(UPDATED FEBRUARY 11, 2013) The following are the statutory sections that provide a benefit or support to military

spouses in the United States Code. Many are contained in Titles 10, 32, and 38, but they also appear in Titles 5, 6, 8, 20, 24, 26, 29, 33, 36, 37 and 50. Same-sex spouses do not have access to any of the benefits or support programs provided by these provisions because of the Defense of Marriage Act. Title 50 (Appendix) War and National Defense Title following sections are contained in the Servicemembers Civil Relief Act (SCRA). The SCRA applies to service members and their dependents. Dependent is defined in 50 U.S.C. Appendix 511 as (1) a servicemembers spouse; (2) a servicemembers child; or (3) an individual for whom the servicemember provided more than one-half of the individual's support for 180 days immediately preceding an application for relief under

the SCRA. A same-sex spouse could qualify as a dependent under the third category, but would not necessarily qualify and would not be qualified because of the spousal relationship. If the marriage was recognized, a same-sex spouse would always qualify under the first category. 50 U.S.C.
