The Circuit Attorney of the City of St. Louis, State of Missouri, upon information and belief, charges that Count 1: Kidnapping (Class B FELONY) RSMo 565.110 TO 12/15/2012 Place: 39XX DELOR ST FROM 12/14/2012 (SCC 16020)

The defendant, in violation of Section 565.110, RSMo, committed the class B felony of kidnapping, punishable upon conviction under Section 558.011, RSMo, in that on or between December 14, 2012 and December 15, 2012, the defendant unlawfully removed K.I.H. without her consent from 39XX DELOR ST, the place where she was found by the defendant without her consent for a substantial period, for the purpose of facilitating the commission of the felony of forcible rape.

Count 2: ARMED CRIMINAL ACTION (FELONY) RSMo 571.015 FROM 12/14/2012 TO 12/15/2012 Place: 39XX DELOR ST (SCC 31010) The defendant, in violation of Section 571.015, RSMo, committed the felony of armed criminal action, punishable upon conviction under Section 571.015.1, RSMo, in that on or between December 14, 2012 and December 15, 2012, in the City of St. Louis, State of Missouri, the defendant committed the felony of Kidnapping charged in Count One, all allegations of which are incorporated herein by reference, and the defendant committed the foregoing felony of Kidnapping by, with and through, the knowing use, assistance and aid of a dangerous instrument.

The defendant, in violation of Section 566.030, RSMo, committed the felony of forcible rape, punishable upon conviction under Section 566.030, RSMo, and subject to lifetime supervision under Section 217.735, RSMo, in that on or between December 14, 2012 and December 15, 2012, in the City of St. Louis, State of Missouri, the defendant knowingly had sexual intercourse with K.I.H., by the use of forcible compulsion.

The defendant, in violation of Section 569.160, RSMo, committed the class B felony of burglary in the first degree, punishable upon conviction under Section 558.011, RSMo, in that on or between December 14, 2012 and December 15, 2012, in the City of St. Louis, State of Missouri, the defendant knowingly entered unlawfully in an inhabitable structure, located at 39XX DELOR ST and possessed by XXXXXXX for the purpose of committing a theft therein, and while in such inhabitable structure there was present in such inhabitable structure, K.I.H., a person who was not a participant in the crime.

Count 11: Theft/stealing (value Of Property/services Is Less Than $500) - 1st Offense (Class A MISDEMEANOR) RSMo 570.030 FROM 12/14/2012 TO 12/15/2012 Place: 39XX DELOR ST (SCC 15000) The defendant, in violation of Section 570.030, RSMo, committed the class A misdemeanor of stealing, punishable upon conviction under Sections 558.011 and 560.016, RSMo, in that on or between December 14, 2012 and December 15, 2012, in the City of St. Louis, State of Missouri, the defendant appropriated a cell phone and clothing, which property was possessed by K.H. and the defendant appropriated such cell phone and clothing without the consent of K.I.H. and with the purpose to deprive her thereof.

Count 12: Theft/stealing (value Of Property/services Is Less Than $500) - 1st Offense (Class A MISDEMEANOR) RSMo 570.030 FROM 12/14/2012 TO 12/15/2012 Place: 39XX DELOR ST (SCC 15000) The defendant, in violation of Section 570.030, RSMo, committed the class A misdemeanor of stealing, punishable upon conviction under Sections 558.011 and 560.016, RSMo, in that on or between December 14, 2012 and December 15, 2012, in the City of St. Louis, State of Missouri, the defendant appropriated a purse, which property was owned by XXXXXXX, and the defendant appropriated such property without the consent of XXXXXXXXXXX and with the purpose to deprive her thereof.
