NEADS "MUST ANSWER" QUESTIONS

EQUIPMENT ISSUES

(1) The reach and extent of NEADS radar coverage:


— Did any of the four hijacked aircraft travel into areas that were beyond the
capability of NEADS radar equipment to pick up? If so, which flights and when?
(NB: I assume that 93 and 77 might have for some period of time, but it is
important to pin them down on specifics as to when they would have "regained"
vision on the targets)

(2) Communications capabilities with the cockpits of scrambled aircraft:


~ Understand specifics of any limitations NEADS has/had in transmitting
directly to pilots of airborne aircraft; from a communications perspective (vs. traffic
management), why does NEADS ever have to "go through" the FAA to talk to
their pilots?

AA11
(1) Response - Otis Scramble:
— Nail down the path, speed and mission of the fighters; why the hold over
Whiskey? Why not direct an immediate CAP over NYC, even if the target has
disappeared? (i.e., hit the WTC)

(2) Rebirth of AA 11
— Determine source of misinformation. Also, if NEADS understanding was that a
hijacked aircraft was headed for D.C., what warnings were sent to Pentagon,
White House, etc.? Why not contact Andrews?

UA175
(1) Notification:
-- If/when NEADS received notification of the hijacking of UA 175?

— Source for Chat Log entry (Bates #15939) and NORAD press release that
asserts "1243Z FAA NOTIFICATION OF UNITED AIRLINES FLIGHT 175
POSSIBLE HIJACK FROM BOSTON - SOURCE RADES" (NB: UA 175
wasn't hijacked at the time - correct?) See documents faxed to Azzarello.

AA77
(1) Notification
— Source of 0924 notification time that is contained in (1) NORAD timeline and
presentation to Commission last May? What exactly did they know about AA 77?
Fact it was hijacked? Location? If so, how?

(2) Tracking:
Independent of FAA notification, what measures (and when) did NEADS take to
track hijacked or wayward aircraft? Did NEADS trackers ever identify AA 77?
If not, why not?

(3) Response - Langley Scramble:


-- What was the target/reason NEADS launched Langley fighters? What was
their mission? Direction? Speed? Was NEADS communicating directly with the
pilots from the time of launch? If not, why not?

UA93

(1) Notification:
How and when did NEADS first learn about the hijacking of UA 93?

(2) Tracking:
Independent of FAA notification, what measures (and when) did NEADS take to
track hijacked or wayward aircraft? Did NEADS trackers ever identify UA 93?
If not, why not?

(3) Shoot Down Order:


Understand the specifics of WHO at NEADS received the shoot down order (from
the top brass down to the controllers), WHEN they received it, and WHAT they
did with it. In particular did the pilots ever receive the order, and if not, why not?

(4) ROE
- Understand the ROE that the pilots in CAPs were operating under at all times.
What was the effect of change in ROE from peacetime to transitional ROE?
When did it happen? When did NEADS receive the written, approved ROE?
Prior to that, what specific guidance was NEADS operating under?

FAA\NORAD COORDINATION

(1) Identify all high level communications between NEADS and FAA:
— Who did Marr talk to within FAA? Anyone at the Command Center or WOC?
What about Nasypany?
— Did NEADS establish an "open line" within anyone at the FAA, and if so who
and when? If not, why not?

NEADS\CONR\CMOC COMMUNICATION
Understand the chain of communications within NORAD on the morning of 9/11. (I
believe Kevin is working on this issue). Try to gain an understanding of Arnold's and
Eberhart's involvement (if at all) in running the air defense operation. Confirm that there
are no tapes/transcripts or other records related to these conversation.
TRAINING

(1) Training exercises involving shoot down orders:


— Ask each witness if they have ever participated in an exercise involving a
hijacked aircraft that they were instructed to shoot down.

(2) Training exercises involving hijacked aircraft on any type of suicide mission
— same question

(3) Training missions involving the National Capital Region

(4) Training missions involving actual coordination (as opposed to simulated)


with any level of the FAA (i.e., Centers, Tracon, HQ)

MISCELLANEOUS
(1) Atlantic City: Were there aircraft scrambled from Atlantic City on the morning of
9/11? If so, please provide details. If not, why was information fed into the Air Threat
Conference Call - around 10:00 am - that NORAD was generating fighter aircraft from
Atlantic City?

(2) After-Action Review: Ask each witness about their awareness of documents
produced post 9/11 assessing and evaluating the air defense operation that day.

(3) Assets other than Otis and Langley: Post 9/11 NORAD emphasized that, in terms
of the air defense response on 9/11, NORAD was limited to the assets at the seven alert
facilities - i.e., Otis and Langley for the east coast. Get on the record that assets from
other "non-alert" facilities were drawn from that day; why couldn't NEADS have pulled
assets from Andrews earlier on?

(4) Drug Interdiction: Probe NEADS involvement with drug interdiction missions post
9/11. How/when did that function become a part of NEADS mandate? To what extent
was NEADS involved in it?
