YES, Athletic Director Carl McAloose, now retired, and Associate Athletic Director Kathy
Peterson were told by FGCU’s interim president, general counsel and director of human
resources that coach Jaye Flood’s personnel file did not support a decision to fire her, so
what did they do?
McAloose and Peterson were told in order to fire Flood, they would need additional
documentation, like a poor performance evaluation, so they changed their evaluation
just days before coach Flood filed a lawsuit, along with Another former coach at the
university, Holly Vaughn, that claims the school retaliated against them for raising
questions about sex discrimination within the athletic department.
Because this case has been ongoing and very involved for years, here is an edited
timeline of the case:
Sept. 1, 2003
FGCU hires Jaye Flood to coach
women’s volleyball team.
Nov., 2004
Team wraps up inaugural season with a 24-6 record- becoming
the first FGCU sport to reach postseason play.
Nov., 2005
Volleyball closes its 27-4 season with a loss in the regional finals.
Nov., 2006
Third season ends with an even better 29-3,- team loses in
the regional final.
May, 2007
Former athletic director Merrily Dean Baker issues a gender-equity
complaint
on behalf of female coaches and women’s athletics.
July, 2007
Internal auditor Carol Slade completes gender-equity investigation,
indicating FGCU was complying with all federal equity laws.
July, 2007
The same day Slade finished her report, Flood receives a “below
expectations”
rating on her evaluation, and is given 120 days to improve her
performance
or face possible disciplinary action.
July, 2007
Flood rebuts her evaluation, writing a memo that her rating was
retaliation
for expressing concerns of discrimination.
Oct., 2007
FGCU places Flood on paid administrative leave for “issues involving
student
welfare.” Team has 16-2 record at the time.
Nov., 2007
Flood is named Atlantic Sun Conference Coach of the Year despite
being on suspension.
Jan., 2008
Public Justice files a federal lawsuit against FGCU on behalf of
Flood,
who claims retaliation and defamation.
Jan., 2008
FGCU President Wilson Bradshaw announces the university will fire
Flood
for having an improper relationship with a student.
March, 2008
Flood officially is fired after a mandatory appeals period concludes.
May, 2008
Holly Vaughn joins Flood’s federal lawsuit as a co-plaintiff.
Oct., 2008
FGCU and the two coaches agree to settle their lawsuit, accepting
$3.4 million while the university admits no wrongdoing.
Oct., 2008
Both parties jointly announce the settlement agreement.
It’s obvious that once McAloose and Peterson knew FGCU was facing discrimination charges they
acted in the most archaic way, hoping everything will just go away and FGCU will continue to stay
in the 60’s where women and mens roles were well defined.
Until women receive the same pay and equal treatment in the workplace we need people like
Jaye to fight for their rights, or we will continue to be treated as second class citizens.
Because of her long fight Jaye will go down in SWFL history as one who fought injustice in an
antiquated system that permeates SWFL. Shame on FGCU for stooping to such lows.

Splash is very lucky to get the first interview with coach Jaye Flood.
SPLASH: WHAT WAS IT INSIDE YOU THAT MADE YOU FIGHT TO THE VERY END WHERE MOST
PEOPLE WOULD HAVE GIVEN UP AND MOVED ON AS SO MANY WHO ARE UNJUSTLY TREATED?
JAYE: It was and still is the right thing to do for my athletes, the womens programs and coaches at FGCU.
I knew that it was time to make a stand, the unjust treatment had gone far enough. It was all there in the
Baker letter that was ignored from the beginning. I had the support of my family, the community and the
best attorneys for this in the United States. I went to high school when Title 9 was first passed and this is 35
years later I am still fighting the same battles, its not right and universities know better I think most of the
time they hide it and fight it until people go away. I was NOT going away this time.
SPLASH: WHAT WAS YOUR INITIAL REACTION WHEN YOU HEARD YOU HAD WON YOUR CASE?
AND CAN YOU TELL US ABOUT YOUR LAWYER?
JAYE: My reaction was of course one of relief a relief that now people would know that what myself and the
other coaches were fighting for was the truth and it had merit. My Lawyers are Linda Corriea and Adele
Kimmel from Washington DC. They believed in me and thought our case was worth the fight. They were
incredable with not only my case but with me as a person. The spin put on the case and not the real issues
were seen through by most people and people who know me know the real story and don’t bother with the
spin.

The classic movie musical, The Wizard of Oz, based on the book by Frank L. Baum
and the world famous 1939 film, chronicles the adventures of Dorothy, the Scare-
crow, the Tin Man, the Cowardly Lion and… Toto, too! You’ll hear the songs from
the score you
know and love such as Somewhere Over the Rainbow, We’re Off to See the Wizard
and Follow the Yellow Brick Road .
Making her Broadway Palm debut as Dorothy is Megan Kip. Straight from play-
ing the Emcee in Cabaret is John Ramsey, Jr. who will portray the extremely limber
Scarecrow. Jason Sofge who played Nicely-Nicely Johnson in Guys and Dolls
returns as the Cowardly Lion and the character of the Tin Man is played by Jonathan
Goodman. Jonathan recently performed in The Off Broadway Palm Theatres Lend
Me a Tenor and appeared as Joseph in last summer’s Joseph and the Amazing Tech-
nicolor Dreamcoat at Broadway Palm.

Living in SWFL can be limiting as far as culture goes. It’s getting better with
theatres and art galleries popping up all over, so I’m always looking for some-
thing to do in Fort Myers.
I recently had the opportunity to check out “The Wizard of Oz” at the Broadway
Palm Dinner Theatre, so my friends and I went on opening night.
Having watched The Wizard of Oz as a child, I had high expectations, and I
must admit I giggled when a munchkin had a hard time staying on her feet, but I
have heard that this is an omen of a bright future ahead for that munchkin!
The “Wicked” Witch, played by Keara Trummel, was perfect for the part, Aside
from a few minor opening night mistakes, they did a wonderful job. Special
kudos to John Ramsey, as the Scarecrow- fresh from the sexy production of
CABARET, and Tony Parise who directed and choreographed.
If you have a family with young children or are just young at heart, I would
highly recommend planning a night at the Broadway Palm Dinner Theatre for
this fun production of The Wizard of Oz. Rachel-
