Toy Testers Registration Terms & Conditions

The Promoter is Colorific Australia Pty Ltd (ABN 17 805 259 425) of 2 Rayhur Street, Clayton VIC 3168, telephone (03) 9542 6666. WHO CAN REGISTER 2. Registration is open to residents of Melbourne living within 50km of the Colorific Head Office in Clayton, Victoria, who are current Facebook account holders and who are official fans of the Colorific Australia Facebook page by clicking the Like button at www.facebook.com/colorific.australia. 3. Entrants who do not have a Facebook account may register by sending their details through to marketing@colorific.com.au 4. Entrants must nominate a girl between the age of 5 and 12 years old to be registered as a Toy Tester and an accompanying legal guardian may also participate in a separate focus group. 5. Entry is limited to one per child. 6. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. 7. Due to confidentiality reasons, registration is not open to those who have any affiliations with competitors of Colorific. ENTRY DETAILS 8. There is no entry fee and no purchase necessary to enter this competition. 9. Information on "how to enter" forms part of conditions of entry. Enter by liking the page www.facebook.com/colorific.australia, selecting the Become a Toy Tester app and answering the questions posed, and sending your entry, address, phone number and age details online. 10. Promotion commences 20/05/2013 and closing date for entry will be 11:59pm Sun 26/05/2013. After this date no further registrations will be accepted. 11. Incomplete, indecipherable or illegible entries will be deemed invalid. 12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 13. No responsibility is accepted for late, lost or misdirected entries. 14. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions. Entry into the competition will be deemed as acceptance of these terms and conditions. WINNERS 15. The winners will be the entries selected, having regard to creativity and originality, at the Promoter's premises on 27/05/2013 16. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining the winner. No correspondence will be entered into. 17. The promoter will notify the winners by phone or email. Winners names will be published on the Colorific Facebook page (www.facebook.com/colorific.australia) on 27/05/13. 18. Upon receiving contact from Colorific, winners must confirm their availability to travel to Colorific head office in th th Clayton, Melbourne, on Tuesday 4 June from 4-6pm for 9-12 year olds, and Thursday 6 June from 4-6pm for 5-8 year olds. Unavailability at this time will result in the winner being re-drawn. 19. Attendance at the Toy Testers day will be subject to signing consent form and confidentiality agreement. 20. Children will participate in a focus group of other girls in their age group run by staff of Colorific. There is a separate focus group held for parents who wish to participate while waiting. 21. Participants in the Toy Testers day will receive goodie bag containing a selection of Colorific products. DISCLAIMER 22. The competition and these terms and conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia. 23. The Promoter collects entrants' personal information in order to conduct the promotion and notify winners. If the information requested is not provided, the entrant may not participate in the promotion. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. In participating in the Toy Testers day, the participants agree to co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners agree to grant the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use. 1.

25. If for any reason this competition is not capable of running as planned including infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter [subject to any written directions given under the Lottery And Gaming Regulations 1993 (SA)] reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems of the phone or of any phone network, or any combination thereof, including any injury or damage to participants or any other person's phone related to or resulting from participation or sending or receiving of any communication or of any materials in this competition. 26. The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of an emergency or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoters control. Any changes to the competition will be notified to entrants as soon as possible by the promoter. 27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 28. The Promoter shall not be liable for any loss or damage whatsoever suffered, including but not limited to direct or consequential loss, or personal injury suffered or sustained in connection with the redemption of and/or use of any other prizes.
