SOFTWARE LICENSE AGREEMENT TikGames, LLC licenses the accompanying software to you only upon the condition that

you accept all of the terms contained in this End User License Agreement be tween you (either an individual or a single entity) and TikGames, LLC for this T ikGames software product. Please read the terms carefully before installing or u sing the software. If you do not agree to these terms, do not install the softwa re. SOFTWARE LICENSE The software is the property of TikGames, LLC and is protected by copyright law. The license grants you a limited, non-exclusive, non-transferable and non-subl icensable license to install, copy, and use the software, as described below. This software contains Adobe Flash Player software by Adobe Systems Incorporated, Copyright 1995-2007 Adobe Macromedia Software LLC. All rights reserved. Adobe an d Flash are trademarks of Adobe Systems Incorporated. LIMITATION OF LIABILITY The software product is provided "as is" and "at "your own risk," without warran ty of any kind, either expressed or implied, regarding the operation of the soft ware product, including warranties of merchantability or its fitness for use for any particular purpose. TikGames, LLC and its suppliers will not be liable for any incidental, indirect, or consequential damages arising out of the use of the software. The entire liability of TikGames, LLC and its suppliers under this a greement shall be limited to the amount actually paid by you for the software th at causes the damage. RIGHTS: Under this agreement you are permitted to: (i) Use one copy of the Software on a single computer. (ii) Make one copy of the Software for the purpose of backup. (iii) Share Unregistered (ie. Free) copies of this software with other end users . (iv) Upon purchase, use one copy of the software for as long as the product is s upported. LIMITATIONS: Under this agreement you are not permitted to: (i) Make any copies of the software, except for personal backup purposes or as d escribed above. (ii) Transfer, distribute, modify or translate the Software, or any portion ther eof, except as described above. (iii) Disassemble, decompile, or otherwise reverse engineer the Software or any of its data in any way, shape, or form, for any purpose, including, but not limi ted to, the purpose of gaining access to the Source Code. (iv) Distribute add-ons or levels of any kind for use with the Software. (v) Distribute, or attempt to distribute, License Codes for this product to any other party. (vi) Use this software on more than once computer simultaneously, if you make a copy on another computer as a backup of the Software. (vii) Use the Software for any commercial purpose. GENERAL This License Agreement shall be governed by the laws of the State of California

without regard to principles of conflicts of laws and shall inure to the benefit of TikGames, LLC, its successors and assigns. Any disputes relating hereto shall be adjudicated in the state or federal courts in the State of California, and you hereby consent to the exclusive jurisdictio n of said courts. If for any reason a court of competent jurisdiction finds any provision of this License Agreement, or portion thereof, to be unenforceable, t hat provision of the License Agreement shall be enforced to the maximum extent p ermissible so as to effect the intent of the parties, and the remainder of this License Agreement shall continue in full force and effect.
