Request for contribution to run 1972 CCS pension case final hearing on 26th April, 2013 in the Supreme

e court of India, New Delhi.


Dear friends, Our wp(c) no:518/2012 for pension represented by Shri.PP Rao, one of the senior most and the best supreme court lawyers in our country got it tagged first with the SLP of Shri PN Mishra represented by Shri.Harish Salve, which was pending for more than a year even without issuing notice to the respondents was heard by Honble supreme court on 4 th Feb . and 11th February 2013, notice was issued and listed for final hearing for 3 rd April, 2013, along with a bunch of several similar SLP/WP etc. pending before the Honble supreme Court. This was possible due to the strenuous efforts on the part of our learned and reputed Counsels as well as efforts of both physical and financial mainly by Pune Region staff well supported by JNVs of Kerala, Karnataka, North East, MP and Rajasthan. But Our case could not be taken up on 3rd or on 4th April 2013 due to time factor. It is informed by our advocate that it would be coming for disposal on 26th April. We have been trying to receive back money from Ranchi JNV, which they had collected to support an individual case filed by Shri Mishra despite our request not to file a SLP by him as his case was weak and devoid of any merit as advised by several senior Advocates, but their greed to waste the hard earned money of our staff had resulted filing a writ petition before the Honble Supreme Court with all documents to support our claim as the fate of Sh. Mishra case was pending before the Hon. Supreme Court for last one year despite spending lacks of rupees. In our case so far we had spent around Rs. 10 lacks only. Our attempt to receive back money from Ranchi unit has not produced any positive response so far. We are taking steps to realize our money which was kept by Ranchi JNV unauthorizedly, but it will take some more time. We now further require around Rs.4 lacks to meet the legal expenses for engaging one of the prominent Advocates to argue the case for final hearing. Through this letter we appeal to all JNVs and Regional Office staff as well as NVS, Hqrs. staff to liberally contribute for the common cause of employees who are waiting impatiently for last 25 years for implementation of CCS(Pension) 1972. We do hope everybody will understand the importance of pension to the staff irrespective of outcome of promise made by Ministry/Samiti. Let us not forget that cabinet notes for pension had been submitted twice before, during the tenure of Shri. O.M Singh as well as Shri. Manoj Singh. In the First case, the Finance Ministry discussed and refused the proposal on various grounds. Second time. The Finance Ministry did not show interest to discuss further. Hence, we need to think how far the present cabinet note will help to change the attitude of Finance Ministry. Imagine a situation where we leave the hope on this writ and waiting for the result of Cabinet note and later no yield from that. There lies the importance to pursue this writ which is sure to win a favorable decision from the Supreme Court. Hence, let us not be carried away by the false propaganda going around as if the pension has been 100% materialized through on going cabinet note process. We are very

optimistic that not-with-standing the stand of Ministry our cherished dream is going to be fulfilled through the interference of Hon. Supreme Court.
