1. FACTORIES AND MACHINERY (ASBESTOS PROCESS) REGULATIONS

1986.
The most important aspects of the legislation are summarized here. The Factories and Machinery (Asbestos Process) Regulations, 1986: Establishes a permissible exposure limit (PEL) of 1 f/ml. Requires exhaust equipment to be provided in order to keep exposures below the PEL. It also requires the equipment to be examined and tested at specified intervals by a competent person. Requires employers to provide protective equipment in a prescribed area or where the concentration exceeds the FEL. This includes respiratory protection. Requires employees to be provided in the use of protective equipment. Places obligations on employees to use the equipment. Specifies requirements for cleaning and housekeeping. 2. FACTORIES AND MACHINERY (NOISE EXPOSURE) REGULATIONS 1989 The regulatory requirements are set out in the Factories and Machinery (Noise Exposure) Regulations 1989. Key requirements are: A permissible exposure limit is established. - Equivalent continuous sound level of 90d0(A) or - Noise dose of unity or - Not exceeding limit in schedule - Maximum noise level of 115d6(A) - Impulsive noise not to exceed 140d8 Method of compliance is by engineering and/or administrative controls. Protective equipment can be used only if these are not practicable. Initial and ongoing monitoring is specified for employees exposed above the action level. Hearing protection must be provided for employees exposed above the PEL (orabove the action level if the employee shows a threshold shift). Hearing protection must attenuate noise levels below the PEE and limit for impulsive noise. An audiometric testing program (to detect hearing loss) must be provided far all employees exposed above the action level. Details of the program are specified. Audiometric testing must be carried out every year if exposure is above PEL or there is a threshold shift. Employees must be trained in aspects of the legislation, effects of protective equipment and audiometric testing.

3. FACTORIES AND MACHINERY (MINERAL DUST) REGULATIONS 1989 Key aspects of the legislation are summarized here. Occupiers must provide and employees are required to use, protective clothing, respiratory equipment and other protective equipment. They must also report any defects in this equipment. Sand blasting (as defined) is prohibited unless written approval from the Chief Inspector is obtained. A PEL for mineral dusts (<1% free silica) of 5mg/m3 respirable and 10 mg/m3 total is established. A PEL of 1mg/rn3 for quartz and .05mg/m3 for cristobalite and trydimite is established. Occupiers are required to carry out atmospheric monitoring. Details are specified. - Initial monitoring of all employees in process area. - Every 6 months for exposures between the action level and PEL. - Every 3 months for exposures above the PEL. - Employees must be notified of results. Occupiers are required to use control equipment to remove dust (engineering controls). The equipment is to be inspected and maintained. The employer is required to provide personal protective equipment. Occupiers must provide for medical examination of employees exposed above the action level. The details of the examination are specified as are the time intervals. (<2 year intervals). Medical reports to be kept for at least 20 years by occupier. Occupiers must provide training for employees on the regulations, nature of the operation, control equipment and medical examination.
