Appeal to Congressman McNerney, Senator Barbara Boxer and Senator Dian Feinstein

Dr. Sheikh cannot Practice Medicine in the State of California after receiving recommendations from University of California, University of Texas and Stanford School of Medicine. She cannot work because this is illegal in the State of California to practice Medicine without permission from the State (also known as license). The Medical Board of California refuses to issue license. The Medical Board intelligently denies compliance with the laws. Dr. Sheikh requested help from her representatives in the US representatives to restore Access to Justice.

Dear Congressman McNerney, I am writing your office to request your help as the Medical Board of California has improperly denied licensure of my wife Dr. Sheikh since 2007. Dr. Sheikh has provided Medical Services in the underserved area of San Joaquin County and she has also successfully completed her Residency training. Dr. Sheikh cannot practice her profession or provide patient care without a license from the State because the law requires that a physician get States permission to practice his/her profession (aka license) even when a physician has a certificate of Residency Completion from University of California. During Nov, 2007 the Medical Board did not approve Dr. Sheikhs license and the Board wrote that Dr. Sheikh will be licensed in July 2008. At that time Dr. Sheikh was providing patient care in Stockton as a Resident Physician. During December 2008 the Board denied Dr. Sheikhs application for licensure. The Board accused Dr. Sheikh of incorrectly answering question 14 of the application form that was completed in 2007. On July 27, 2009 Administrative Law Judge signed orders for Board to release a copy of records. The Board has improperly denied compliance with Judges orders because Boards story is a fiction. In the United States District Court, Dr. Sheikh submitted a Request for Admission per Federal Rules of Civil Procedure (FRCP) 36 that demonstrated that Dr. Sheikh had correctly completed the application form. The Board could not even present any opposition to Dr. Sheikhs Request for Admission. Dr. Sheikh filed a petition with the Federal Court of Appeals and unfortunately the Court of Appeals erred and dismissed the case without reviewing any documents or

Dr. Sheikh will be submitting a Motion for Reconsideration with the Ninth Circuit Court of Appeals with legal arguments. Dr. Sheikh is a highly qualified physician with exceptional recommendations from her fellow physicians and faculty at San Joaquin General Hospital, VA Palo Alto Hospital, Stanford School of Medicine and University of Texas Medical Branch. This is disappointing that the State will not let her practice her profession and improperly deprive patients of the underserved area of San Joaquin of the services of such a qualified and a caring physician. The miserable story of Dr. Sheikh has been presented at five or more conferences whereas each conference was attended by hundreds of attorneys or hundreds of physicians; Many of the physicians and attorneys shockingly respond with a similar observation; We have never seen anything like this before. In such a dire situation, we seek help from our elected representatives (as we have been suggested by numerous individuals). Several years ago when Medical Board denied licensure of Dr. Hanson (from Alaska), Several United States Senators and Congressmen (under the leadership of Senator Kennedy) requested review from the Ninth Circuit Court of Appeals. As a result of the efforts of those esteemed public representatives, Dr. Hanson was successful in securing relief from that Court. Your office has demonstrated strong interest in the issues of physicians and healthcare in the central valley of California. We are also requesting help, via your office, from the US Senators Hon. Dianne Feinstein and Hon. Barbara Boxer. Senator Boxer has taken interest in the issues relevant to welfare of the Central valley. Senator Feinstein is our Senior Senator and she is also a member of Senate Judiciary Committee. With your help and with help from the esteemed United States Senators, Dr. Sheikh can practice her profession for which she has studied all of her life. Dr. Sheikh is the only bread winner of the Sheikh family. We are humbly requesting your help in this matter. We are confident that with your support and with the support from the US Senators, we can overcome these difficult circumstances. Well be glad to offer any cooperation and provide any information.
