LEGAL ARGUMENT The Federal Rules of Evidence mandate that judicial notice be taken where it is requested by a party and supplied with the necessary information, Fed. R. Evid. 201(d), and authorizes judicial notice at any stage of the proceeding. Fed. R. Evid. 201(f). Moreover, a judicially noticed fact must be one not subject to reasonable dispute in that it is either (1) generally known within the territorial jurisdiction of the trial court or (2) capable of accurate and ready determination by resort to sources whose accuracy cannot reasonably be questioned. Fed. R. Evid. 201(b). Courts may take judicial notice of court filings and other matters of public record. See Reyns Pasta Bella, LLC v. Visa USA, Inc., 442 F.3d 741, 746 n. 6 (9th Cir. 2006); see also Allen v. City of Los Angeles, 92 F.3d 842, 850 (9th Cir. 1992) (federal courts may take judicial notice of proceedings in other courts, both within and without federal judicial system, if those proceedings have a direct relation to matters at issue) (overruled on other grounds); Bryant v. Carleson, 444 F.2d 353, 357 (9th Cir. 1971) (court took judicial notice of proceedings and filings in other courts). Here, the requested facts are not subject to reasonable dispute in that they are capable of accurate and ready determination by referring to public records dockets, sources whose accuracy cannot reasonably be questioned. Fed. R. Evid. 201(b). Thus, the following documents are readily verifiable and the proper subjects of judicial notice, and Borodkin respectfully requests that this Court take judicial notice of them: Exhibit 1: The State Bar of California Standing Committee on Professional

Responsibility and Conduct Formal Opinion No. 1983-74 (Ethics Opinion No. 198374). Exhibit 2: Pages 1 to 3 of the May 11, 2010 declaration of Ed Magedson, filed

as Docket Number DN-31 in Asia Economic Institute LLC et al. v. Xcentric Ventures LLC et al., C.D.Cal. No. 10-cv-1360 (the California Action). Exhibit 3: Pages 19 to 28 of the Order of July 19, 2010, filed as Docket Number
