REQUEST FOR EXPRESSIONS OF INTEREST CONSULTING SERVICES KINGDOM OF MOROCCO Preparation of the Executive Decree to the PPP Law

of Morocco The Government of Morocco has received a financing from the Arab Financing Facility for Infrastructure (AFFI) and intends to apply part of the proceeds of this financing to hire a Consultant (a legal advisory firm) for the preparation and drafting of the Executive Decree to the PPP Law in place in the country (the Project). The Arab Financing Facility for Infrastructure (AFFI) is a partnership of the World Bank (IBRD), International Finance Corporation (IFC) and Islamic Development Bank (IDB). The Technical Assistance Facility (TAF), one of the components of AFFI, provides awareness raising, enabling environment and transaction advisory services to governments to assist in preparing PPP projects. The law on PPP has been recently approved by the Council of Government. As a next step, and upon the adoption of the law by the Parliament, this law would need to be completed by an executive decree to allow its efficient implementation. In this respect, the Ministry of Finance (MoF), via the Directorate for Public Enterprises and Privatization (DEPP), has requested support from the AFFI TAF to help in the drafting of such decree. In this sense, the scope of the Consultant would entail the supply of legal and technical advice in the development and drafting of the executive decree. The Consultants services will include mainly, but not limited to: Presentation of benchmarks of PPP implementation decrees with a focus on best practices in PPP Contract Undertaking/Project Cycle, in view of recommending appropriate technical and operational provisions for the proposed decree, and setting up the necessary enabling tools for the implementation of the Government policies in terms of PPPs; Definition and drafting of the conceptual and operational aspects of the decree to enable the implementation of the different PPP law clauses relating to, amongst others, project evaluation, PPP contract procurement, contract monitoring, draft contract, etc; Support to DEPP in the presentation to and discussion with public stakeholders of the draft implementation decree, and eventually in the finalization of this document.

The IDB, on behalf of the TAF, now invites eligible consultants to indicate their interest in providing these services. Interested consultants must provide information indicating that they are qualified to perform the above mentioned services (brochures, description of similar assignments, experience in similar conditions, general qualifications and technical expertise, number of key staff and so forth). Consultants may express their interest in the form of association, validated by an agreement among members of the association which clearly specifies the type of association, i.e. a joint-venture, intermediate forms of association, or sub-consultancy. A consultant will be selected in accordance with the procedures set out in the Guidelines for the Use of Consultants under Islamic Development Bank Financing (current edition).
