FOR: PROBATE OF WILL AND ISSUANCE OF LETTERS TESTAMENTARY MARIA MALDITA MASIPAG, PETITIONER x----------------------------------------x

PETITION

COMES NOW, the petitioner through undersigned counsel, and to this Honorable Court respectfully alleges: 1. That petitioner is a Filipino citizen, residing at Bais City and the widow of the deceased JUAN S. MASIPAG; 2. That the petitioner has been appointed by the testator as sole executrix, to which the petitioner consents to; 3. That on November 1, 2012, JUAN S. MASIPAG died in Dumaguete City, Negros Oriental;

4. That on January 6, 2010 he executed a notarial will in English, a language known to him. A copy of said notarial will is hereto attached as Annex A, as his last will and testament; 5. That the deceased left properties, both real and personal, with an estimated value of three million pesos (3,000,000 php); 6. That he left as his only heirs the herein petitioner, MARIA MALDITA as his widow and his five children from his first wife namely, JUAN S. MASIPAG, JR., PEDRO S. MASIPAG, ANTONIA MASIPAG-REMEGIO, DOROTEA MASIPAG-DADO, all of whom are of legal age, and ENRICO S. MASIPAG, 16 years of age, all of whom are residents of Bais City; 7. That letters testamentary are prayed for MARIA MALDITA, who is named as the sole executrix in the will.

WHEREFORE, it is respectfully prayed that, after due notice and publication, this Honorable Court fix the date for the probate of said will and that letters of testamentary be issued in favor of the herein petitioner and thereafter the properties of the deceased be adjudicated in accordance with the said will.
