Film-it-Yourself NZ 2013 Wedding Video Terms & Conditions 1. PAYMENTS - An initial Reservation Fee of $300.

00 is required with the signed contract. The Reservation Fee is non-refundable. The remaining balance is due prior to shipping of the film equipment. 2. RESERVATION OF TIME AND DATE - This contract constitutes an order for one wedding production. If the payments are not received at Film-it-Yourself Ltd. by the dates specified, Film-it-Yourself Ltd. will consider the contract null and void and will retain the Reservation Fee. Film-it-Yourself Ltd will make all reasonable endeavours to contact the client in this instance. The reservation fee, payment schedule, times, dates, locations, and other important information are specified on the reverse side of this contract. 3. DELIVERY OF FINISHED PRODUCT - The Client is welcome to pick-up their video(s) in person or they can have them shipped to them postage paid. Please note that Post-Production editing usually takes up to 9 weeks to complete. Conversion of a package to a higher one must take place within six (6) months. Requesting final copies to be converted into a full package after two (2) months will result in a $100.00 Footage Reloading Fee as well as the second edit fee, as video is erased after two (2) months. 4. EXCLUSIVE RIGHTS - It is understood Film-it-Yourself Ltd. is the exclusive official production company retained to perform the services requested on this contract. Display rights: In agreeing to these T&C's, The Client is acting as agents for all members of the party and guests and grants Filmit-Yourself Ltd. all rights for display,broadcast, exhibition, promotion, and advertising use of all images produced under this contract. All video masters and raw footage remain the exclusive property of Film-it-Yourself Ltd. 5. RESTRICTIONS - The Client is aware that restriction imposed by others (e.g., photographer, church, reception hall, guests, etc.), and the constraints of the physical environment, safety, weather, and acts of God can affect the quality and extent of video coverage possible. Film-it-Yourself Ltd. takes no responsibility for the quality of footage recorded by the camera operators chosen by the Client to film the event. Film-it-Yourself Ltd. will not be held accountable for events within the bounds of any restrictions and constraints of the physical environment, safety, weather and acts of God. Film-itYourself Ltd. cannot guarantee coverage of the entire wedding event as this is dependent on the camera operators as chosen by the Client. 6. POSTPONEMENT/CANCELLATION - In the event of a postponement or cancellation of the wedding/contract, prior to four (4) weeks of the event, the amount paid will be returned. If cancellation is made less than four (4) weeks remaining to the event, no refund of the Reservation Fee will be made. 7. STUDIO LIABILITY - Film-it-Yourself Ltd. will take the utmost care with respect to the post production and delivery of the video(s). However, in the event Film-it-Yourself Ltd. fails to comply with the terms of this contract,due to any event at or beyond the control of Film-it-Yourself Ltd., including but not limited to illness, accidents,labour disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Film-it-Yourself Ltd. liability is limited only to refund of all monies received. 8. ADDITIONAL CHARGES - If something occurred at the event that the Client does not want to appear on the end product, the Client must instruct Film-it-Yourself Ltd. before editing begins. After the video has been delivered to the Client, there will be a charge for the additional editing package. 9. WARRANTIES - Film-it-Yourself Ltd. makes no warranties express or implied, with respect to the work or property that is the subject matter of this contract. 10. PRODUCTION AND EDITORIAL CONTROL - Film-it-Yourself Ltd. is granted full editorial control by the Client regarding all aspects of the post-production services for this event. In the case a particular segment of the event is either not recorded, partially recorded, or not part of the edited master DVD, it is at the sole discretion of Film-it-Yourself Ltd. as the exclusive producer of the event video recording. Film-it-Yourself Ltd. attempts to edit the provided raw footage of your event as-is. Film-itYourself Ltd. takes no responsibility for the operation of the equipment by the camera operators at the event. Film-it-Yourself Ltd. endeavours to provide the Client with fully functional and non-faulty

equipment before the arranged date of the event. It is the responsibility of the Client to make sure that the equipment is all fully functional and operating correctly before the event takes place. If the Client is not satisfied or finds fault with the equipment it is the responsibility of the Client to contact Film-it-Yourself Ltd. as soon as possible to arrange replacement equipment. If the Client does not notify Film-it-Yourself Ltd. at least twenty four (24) hours before the event commencement, Film-itYourself Ltd. will not be held responsible for any malfunctions and/or faulty equipment operated at the event. 11. CLIENT FILMING - Film-it-Yourself Ltd. will not be held responsible for the quality, quantity or type of raw video footage recorded by the Client. Film-it-Yourself Ltd. will not be held liable for the raw video footage and will edit the delivered footage as well as possible to deliver the package as paid for by the Client. Film-it-Yourself Ltd. cannot guarantee coverage of the entire wedding event as this is dependent on the raw video footage as filmed by the Client. 12. DVD COMPATIBILITY - Film-it-Yourself Ltd. produces DVDs using the most compatible media for set-top players. Film-it-Yourself Ltd. is not responsible for incompatibility with the DVDs created and the Clients DVD player.
