SB 13-200 Expand Medicaid Eligibility Sen. Aguilar & Rep. Ferrandino Staff Name: Amanda Levin What the Bill Does: Under current law, moneys in the hospital provider feeder cash fund may be used to increase, up to 100 percent of the federal poverty line (FLP), the Medicaid eligibility income level for parents of children who are eligible for Medicaid and for childless adults or adults without a dependent child in the home. It currently sets the income eligibility level at 61 percent of the FLP. To implement the federal Affordable Care Act, SB 13-200 will allow money in the hospital provider fee cash fund to be used to increase the income eligibility for parents and caretaker relatives of Medicaid children and childless adults or adults with a dependent child to 133 percent of the FLP. It will eliminate the requirement that if the moneys in the hospital provider fee cash fund, together with matching federal funds, are insufficient to fully fund parents of Medicaid children and childless adults, the state board may reduce the medical benefits for families whose income exceeds 60 percent of the FLP, or may reduce the percentage of the federal poverty line to below 100 percent but not below 60 percent. Colorado Context: In 2009, Medicaid covered 702,239 people in Colorado, constituting 13.9 percent of the states population.1 The Colorado Health Institute estimates that there are currently 27,000 people who are already eligible but not enrolled in Medicaid, and that 140,000 new people will become eligible under the new law by 2022, if passed.2 National Context: Twenty-four states plan to participate in expanding Medicaid under the ACA.3 Four states are leaning towards participating.4 Fourteen states plan not to participate,5 and three states are leaning towards not participating.6 Five states are currently undecided as to their participation in expanding medicaid.7

Bill Provisions: Adds caretaker relatives to the eligibility pool. Increases the eligibility level of parents and caretaker relatives of children who are eligible for Medicaid from 61% to 133% of the FLP. Provides eligibility for a childless adult or an adult without a dependent child in home, who is between the ages of 19 and 64 years and who earns up to 133% of FLP. Fiscal Impact: State revenue from hospital provider fees could change by allowing almost $160 million in expenditures currently paid with those funds to be refinanced with federal funds. The fee may be reduced accordingly or the revenue may be appropriated for a different, authorized purpose, such as implementing continuous eligibility. Overall, this bill increases state expenditures by $303.6 million and 17.8 FTE in FY 2013-14, $887.1 million and 20.0 FTE in FY 2014-15, and $1.1 billion and 20.0 FTE in FY 2015-16.8
