Order for hiring of Taxi/ INDICA DLS FL diesel car No. DL-3CBB-1168.

Dear Sirs, On approval of higher authority and in reference to your application Dtd: 29.11.2012, for engaging your Taxi/ INDICA DLS FL diesel car No. DL-3CBB-1168. on hire basis, this order is hereby placed on you for engagement of your Taxi/ Indigo CS Diesel Car in the office of Executive Engineer, EMD-I, 3X210 MW ATPS, Anpara for use of concerned officer from colony to site and back for a period of 01.12.2012 to 28.02.2013 on the following rate, terms & conditions:Terms & conditions:01. The vehicle shall normally be used for local journey in Anpara but the vehicle is required to go outside Anpara with approval of Chief Engineer (L-1), ATPS, Anpara. 02. Toll tax, parking if any shall be paid extra by the Nigam as per actual expenses along with the monthly running bill presenting the original cash receipt duly verified by the user officer of UPRVUNL. 03. In case of breakdown of the vehicle the contractor will have to provide equivalent other vehicle in place of the engaged vehicle. In case he fail to do so, the payment for that day +10% penalty on hire charges for the period the vehicle was not provided shall be deducted from the running bill of Contractor. It will be the liberty of Nigam to make alternative arrangement also and in such case the full expanses shall be adjusted from the running bill till date . 04. If the performance of vehicle engaged, is not up to the satisfaction of the Nigam and Contractor fails to provide replacement of the vehicle, the contract can be terminated by giving 3 days notice and the security deposited/deducted from the running bill till date shall be forfeited. 05. In case of contractor withdraw the vehicle on his own, during the contract period; the security deposit deducted from the running bill shall be forfeited. 06. The vehicle to be engaged shall be Taxi/ INDICA DLS FL Diesel Car/ vehicle of 2008 Model or later year model and shall be in good running condition and well mentioned. 07. The contract period shall be w.e.f 01.12.2012 to 28.02.2013 but may be extended at the discretion of Nigam on the same rates and terms and conditions. 08. The vehicle shall be normally used for 12 hours each day. However it shall remain at the disposal of Nigam for full 24 hours and shall not be used by the contractor for other service. The vehicle shall have valid registration, Road Tax payment, Insurance and shall be redistricted with the RTO/ARTO under Taxi Quota etc. The driver must have the valid driving license. All expanses in this regard shall be borne by the Contractor. 09. The journey from garage to user officers residence and back shall be born by the contractor. 10. The contractor shall be responsible for proper maintenance and upkeep of the vehicle including payment of Drivers salary, road tax, Insurance etc. All expanses in this regard shall be borne by the Contractor. 11. The driver of the vehicle shall maintain a log book and will enter daily reading of Kilometer and get the same verified daily by the user officer. P.T.O .

The hire charges of the vehicle will be paid at the rate of Rs. 435.00/per day for 12 hours duty (Inclusive all taxes & Insurance).Vehicle shall normally be provided/operated for full month. 13. For out station duty the night halt charges for the driver at the rate Rs. 150.00 per night halt will be paid. 14. The said vehicle shall remain available with the user officer for all days of the month. 15. The contractor shall be responsible for all Statutory Compliences with all legel bindings such as minimum wages to worker, Compensation etc. in case of accident and other such related matters No Claim in this respect will be entertained by UPRVUNL. 16. The instruction of In-charge of the contract/ (CE/SE/EE) shall have to be followed. 17. The approved monthly rates hereof shall not be changed during the course of contract. 18. Vehicle owner will comply all provisions of Motor vehicle Act 1990 read with U.P. Motor Vehicle rules. 19. The reimbursement of Diesel charges would be made as per actual journey in a month taking average consumption for diesel vehicle at 14 Km./ Liter as per the following formula for 1000 Km in general shift:Km Running X Cost of Diesel 14 20. Vehicle will be operated whole month except Two days off for the maintenance of Vehicle which no payment shall be made. 21. In case any accident occurs by the Vehicle to the Driver/any employee of the project/any person, it will be sole responsibility of Vehicle owner for payment of any due compensation under the Motor Vehicle Act 1988(Amended),workmen compensation act 1923 and other relevant statutes relating thereto made for time to time. No claim in this respect will entertained by UPRVUNL. 22. Division shall not be liable to provide either accommodation or garage facility to the Vehicle owner or his employee. Payment: 01. Payment shall be made on presenting of running bill duly verified by user officer by the contractor each month and taxi permit should be must before submitting the running bill otherwise payment could not released. 02. Total 10% of the rent amount shall be deducted as security from each running bill and shall be refunded after completion of satisfactory work. 03. Income tax shall be deducted from each running bill as applicable from time to time. 04. Any dispute arising out of the reasons mentioned above during the pendency of the contract shall be subject to the jurisdiction of Sonebhadra Court. Thanking you, Yours faithfully
