EMERGENCY (BY 20 MAY 2013) PETITION FOR WRIT OF MANDAMUS FOR CLERK TO ISSUE SUBPOENA FOR TO PETITIONER TO PRESENT INFORMATION TO FAIRFAX REGULAR GRAND JURY OF CRIMINAL ACTIVITY... BY GOVERNMENTAL... OR OFFICIAL TO: ! Chief Justice of the supreme Court of Virginia 1. FACT: In Police Notes of 02-17-99, a trusted

informant reported Paul Thomson is skimming money from drug dealers. FACT: In an entry minutes later was

stated that the FBI Special Agent Stiefvater would be contacted. FACT: On 05-17-2013, Petitioner, with a

collaborating witness, interviewed FBI Special Agent Stiefvater, who stated no one in the Police department ever gave him the information that Paul Thomson was skimming money from drug dealers. OPINION: The Thin Blue Line at work.

2. FACT:

In December 2010, after the Criminal Justice

Services Board meeting, Petitioner spoke with an honest Commonwealth Attorney. FACT: That man

suggested Petitioner contact the Virginia State Police. FACT: Petitioner contacted VSP by email and

then went in person on 4 January, where the Police Notes of 02-17-99 were shown to a Special Agent. FACT: Five days later, DEA Agents arrested Paul

Thomson for Drug Possession, Evidence Tampering, and Witness Tampering. FACT: Paul Thomson accepted a Plea

Deal on 27 June 2011 for 38 months in Federal Prison. FACT: Paul Thomson reported to Prison in late September 2011. REPORTED SIGHTING: On 15 May 2013,

Paul Thomson was seen at a Handley High track meet, 19 months after he went to federal prison. OPINION: Thicker Blue Line of prosecutor protect a prosecutor Sweet Deal of only 38 months, was made ever more sweeter by reduction to 19 or so months in prison.

3.! In December 2012, Petitioner wrote a letter of petition to his friend John Frey, Clerk of the Circuit Court of Fairfax County, and received a prompt and courteous reply saying that he did not have the authority, that I must petition the Chief Judge, Dennis Smith. 4.! Also in December 2012, Petitioner wrote a letter of petition to Commonwealth Attorney Raymond Morrogh, but received no reply, in over five months. 5.! Petitioner wrote other letters quoting relevant Code of Virginia sections to John Frey, and met with John Frey in his office to further discuss the issue. Frey referred Petitioner to Chief Judge Smith. On 3

May 2013, Chief Judge Smith signed an ORDER for filing without pre-payment of costs or fees. 6.! Petitioner filed a Motion to be before Judge Smith on 10 May 2013, then wrote, filed and in court, gave a copy of a first version of a MEMORANDUM OF POINTS AND AUTHORITIES to Chief Judge Smith, emphasizing the

immediacy of the issue, the 20 May 2012 date of meeting of the Fairfax Regular Grand Jury. 7. Petitioner did not bad mouth Commonwealth

Attorney Ray Morroghs neglect of the December 2012 letter of petition when Chief Judge Smith directed Petitioner to first go talk with the prosecutor. 8. Petitioner OBJECTED, at least three times, because

legal texts have said that is a necessary number, saying that given the criminal activity of Paul Thomson, former Commonwealth Attorney, and other government officials, his verbal order was violative of the Secrecy of Grand Jury and its witnesses. 9. Contrary to what he felt was the wise or

principled thing to do, Petitioner did as Chief Judge Smith ordered, and went directly to the Fairfax Commonwealth Attorney office. Morrogh was out, but

Petitioner spoke with his assistant Katherine Stott, on the morning of 10 May 2013.

10.! In over a week, with the deadline fast upon us, that being the 20 May 2013 meeting of the Fairfax Regular Grand Jury, NO letter, phone, email or text reply has been received from the Fairfax Commonwealth Attorney, who was first petitioned in December 2012. 11. A Government Official in the criminal justice

community, involved in the crimes of Federal Felon Paul Thomson, committed IN FAIRFAX COUNTY what the Petitioner investigates the Code of Virginia to see are three Felony crimes, and yet OTHER Governmental Officials, namely Chief Judge Smith and Commonwealth Attorney Morrogh, are creating an Obstruction of Justice by Delay and Denial of a legitimate report of crime by a governmental official to the Regular Grand Jury that under Code of Virginia has responsibility to hear and act on such matters. 12. Petitioner requests the Court to issue a Writ of Mandamus to either Commonwealth Attorney Morrogh to subpoena the Petitioner as Witness before the Regular Grand Jury, or even better, simply direct the Clerk of

the Circuit Court of Fairfax County, in this case the good and honorable public servant, John Frey, to have the Subpoena requested by the Petitioner this morning, 17 May 2013, prepared for service by the sheriff in the Fairfax Judicial Center on 20 May 2013, as was written on a Subpoena issued in January 1995 by the Winchester Circuit Court Clerk Office that was served by Police Investigator James Bailous, one of the former governmental officials who violated many laws of Virginia, and was fired by the new Winchester Police Chief, Dr. Gary Reynolds. ! ! ! ! ! !
