, an act or omission involving negligence of the Owner or the Owner's agents. 15. LIMITATIONS OF CLAIMS If the Guest or any member of the Guest's party, or guest or invitee, has a claim of any kind against Cortes Island Vacation Rentals or the Owner, with respect to or arising from this Guest Agreement or the use of the Property, the maximum liability in all circumstances of Cortes Island Vacation Rentals and the Owner with respect thereto will be the amount of money the Guest has paid under this Agreement. 16. INTERPRETATION AND DISPUTES (a) This Guest Agreement shall be governed by the laws of the Province of British Columbia, Canada. In the Guest Agreement, the singular will include the plural. If there is more than one Guest, the covenants, agreements and acknowledgments of the Guest herein bind each person comprising the Guest. (b) This Agreement and other writing delivered pursuant hereto may be executed in any number of counterparts with the same effect as if all parties to this Agreement or such other writing had signed the same document and all counterparts will be construed together and constitute one and the same instrument. (c) This Agreement will endure to the benet of and be binding upon the respective legal representatives, successors and permitted assigns of the parties. (d) In the event of any legal dispute concerning this agreement, the prevailing party shall be reimbursed by the losing party for all reasonable fees and costs for the legal services involved. This paragraph shall survive this contract.

17. AGREEMENT The Guest agrees to use the Property for the period of time, for the amounts and other payments set out in the Guests invoice, and on the other terms and conditions contained in this Guest Agreement. All adult Guests who execute this Guest Agreement agree to observe, perform and abide by the obligations of the Guest under this Guest Agreement, jointly and severally. The undersigned agree that they will use the Property at their own risk. Guest certies that by clicking I Accept, he/she has read the terms and conditions, understand them, agrees to be bound by them, and is authorizing all rental charges due and any outstanding charges remaining after departure to be charged to the credit card on the reservation.
