This is my beloved niece Lacey Gaines. She was murdered just 6 days after her 20th  birthday on Dec. 7, 2009 in her apartment in Justice, Il. She was strangled with a cord and her throat was cut with a 10” kitchen knife. No forced entry, no robbery, no sexual assault, no defensive wounds. Her murder left her infant son without a mother and her family in possible danger. There have been no arrests in her case.Lacey grew up among the cornfields of Grant Park, Il. She was a polite and kindhearted little girl with a sense of humor. She attended a Lutheran Day School and went to France as part of a student exchange program. She spoke fluent Spanish.When she was 15 yrs old (under the age of consent) she met and began a sexual relationship with a Latino man who was 10 years older than she. A baby was born and she lived with the father for a time. But then Lacey began calling me and telling me she was being abused. I advised her to go to the shelter and see a therapist, get an order of protection, and make police reports. She did all of these things.She met and began a relationship with another Latino man. She moved to the Sunset Apt in Justice in the spring of 2009. Just a short time prior to her murder she asked her father if she could move back home. Unfortunately she was found murdered shortly after making the request. My mother called and told me Lacey had  been found murdered. It was a horrible shock.Lacey was a treasured daughter, a close sister, a tender mother, an unforgettable niece, a generous cousin, and a forever friend. She was unique, full of life and laughter, she had a spirit which could not be  broken, it was a light she let shine brightly. She still shines ever brighter in our hearts and in Heaven.

Trust me when I tell you that my cousin Lacey was different from you and I. Most of us funnel through life operating every aspect our daily routine taking for granted the people we love. We usually never think, until it’s too late, that at any moment somebody we care about could be taken away from us. We tend to not always say what’s in our hearts and we procrastinate  because we naturally assume that we have all the time in the world. . .When I first heard the news that Lacey was killed my mind went blank. I didn’t know what to think, how to react or how to feel. I was in shock. A short time later the reality of what had happened and the sadness in my heart was all to present. I immediately  began to think of all the times I was supposed to call Lacey and didn’t; the time I was supposed to take her to that concert and cancelled; the times I argued with her and never apologized. . .

Who We Are
The majority of the board members of CitizensAgainst Homicide have had a family member murdered. They are surviving the devastatingloss of a loved one and still suffer the continued emotional trauma of coping with our criminal justice system. We have joined together to createa voice for the survivors and friends of murder victims.
CAH Objectives
Assist families through the complicated criminal justice system.
Provide trial and courtroom support to victims.Accompany victims to parole hearings in their endeavor to keep the convicted murderer in prison.Provide information on pending crime legislation.
 Protecting Your Own Interests
You can’t prepare for the event that makes you a victim. You can only react. You need to knowhow to deal with the subsequent trial, sentencing and unavoidable parole hearings. CAH helps you take action to protect your own interests.

We hold monthly meetings on the second Sundayof each month at 302 4th Street, San Rafael, CAThe monthly meeting starts at 10:00 a.m. We encourage anyone interested to attend meetings.

The Victims Voice and Citizens Against Homicide have lost a friend in the death of Gail. Gail was devoted to her family, yet found time to be involved in her community.Gail and Jacque met through sorrow when Gail’s parents were murdered. She worked tirelessly to keep their story in the public arena. Gail was also a guest on Jacque’s show

 will not allow the public to forget her parents until their case is solved.Just a few words of thanks for everyone that worked and  played in the 17th annual CAH Golf Tournament that was held on Friday the 13th of August. Usually in the issue of our Newsletter we have photos and all the winners listed.However this month the NL is especially filled with the greater than usual requests for paroles. One that did not have time to go into the NL but has been posted on our website along with the ones featured in this months NL. There is also an open letter to the Governor of California regarding a request that the Governor not sign the release for a murderer. The letter speaks for itself thus I will not repeat the details here. What I will say here about that case is that again we have a Judge, Judge Goethais making decisions from the bench and TELLING the Board of Parole Hearings to vacate their decision. The Judge is Thomas M. Goethais, Orange County Superior Court Judge. As of this writing we were not able to gather any specific information about this Judge. If anyone has details about him we certainly would like to know. By this ruling he is not a friend of victims or the laws that we currently have in place. He supports murderers. Someone we should  NOT have sitting on the bench. Next month we will have all the details of fun and fund raising that went on at the tournament.

OPEN LETTER TO GOVERNOR SCHWARZENEGGER
 RE: GARY ECCHER PAROLE RELEASE 
On August 10, 1985, Gary Eccher murdered Lianne Lando. He bludgeoned her, strangled her, submerged her in bath water, and electrocuted her. Per the Orange County Probation Officer’s report, Gary Eccher stated, “a spur of the moment physical altercation ensued and that escalated into the death of my girlfriend”.Deputy District Attorney, Rebecca Olivieri’s statement objecting to parole (page 32, line 13-15), demonstrates a lack of remorse and insight by Gary Eccher into the murder of Lianne Lando. Note that Gary Eccher indicated that “this crime is simply an isolated incident between a couple who was living together”. Governor Schwarzenegger, murder is NOT a simple isolated incident. Gary Eccher’s decision to murder Lianne Lando has changed lives forever . . . that words cannot describe.Do these statements reflect insight into the commitment offense? Gary Eccher refers to his murder of Lianne as “an incident that just so happened to be a spur of the moment physical altercation that escalated into the death of my girlfriend”. Gary Eccher murdered Lianne Lando and he cannot come remotely close to using the word “murder”. He just doesn’t get it. There is no remorse or insight into what he chose to do . . . Murder Lianne.On July 15, 2009, Gary Eccher, CDC# D-36746 appeared before the California Board of Hearings Panel for a Life Term Parole Consideration Hearing. The Panel concluded that he was not yet suitable for parole,  because he posed a present and unreasonable risk of danger to society, or a threat to public safety if released from prison. Considered were (3) three disciplinary actions and the commitment offense continued to be a factor that influenced the Panel’s decision of unsuitability. The Panel noted and conceded that the commitment offense no longer weighed heavily against suitability, but it was a consideration for the panel. The Panel noted that the offense was committed in an especially heinous, atrocious and cruel manner. It was carried out in a calculated manner that demonstrated an exceptionally callous disregard for human suffering and the motive certainly was trivial. The Panel mentioned that subsequent to Lianne Lando being murdered by Gary Eccher, he showered, took property from the residence and fled to Mexico.The Panel noted their concern about Gary Eccher’s issue of being self-absorbed and self-centered. He failed to adhere to some direction when cautioned by the Panel about his perceived personal agenda. He ignored the warning and kept going. Only after a second reminder did he divert his course of action. The Panel was also concerned about his flawed judgement when confronted with issues of dealing with right versus wrong.On March 11, 2010, Thomas M. Goethais, Orange County Superior Court Judge, granted Gary Eccher’s  petition for Writ of Habeas Corpus. He ordered the Board of Parole Hearings (BPH) to vacate its July 2009 decision finding Gary Eccher unsuitable for parole and directed the BPH to conduct a new parole suitability hearing. He directed that the BPH find Gary Eccher suitable for parole unless either previously undiscovered evidence or new evidence subsequent to Gary Eccher’s July 2009 hearing “regarding his conduct, circumstances or change in his mental state supports a determination that he currently poses an unreasonable risk of danger to society if released from parole”.Judge Goethais notes in his order, that private counsel (appointed by the court) contends there is no evidence to support the BPH conclusion that Gary Eccher would currently present a danger to society on release. Counsel requested that the court order the BPH to vacate its decision denying parole and to hold another hearing at which, it is to find Gary Eccher suitable for parole.Gary Eccher’s murder of Lianne Lando is described by Judge Goethais as occurring 24 years ago. Also, that the crime is “both temporally remote and mitigated by circumstances indicating the conduct is unlikely to recur. Therefore, the BPH may not continue to rely solely on the commitment offense to deny parole,  because the circumstances of the crime alone no longer support the conclusion that Gary Eccher remain a current threat to public safety”.How careless for a presiding Superior Court Judge to insinuate that Lianne’s murder is “temporal”; Lianne’s death is “forever”’ a far cry from being temporary and not eternal. Shame on Judge Goethais for discounting the life of Lianne Lando.Judge Gothais, in his decision to grant Gary Eccher’s Writ of Habeas Corpus and order for a new parole
