JusticeMarkWeinberg:Whateverelsecanbesaid,nocase,nomatterhow complexitmayseem,shouldbeallowedtorunformonthsandsometimes years (JusticeWeinberg2008:17).

IreceivedaresponsetothatessayfromtheOfficeoftheLegalServicesCommissioner.TheCommis sionerssympatheticreplynotedmyconcernsregardinglitigationbeingusedasaweapon,andtheneed forlegalcasestobeindependentlymonitored.TheCommissionersletterincludedaneyeopeningand bluntFACTSHEET#18titled:OPPOSINGLEGALREPRESENTATIVES(OfficeoftheLegalServicesCommissioner, 2005).Thusbeganmyeducationintheadversarialsystemofjustice.IhaveevaluatedthisFACTSHEET,

(JusticeMartin2008:3). IseetheFACTSHEETasbrieflyandclearlyoutliningmajordysfunctionsinouradversarialsystemofjus tice,withtheimplicationsoftheseproblemsdeepeningfurtherintoahodgepodgeofextremesandcon tradictions.Itsays(myemphasis):

Firstly,Iwishtoassertthatthetwobulletedpointsaboverepresentamassive,insituandaccepteddys function.Thatis,theframingofamonumentalwasteoftimeandresourcesviasetsofPlaintiff Defendantdichotomiesatwar.Thisinstitutionalizedcombatshouldnotexistinatrulyenlightenedsoci ety.Theyrepresentaridiculouslycomplexandimmaturestrivingforsupremacyinsideacommercialsys temcarryingthetaintofvestedinterests.Theyalsosignifystitchedupandprejudicedrulescoddling preciouscorporateegosandgreedyattitudesobsessedwithanendlesssummerharvestingoflegalfees: theexpandinglegaltaskandelasticaccounting(JusticeAllsop,2008:2)ofthelegalsystem.Howdidthe legalsystemconfigureforitselfsomuchbenefit?Thisformalizedschoolyardscrapandgrabmentality generatesalongwindedandexhaustingprocessthatconvenientlymaintainsaprofitableragewhile dancingawayfromthegenuineresponsibilitiesthataredemandedbythesuccinctelucidationofsimple truth.

Generally:whiletheoreticallyharnessingthepowerofselfinterestoneachsidetounearththebest evidence(LawReformCommissionofWA,nodate:25),legalteams,inseekingtoestablishprotection fortheirclients,mayultimatelygenerateanunavoidableandpowerfulinvestmentinskewedbiasin termsoftheessentialnatureoftheargumentputforth.Forexample,wemaybeleftwithpercep tionsofbiasinexpertswhogiveevidence(JusticeMcClellan2008:18).Thismanipulationofknowl edgeandinterpretationcanoccurtoapointwheretheargumentstructuresafabricatedstory,apic tureofeventsandanalysesthatmaynotevenmanagetoresemblethesomewhatdisappointingap proximatetruth(LawReformCommissionofWesternAustralia,nodate:25)thatseemstobetherather mediocregoaloftheadversarialsystem.Butthereisnoneedforprotectionandbiasifweviewthe unencumberedtruthasbeingmostimportant.Inmycase,thereexistsanabjectdenialthatonecan bepoisonedfromatermiticideapplication,eventhoughthegenerationofmysymptomswasalmost immediateuponexposuretothepesticidevapoursenteringmyunit.Youhavetowonderatwhat levelintellectisoperatingwhensocalledscientificprofessionalsdontevenseemtorecognizethe easymobilityandtoxicityofsolventsasacomponentofsomepesticides.Points3.c.andd.provide ideashere. 2. Putanotherway,andlookingtowardamoreidealconceptofresolvingtheissueoflyingconflict3,legal teamsshouldnotbeboundtoprotecttheirclientsvigorously.Thisisbecauseprotectionatallcosts automaticallyinvestsinaninstitutionalizedformofObsessiveCompulsiveDisorder(OCD).Thisdisor derultimatelyframesthecompulsiontoprotecttheclientinvestmentfromtheunpalatableordifficult historicaltruthofamatter,whileenhancingthereputationofthelegalfirmviaastatusenhancing win.However,ifweweretoimagineamoreefficientandlessdeceitfullegalworkplaceenvironment inwhichtosettledisputes,therewouldbenoinvestmentonanyleveltoprotectandnocorporate profiletodefend,advanceandpolish.Therewouldbenocompulsiontowinbecausetherewouldbe noschizophrenicandantagonisticlegaldichotomycreatingopposingrealities.Theveryexistenceof separatelawfirmsseeingthemselvespredominantlyaspartofbigbusiness(JusticeWeinberg 2008:23;quotetakenslightlyoutofcontext),andexposedtothetemptationsofvolumelitigation (JusticeAllsop2008:2)is,intheveryfirstinstance,aformativeinsulttowhatshouldbethecompara tivelyneutralandincorruptibleprocessofuncoveringtheunencumberedtruthwithinasimplecom posite(nondualistic)format. 3. Furthertowardaddressingthisprofounderror,theOCDandincomeimperativestoprotectclients, generatefees,andwinthelegalbrawlensuresthatethicalabuseswillbeacceptedandperpetuated insidethelegalprocess:

Expertscurrentandbeneficialevidencecanbedestroyedinsideatrialinaninfantileattackby theopposingside.Liescanwiniftheattackisdexterouslywaged(seeJusticeMcClellanstakeon this4).Today,thisisespeciallyapparentintermsofasystemthatrequiresustotreatothersas adversariesandtobattleeachotherinineffectivedehumanizingformalizedforums[where]we allbecomecasualtiesofthesystemandeachother(Redgwell2009).Thedegenerativetrendof todays(legal)decliningstandards(JusticeWeinberg,2008:1)isobvioushere,alongwithaninevi tableandalmostuniversalerosionoffaithintheadversarialsystem(JusticeMcClellan2008:6)5. c. Thecombinedevidencesuggeststhatneurodevelopmentaldisorderscausedbyindustrialchemicalshascreatedasi lentpandemicinmodernsociety.Althoughthesechemicalsmighthavecausedimpairedbraindevelopmentinmillions ofchildrenworldwide,theprofoundeffectsofsuchapandemicarenotapparentfromavailablehealthstatistics.Addi tionally,asshownbythisReview,onlyafewchemicalcauseshavebeenrecognisedsothefulleffectsofourindustrial activitiescouldbesubstantiallygreaterthanrecognisedatpresent. Theconsequencesofapandemicofdevelopmentalneurotoxicityextendbeyonddescriptivedataforincidenceand prevalenceofclinicallydiagnoseddisorders.1,3IncreasedriskofParkinsonsdisease97orotherneurodegenerativedis eases98isafurtherpotentialconsequenceofthepandemic[p.2174](Grandjean&Landrigan2006). 8 itisonlyrecentlythatithasbeengenerallyrecognizedthatthereisasecondcontaminanttransportprocess whichwilloccureventhroughaverylowhydraulicconductivityclayliner:thatprocessischemicaldiffusiondiffusion

thepesticide.9TheseexpertsfailtorecognizewhataGooglesearchcanuncover:thatpesticides penetratedmyunitshighlyporousconcreteslabunderlyingtwojoinedunits10(thisbeingwhymy elderlyneighbouralmostdiedin2001withnumerousboutsofbronchitisanddoublepneumonia requiringhospitalization).Thepossibilityofgapsorcracksintheslabthatmayhaveallowed penetrationoftheproductoritsvapoursintotheinteriorofyourunitcannotbediscounted (APVMAAdverseExperienceReportingProgramLetter/Report,28July2004).Mylegalteamand associatedscience/medicalprofessionalsaresteadfastlyattemptingtoelucidatethisINCONVEN IENTTRUTH,notrepudiateitwithmagicalfantasiesbasedinunscientificbias. 4. Evernoticed?WithinanyadversarialsystemorframeworkinstitutionalizedOCDengineersamassive andwastefulpapershufflingexerciseontworidiculouslyopposingandcombativefronts.Inpolitics twomainpartiesshuffleadvertisingandwastepreciousdollars.Inthelegalsystemwefirstnoticeun cooperativediscoveryandpreliminarymatters(ChiefMagistrateJudgeGrimm[USA],2008:2)11re sultinginyearswhereargumentsandpositionsareadvertised.Interestingly,verydeepsociological aspectsofthisfanaticismmaybeviewedsubliminallyandontologicallyasaneuroticandinadequate purificationdevice:areligiouslikeobsessionwithscrupulosityframedinsidedetailedandburden someactivityultimatelygeneratedasafunctionofalmostprimalguilt.Thisunavoidableandunre solvableguiltspringsfromanuncomfortableawarenessofacascadeofformative,developmentaland normalizedinadequacieswithinatoxiclegalframework.Thistypeofphenomenonisawidespread occurrencewithinhumansociety. 5. Myinjuredhealthstatus(pesticidepoisoning)wasnotimmediatelyandintelligentlyfactoredintothe genesisandfunctionalityofthelegalinquiryprocessinmycasewhenitstarted.Nordoesthelegal systemappeartobecapableoftherapeuticallydoingso.Asaresult,theoriginalproblemoftheDe fendantsindifference,negligenceandfailureofDutyofCare(notactingappropriatelyonthebasisof repeatedhealthalerts),thesubsequentnegligentdeploymentofpesticideontwooccasions,my mountingshockasaresultoftheseinvasions,andtheconsequentgenerationofaraftofcompound ingphysicalandpsychologicalinjuriesallbecamesynergizedandabsorbedbyafurtherinsult,thisbe ingMYDEATHLYENSHROUDINGASAPOISONINGANDBRAINDAMAGEDVICTIMINSIDEAPROCESS THATNOWFAILSTORECOGNISEANDCOMPENSATEFORANAGGRAVATEDANDLAYEREDHEALTH EVENT:LEGALSTRESSAMPLIFYINGPOISONINGSYMPTOMSANDPSYCHOLOGICALSHOCKLAYERED OVERTHESTRESSOFPOISONINGANDSHOCKAMPLIFYINGPOISONINGSYMPTOMS.Whenbureauc racyattacks!Erroroverlayserror,insultbindstoinsult,incomprehensionfollowsincomprehension, andscrambledcomplexitybuildsonscrambledcomplexity.Adynamicallyflawedlegalsystemtakes aninjury,andthenmagnifiesitfurtherviastupidlymandatedargumentandprotectioninsideanex haustingandinsanelyexpensivefeeharvestingprocessx2.ShadesofBleakHouseandjusticedelayed anddenied12,whileIhavealsosufferedaminorstrokeontopofallmypoisoningsymptomsandout comes(andbeenprescribedAsproProtect)!But,whocaresifthelitigantisthatcompromised?Cer

maybethedominantcontaminanttransportmechanisminawellconstructedclayliner.Furthermore,contaminants canescapefromawastedisposalsite,bydiffusionthroughaliner,evenifwaterflowinthelinerisintothelandfill (Rowe,R.K.1994). 9 Termiteswerekilledinbifenthrintreatments,andthissuggestedthemovementofthechemicalfromtreatedinto untreatedsections.Su&Scheffrahn(1990)reportedthemovementofapyrethroid(tralomethrin)fromtreatedsandto theagarlayerintheirexperimentagainstR.flavipes,causinghighmortalitieseventhoughthetermitesdidnotreach thetreatedarea.Manyotherresearchersalsoreportedtheroleofvapourphaseintheirexperiments.Ebeling&Pence (1958)noticedthatthevapourphaseofchlorinatedhydrocarbonshadpenetratedintoareasbeyondthetreatedsoil andwaskillingthetermitesAlthoughbifenthrinhaslowvolatilitywhenappliedondrysoil,itpossessesahighermi grationpotentialinwetterconditions(Fecko1999).Themovementofthetermiticide(andemulsifier)wasprobably facilitatedbywatersolubility(Smith&Rust1990;1991)andvaporpressure(Suetal.1982;Smith&Rust1990;1991). Whenthevaporpressureishighenough,someofthetermitesmighthavesatisfactoryamountsoftoxicantdeposited onthecuticle.Penetrationofthetoxicantthroughthecuticlewillslowlyaffectthetermiteswithoutdirecttermiticide contact(Suetal.1982;Smith&Rust1991).Thismayexplainthedeathofthetermitesintheuntreatedsection.(Yeoh &Lee2007) 10 "Thoughfairlyimpervioustowatermovement,concreteiseasilypenetratedbyvaporsandsolvents.Itisalso pronetocracking.Forthesereasons,theEnvironmentalProtectionAgency(EPA)believesthatconcretealonemay notprovideaneffectivebarriertopesticidemovementandhasproposedthatconcreteinpesticidesecondarycon tainmentstructuresbesealedorcoatedtoreduceitspermeability."(Broder&Nguyen1995) 11 Notealso:IthasrecentlybeenestimatedthatinonecasecurrentlybeingbroughtintheFederalCourt,thecostof discoveryalonewillexceed$20million.Thatisbothoutrageousandintolerable.Itmattersnotintheleastthatthe partiestothatlitigationarelargecorporateentities,presumablyableandwillingtoensurethattheyleavenostone unturnedinpursuingtheirinterests.(JusticeWeinberg,2008:10). 12 Thephrasejusticedelayedisjusticedeniedappliestoallaspectsofthelegalsystem(P.Dodd[solicitor]2009.
