Class IV Zoning Permit Z-IV March 26, 2013 Dear Kaua'i County Planning Commissioners, Please accept this testimony and add it to the public record. I strongly oppose this proposed cell tower in Kilauea. The high powered transmitters on cell towers do not belong in our neighborhoods or next to our children's schools. A recent investigation by the EMR Policy Institute has found that many cellular antenna sites in the U.S. exceed the FCC Maximum Public Exposure Guidelines (MPE) for radio frequency radiation (RFR). The FCC has only 2 employees for monitoring RFR violations and to date they have not inspected these sites or required the telcoms to turn down their emissions. The fact is our government, including here on Kaua'i, is not monitoring the RFR emissions at antenna sites and industry is not always in compliance. However even if the antennas do not violate the FCC MPE there is no guarantee of safety. According to researcher Magda Havas, PhD, BSc, RFR exposure guidelines, used in our wireless communications, range 5 orders of magnitude in countries around the world. Salzburg, Austria recommends that RFR levels be kept to: Outside 0.001 microwatts per centimeter squared (W/cm2) and Inside 0.0001 W/cm2. The U.S. FCC exposure guideline is 1000 W/cm2. In China, Russia, Italy, Switzerland and Monaco the guideline is 10 W/cm2. All of these exposure guidelines are set at the level that presumes to protect our body tissue from damage from the thermal heating generated by RFR exposure. The theory is that our body tissue dissipates the heat quickly enough so that there is no harm. While this in itself is not proven, the thermal effect theory ignores a vast body of evidence which documents harm at levels far below the FCC MPE. These biological effects include increased permeability of the blood brain barrier, increased calcium flux, increase in cancer and DNA breaks, induced stress proteins, and nerve damage. Exposure to this energy is associated with altered white blood cells in children; childhood leukemia; impaired motor function, reaction time and memory, headaches, dizziness, fatigue, weakness and insomnia. According to the BioInitiative 2012 Report, available at: www.bioinitiative.org: "The BioInitiative 2012 Report has been prepared by 29 authors from ten countries, ten holding medical degrees (MDs), 21 PhDs, and three MsC, MA or MPHs. Among the authors are three former presidents of the Bioelectromagnetics Society, and five full members of BEMS. One distinguished author is the Chair of the Russian National Committee on Non-Ionizing Radiation. Another is a Senior Advisor to the European Environmental Agency. As in 2007, each author is responsible for their own chapter. The great strength of the BioInitiative Report (www.bioinitiative.org) is that it has been done independent of governments, existing bodies and industry professional societies that have clung to old standards. Precisely because of this, the BioInitiative Report presents a solid scientific and public health policy assessment that is evidence-based... Roughly, 1800 new studies have been published in the last five years reporting effects at exposure levels ten to hundreds or thousands of times lower than allowed under safety limits in most countries of the world... This study covers EMF from powerlines, electrical wiring, appliances and hand-held devices; and from wireless technologies (cell and cordless phones, cell towers, smart meters, WI-FI, wireless laptops, wireless routers, baby monitors, and other electronic devices). Health topics include damage to DNA and genes, effects on memory, learning, behavior, attention, sleep disruption, cancer and neurological diseases like Alzheimers disease. New safety standards are urgently needed for protection against EMF and wireless exposures that now appear everywhere in daily life..." The report finds that RFR exposures should be kept below 0.001 W/cm2 in order to ensure public safety. (Compare to U.S. FCC exposure guideline of 1000 W/cm2.)

While most people want wireless communications, the siting of antennas needs to be based on minimizing harm. If there will be children or homes close to the antennas these people are more susceptible to harm from RFR exposure as chronic long-term exposure leads to cumulative damage and the development of electrohypersensitivty and childrens smaller bodies absorb more radiation. In addition, wildlife, with bees in particular, may have their navigational abilities interfered with due to RFR exposure. 10 out of the 14 peer reviewed epidemiological studies on cell tower emissions which meet the World Health Organizations criteria found significant increases in ill health effects. Included in this database are only those studies that are about cell tower exposures. (Kundi, 2008 at the London EMF International Conference). Populations close to cellular antennas show an increase in the effects of ill health in those closest to the antennas with the risks factors dropping off as distance and RFR levels decrease. Symptoms ranged from sleep disturbances to breast and brain cancers. New Cingular Wireless PCS has other options available for a cell tower. Kaua'i should not grant a variance on our height limit for unsightly cell towers that lower property values, mar view sheds for our residents and tourists and harm all who must live nearby.
