With the scheduling problems we experienced before the last term ended and the replacement of Board members, it is apparent we would again be left with a compromised panel of only two members leaving open the very expensive potential of 1 no decision being reached and the hearing needing to be re-litigated. We have appreciated your attention to this matter and courtesy throughout the process thus far. Today, we filed on behalf of Mr. Murphy a tort claim with the county and attached a complaint which, if necessary will litigate this in Federal District Court. Through the course of discovery conducted in relation to this appeal, evidence was established that gave rise to constitutional claims which are beyond the purview of the Civil Service Board in any event. Thank you again for your assistance.
